Douglas Burgess (born June 17, 1977) is an American author and historian specializing in maritime and legal history. He is credited as the first scholar to suggest a link between the definitions of piracy and terrorism in law. He is a featured blogger for The Huffington Post and is currently a professor of history in Yeshiva University [1] and affiliated professor at Benjamin N Cardozo School of Law.
Burgess was born in Norwalk, Connecticut, United States. After moving to Rhode Island, where his paternal family has lived for over three hundred years, he received his first education from the Quaker Friends at Moses Brown School. Burgess received a BA from McGill University in 1999, a JD from Cornell University in 2002, an LL.M. from the University of British Columbia in 2003, and a Ph.D. from Brown University in 2009.
In 2003, Burgess wrote a dissertation arguing for the legal linkages between piracy and terrorism, and for the possible use of piracy law as a foundation for defining international terrorist organizations. This concept was later articulated in articles for Legal Affairs [2] Magazine, the National Security Law Report, The New York Times , [3] and other publications. It appeared in book form as "The World For Ransom" (2010). Burgess continues to lecture around the world on counter-terrorism and the law.
Other published books include "The Pirates' Pact" (2005) and "Seize the Trident" (2003). Burgess has authored numerous articles for trade and scholarly journals, and one piece of fiction—a mystery set in Little Compton, Rhode Island. He is a featured blogger for The Huffington Post.
Piracy is an act of robbery or criminal violence by ship or boat-borne attackers upon another ship or a coastal area, typically with the goal of stealing cargo and other valuable goods. Those who conduct acts of piracy are called pirates, vessels used for piracy are pirate ships. The earliest documented instances of piracy were in the 14th century BC, when the Sea Peoples, a group of ocean raiders, attacked the ships of the Aegean and Mediterranean civilisations. Narrow channels which funnel shipping into predictable routes have long created opportunities for piracy, as well as for privateering and commerce raiding.
The First Barbary War (1801–1805), also known as the Tripolitan War and the Barbary Coast War, was a conflict during the Barbary Wars, in which the United States and Sweden fought against Tripolitania. Tripolitania had declared war against Sweden and the United States over disputes regarding tributary payments made by both states in exchange for a cessation of Tripolitatian commerce raiding at sea. United States President Thomas Jefferson refused to pay this tribute. Sweden had been at war with the Tripolitans since 1800.
The Barbary Wars were a series of two wars fought by the United States, Sweden, and the Kingdom of Sicily against the Barbary states and Morocco of North Africa in the early 19th century. Sweden had been at war with the Tripolitans since 1800 and was joined by the newly independent US. The First Barbary War extended from 10 May 1801 to 10 June 1805, with the Second Barbary War lasting only three days, ending on 19 June 1815.
The Second Barbary War (1815) or the U.S.–Algerian War was fought between the United States and the North African Barbary Coast states of Tripoli, Tunis, and Algiers. The war ended when the United States Senate ratified Commodore Stephen Decatur's Algerian treaty on 5 December 1815. However, Dey Omar Agha of Algeria repudiated the US treaty, refused to accept the terms of peace that had been ratified by the Congress of Vienna, and threatened the lives of all Christian inhabitants of Algiers. William Shaler was the US commissioner in Algiers who had negotiated alongside Decatur, but he fled aboard British vessels during the 1816 bombardment of Algiers. He negotiated a new treaty in 1816 which was not ratified by the Senate until 11 February 1822, because of an oversight.
The Barbary pirates, Barbary corsairs, or Ottoman corsairs were mainly Muslim pirates and privateers who operated from the Barbary States. This area was known in Europe as the Barbary Coast, in reference to the Berbers. The main purpose of their attacks was to capture slaves for the Barbary slave trade. Slaves in Barbary could be of many ethnicities, and of many different religions, such as Christian, Jewish, or Muslim. Their predation extended throughout the Mediterranean, south along West Africa's Atlantic seaboard and into the North Atlantic as far north as Iceland, but they primarily operated in the western Mediterranean. In addition to seizing merchant ships, they engaged in razzias, raids on European coastal towns and villages, mainly in Italy, France, Spain, and Portugal, but also in the British Isles, the Netherlands, and Iceland.
The Golden Age of Piracy is a common designation for the period between the 1650s and the 1730s, when maritime piracy was a significant factor in the histories of the North Atlantic and Indian Oceans.

Piracy in the Gulf of Guinea affects a number of countries in West Africa as well as the wider international community. By 2011, it had become an issue of global concern. Pirates in the Gulf of Guinea are often part of heavily armed criminal enterprises, who employ violent methods to steal oil cargo. In 2012, the International Maritime Bureau, Oceans Beyond Piracy and the Maritime Piracy Humanitarian Response Program reported that the number of vessels attacks by West African pirates had reached a world high, with 966 seafarers attacked during the year. According to the Control Risks Group, pirate attacks in the Gulf of Guinea had by mid-November 2013 maintained a steady level of around 100 attempted hijackings in the year, a close second behind the Strait of Malacca in Southeast Asia. Piracy in the Gulf of Guinea continues to be a concern to the shipping industry, which is affected significantly. At the same time, governments in the region generally highlight that the fight against piracy requires a broad understanding of maritime security throughout the Gulf of Guinea.
The Barbary slave trade involved slave markets in the Barbary States. European slaves were acquired by Muslim Barbary pirates in slave raids on ships and by raids on coastal towns from Italy to the Netherlands, Ireland and the southwest of Britain, as far north as Iceland and into the Eastern Mediterranean.
The Ganj-i-Sawai was an armed Ghanjah dhow belonging to the Mughals. During Aurangzeb's reign, it was captured on 7 September 1695 by the English pirate Henry Every en route from present-day Mocha, Yemen to Surat, India. Piracy off the coast of Somalia occurs in the Gulf of Aden, Guardafui Channel, and Somali Sea, in Somali territorial waters and other surrounding places and has a long and troubled history with different perspectives from different communities. United States v. Shi, 525 F.3d 709 is a case involving piracy on the high seas. The case held that United States could try foreign nationals on foreign-flagged vessels for crimes committed on the high seas, outside the territory of the United States.
The Sulu and Celebes Seas, a semi-enclosed sea area and porous region that covers an area of space around 1 million square kilometres, have been subject to illegal maritime activities since the pre-colonial era and continue to pose a maritime security threat to bordering nations up to this day. While piracy has long been identified as an ubiquitous challenge, being historically interwoven with the region, recent incidents also include other types of maritime crimes such as kidnapping and the trafficking of humans, arms and drugs. Attacks mostly classify as 'armed robbery against ships' according to the United Nations Convention on the Law of the Sea as they occur in maritime zones that lie under the sovereignty of a coastal state. Incidents in the Sulu and Celebes Seas specifically involve the abduction of crew members. Since March 2016, the Information Sharing Centre (ISC) of the Regional Cooperation Agreement on Combating Piracy and Armed Robbery against Ships in Asia (ReCAAP) reports a total of 86 abuctions, leading to the issue of a warning for ships transpassing the area.

International piracy law is international law that is meant to protect against piracy. Throughout history and legal precedents, pirates have been defined as hostis humani generis, Latin for "the enemy of all mankind". The United Nations has codified much of the law in the United Nations Convention on the Law of the Sea (UNCLOS), which defines different types of piracy and ways to combat it.
The Proclamation for Suppressing of Pirates was issued by George I of Great Britain on 5 September 1717. It promised a royal pardon for acts of piracy committed before the following 5 January to those pirates who surrendered themselves to the correct authority before a deadline. Originally, the surrender had to occur on or before 5 September 1718; this was later extended by a second proclamation to 1 July 1719.
