Dina Bakst

Dina Bakst is an American lawyer and worker's rights advocate. She is co-founder and co-president of A Better Balance, a national nonprofit organization that focuses on legislative advocacy and education on labor issues, particularly relating to pregnancy discrimination, sick leave, parental leave, and work–life balance. [1]

In 2020, Time magazine named Bakst on their list of "16 People and Groups Fighting for a More Equal America." [2]

In 2021, along with A Better Balance co-founder and co-president Sherry Leiwant, Bakst was awarded the Heinz Award for the Economy for A Better Balance's advocacy and policy work. [3]

A Better Balance

Bakst and Sherry Leiwant founded A Better Balance in New York City in 2006. [4]

Pregnant Workers Fairness Act

Under Bakst's leadership, A Better Balance was credited by Fast Company as the "primary driver" of the Pregnant Workers Fairness Act, which passed in December 2022. [5] Representative Jerry Nadler credited Bakst's January 2012 op-ed in The New York Times "Pregnant, and Pushed Out of a Job," as the inspiration for first introducing the Pregnant Workers Fairness Act in 2012. [6] [7] The organization helped draft the language of the bill. [8] [9]

Bakst presented witness testimony at a 2019 House Education and Labor Committee hearing on the Pregnant Workers Fairness Act [10] and again in 2021. [11]

New York State legislation

Under Bakst's leadership, A Better Balance played a key role in passing legislation in New York, including New York City's Earned Sick Time Act, which went into effect in 2014, [12] New York City's Pregnant Workers Fairness Act, which passed in 2013, [13] and New York's paid family leave law, which passed in 2016. [14]

Under Bakst’s leadership, New York passed a law in 2022 protecting workers from being disciplined for taking legally protected time off. [15]

Strategic litigation

Under Bakst's leadership, in 2017, alongside the National Women's Law Center and Mehri & Skalet, and Sedey Harper & Westhoff, A Better Balance filed a nationwide class-action lawsuit against Walmart for failure to accommodate pregnant workers. A Better Balance filed additional charges of disability discrimination against Walmart later that year. [16] In 2020, a federal court granted final approval to a $14 million settlement in the matter of Borders v. Wal-Mart Stores, Inc. [17]

Additionally, the city of Florence, Kentucky, reached an agreement in response to a case filed by A Better Balance under Bakst's leadership on behalf of two police officers who faced pregnancy discrimination on the job in 2016. [18]

The U.S. Equal Employment Opportunity Commission (EEOC) is a federal agency that was established via the Civil Rights Act of 1964 to administer and enforce civil rights laws against workplace discrimination. Pregnancy discrimination is a type of employment discrimination that occurs when expectant women are fired, not hired, or otherwise discriminated against due to their pregnancy or intention to become pregnant. Common forms of pregnancy discrimination include not being hired due to visible pregnancy or likelihood of becoming pregnant, being fired after informing an employer of one's pregnancy, being fired after maternity leave, and receiving a pay dock due to pregnancy. Pregnancy discrimination may also take the form of denying reasonable accommodations to workers based on pregnancy, childbirth, and related medical conditions. Pregnancy discrimination has also been examined to have an indirect relationship with the decline of a mother's physical and mental health. Convention on the Elimination of All Forms of Discrimination against Women prohibits dismissal on the grounds of maternity or pregnancy and ensures right to maternity leave or comparable social benefits. The Maternity Protection Convention C 183 proclaims adequate protection for pregnancy as well. Though women have some protection in the United States because of the Pregnancy Discrimination Act of 1978, it has not completely curbed the incidence of pregnancy discrimination. The Equal Rights Amendment could ensure more robust sex equality ensuring that women and men could both work and have children at the same time.

The California Civil Rights Department (CRD) is an agency of California state government charged with the protection of residents from employment, housing and public accommodation discrimination, and hate violence. It is the largest state civil rights agency in the United States. It also provides representation to the victims of hate crimes. CRD has a director who is appointed by the governor of California and maintains a total of five offices and five educational clinics throughout the state. Today, it is considered part of the California Business, Consumer Services, and Housing Agency.

The Pregnancy Discrimination Act (PDA) of 1978 is a United States federal statute. It amended Title VII of the Civil Rights Act of 1964 to "prohibit sex discrimination on the basis of pregnancy."

Employment discrimination law in the United States derives from the common law, and is codified in numerous state, federal, and local laws. These laws prohibit discrimination based on certain characteristics or "protected categories". The United States Constitution also prohibits discrimination by federal and state governments against their public employees. Discrimination in the private sector is not directly constrained by the Constitution, but has become subject to a growing body of federal and state law, including the Title VII of the Civil Rights Act of 1964. Federal law prohibits discrimination in a number of areas, including recruiting, hiring, job evaluations, promotion policies, training, compensation and disciplinary action. State laws often extend protection to additional categories or employers.

Mother's rights are the legal obligations for expecting mothers, existing mothers, and adoptive mothers in the United States. Issues that involve mothers' rights include labor rights, breast feeding, and family rights.

Pregnant patients' rights or Pregnant women's rights refers to the choices and legal rights available to a woman experiencing pregnancy or childbirth. Specifically those under medical care within a medical establishment or those under the care of a medical professional regardless of location.

Equal Rights Advocates (ERA) is an American non-profit gender justice/women's rights organization that was founded in 1974. ERA is a legal and advocacy organization for advancing rights and opportunities for women, girls, and people of gender identities through legal cases and policy advocacy.

Legal Momentum, founded in 1970, is a 501(c)(3) nonprofit and the nation's first and longest-serving legal advocacy group for women in the United States. Betty Friedan and Muriel Fox were its co-founders and Muriel Fox is an ongoing leader of the organization. Carol Baldwin Moody became President and CEO in April 2018. The organization, founded as the NOW Legal Defense and Education Fund, became Legal Momentum in 2004. Legal Momentum is a multi-issue organization dedicated to advancing women’s rights and gender equality, particularly in the areas of equal education opportunities; fairness in the courts; ending all forms of gender-based violence; workplace equality and economic empowerment. The organization employs three main strategies: impact litigation, policy advocacy, and educational initiatives. It is headquartered in New York City.

A protected group, protected class (US), or prohibited ground (Canada) is a category by which people qualified for special protection by a law, policy, or similar authority. In Canada and the United States, the term is frequently used in connection with employees and employment and housing. Where illegal discrimination on the basis of protected group status is concerned, a single act of discrimination may be based on more than one protected class. For example, discrimination based on antisemitism may relate to religion, ethnicity, national origin, or any combination of the three; discrimination against a pregnant woman might be based on sex, marital status, or both.

<span class="mw-page-title-main">Paycheck Fairness Act</span> Proposed law to address the gender pay gap

The Paycheck Fairness Act is a proposed United States labor law that would add procedural protections to the Equal Pay Act of 1963 and the Fair Labor Standards Act as part of an effort to address the gender pay gap in the United States. A Census Bureau report published in 2008 stated that women's median annual earnings were 77.5% of men's earnings. Recently this has narrowed, as by 2018, this was estimated to have decreased to women earning 80-85% of men's earnings. One study suggests that when the data is controlled for certain variables, the residual gap is around 5-7%; the same study concludes that the residual is because "hours of work in many occupations are worth more when given at particular moments and when the hours are more continuous. That is, in many occupations, earnings have a nonlinear relationship with respect to hours."

Women Employed is a nonprofit advocacy organization based in Chicago, Illinois. Founded in 1973, Women Employed's mission is to improve women's economic status and remove barriers to economic equity. They promote fair workplace practices, increase access to training and education, and provide women with tools and information to move into careers paying family-supporting wages.

The National Partnership for Women & Families is a nonprofit, nonpartisan 501(c)(3) organization based in Washington, D.C. Founded in 1971, the National Partnership works on public policies, education and outreach that focuses on women and families.

The maternal wall is a term referring to stereotypes and various forms of discrimination encountered by working mothers and mothers seeking employment. Women hit the maternal wall when they encounter workplace discrimination because of past, present, or future pregnancies or because they have taken one or more maternity leaves. Women may also be discriminated against when they opt for part-time or flexible work schedules. Maternal wall discrimination is not limited to childcare responsibilities. Both men and women with caregiving responsibilities, such as taking care of a sick parents or spouse, may also result in maternal wall discrimination. As such, maternal wall discrimination is also described as family responsibilities discrimination. Research suggests that the maternal wall is cemented by employer stereotypes and gender expectations.

Young v. United Parcel Service, 575 U.S. 206 (2015), is a United States Supreme Court case that the Court evaluated the requirements for bringing a disparate treatment claim under the Pregnancy Discrimination Act. In a 6–3 decision, the Court held that to bring such a claim, a pregnant employee must show that their employer refused to provide accommodations and that the employer later provided accommodations to other employees with similar restrictions. The Court then remanded the case to the United States Court of Appeals for the Fourth Circuit to determine whether the employer engaged in discrimination under this new test.

Victoria Ann Lipnic is an American lawyer and public figure. She served in multiple senior United States government positions. She was Commissioner of the U.S. Equal Employment Opportunity Commission (EEOC), nominated to two terms by President Barack Obama, 2010 – 2020.) She served as Chair (Acting) of the EEOC under President Donald J. Trump from 2017 – 2019. Prior to her appointments to the EEOC, she was Assistant Secretary of Labor under President George W. Bush. The United States Senate confirmed her unanimously to each of these positions.

<span class="mw-page-title-main">Pregnant Workers Fairness Act</span> 2022 United States federal law

The Pregnant Workers Fairness Act is a United States law meant to eliminate discrimination and ensure workplace accommodations for workers with known limitations related to pregnancy, childbirth, or a related medical condition. It applies to employers having fifteen or more employees. Originally a stand-alone bill first introduced in 2012, the bill was included as Division II of the Consolidated Appropriations Act, 2023, which was passed by Congress on December 27, 2022, and signed by President Joe Biden on December 29, 2022. The bill went into force on June 27, 2023.

Chelsey Glasson is an American user researcher, author, and workers' rights advocate. She sued Google, her former employer, for pregnancy discrimination, which ended in an undisclosed settlement after two years of litigation. She has successfully lobbied for pregnancy anti-discrimination and labor rights laws in Washington State.

Absence management, also known as leave management, is a combination of employer policies, procedures, or programs designed to handle employee leaves of absence and minimize the impact of those absences on the employer. Absence management programs aim to maximize productivity by supporting an employee from initial absence through return-to-work and stay-at-work plans.
