The Hale Commission was established by the Commonwealth of England on 30 January 1652 and led by Sir Matthew Hale to investigate law reform. Consisting of eight lawyers and thirteen laymen, the Commission met approximately three times a week and proposed changes as radical (at the time) as reducing the use of the death penalty, allowing witnesses, legal aid and lawyers for defendants in criminal cases and creating County Courts and a Court of Appeal for criminal cases. Though the Commission was unsuccessful at passing any of its measures under the Rump Parliament, two of its measures were put into law by the subsequent Barebone's Parliament, and, by the middle of the 20th century, most of the others were as well. Debate has occurred over the effectiveness and strife within the Commission between its more moderate and radical members; the general conclusion is that with the sheer volume of work produced and the vast proportion of moderate to radical members, it is unlikely such strife existed.
The loss of Charles I of England in the English Civil War led to the establishment of the Commonwealth of England on 19 May 1649. During the rule of both the Commonwealth and the succeeding Protectorate, there was considerable desire for law reform. Many judges and lawyers were corrupt, and criminal law followed no real reason or philosophy. Any felony was punishable by death, proceedings were in a form of Norman French, and judges regularly imprisoned jurors for reaching a verdict they disagreed with. [1] Cromwell and the Rump Parliament aimed to establish a "new society", which included reforming the law; to that end, on 30 January 1652 Sir Matthew Hale was appointed chairman of a commission to investigate law reform, which soon became known as the Hale Commission. The Commission's official remit was defined by the Commons; "taking into consideration what inconveniences there are in the law; and how the mischiefs which grow from delays, the chargeableness and irregularities in the proceedings in the law may be prevented, and the speediest way to reform the same, and to present their opinions to such committee as the Parliament shall appoint". [2]
The Commission consisted of eight lawyers and thirteen laymen, appointed by the Rump Parliament on 26 December 1651, [3] and sat from 23 January 1652 approximately three times a week in the chamber of the House of Lords. No Members of Parliament were allowed to sit. [4] In addition to Hale, members included John Desborough, John Rushworth, Hugh Peters, Anthony Cooper, [4] John Sadler, John Fountaine, William Steele, Henry Blount, William Roberts, Josiah Bemers, Samuel Moyer, Charles George Cock [note 1] and Matthew Thomlinson. [6]
The Commission recommended various changes. On the criminal law side, they supported reducing the use of the death penalty, although "wilful murderers" were still to be executed, and the abduction of a child under 16 was to be considered a capital crime. They also suggested allowing prisoners access to lawyers in any case where the prosecution was permitted representation and allowing witnesses for the defence to give evidence under oath. Legal aid was also considered, although the rejection of a case where legal aid was given would result in the defendant being sent to a workhouse for a month and whipped. [7] The abolition of peine forte et dure as a way to avoid the forfeiture of land was also proposed. [8]
For legal system reform, the Commission suggested the creation of county courts led by the Westminster judges with jurisdiction over civil actions, and small claims courts for amounts under £4 to be manned by commissioners, approved by Justices of the Peace. [9] They also supported the creation of a Court of Appeal consisting of laymen chosen by Parliament, the formation of a land registry and a permanent law commission. [10] Against Hale's wishes, the Commission called for the abolition of benefit of clergy, and the acquittal of those charged with justified homicide. [11] The Commission also suggested that debtors should no longer be imprisoned, and attorneys should be educated at an Inn of Court and not allowed to practise until they were admitted as members. [12]
None of the Commission's recommendations ever made it into law under the Rump Parliament, though the Commission did produce 16 bills. Several were read in the House of Commons, and the remainder given to the Parliamentary Law Committee in July 1652 following the Committee's dissolution on 23 July. [13] The Rump Parliament's successor, the Barebone's Parliament, brought two of the Commission's suggestions (to abolish fines for original writs and to develop procedures for civil marriages) into force through statutes. [14] Most of the Commission's suggestions were, at some point, followed. In 1837 the use of the death penalty was curtailed, and it was finally abolished in 1969. From 1702 onwards, witnesses were allowed for the defence, and the Prisoners' Counsel Act 1836 allowed legal representation for the defendants. The use of peine forte et dure was abolished in 1772, and the benefit of clergy in 1827. A permanent Law Commission was finally established with the Law Commissions Act 1965. [15] County Courts were finally established in 1846, and a Court of Criminal Appeal in 1907. [16]
Academic debate over the Commission's value has been strong. On the one hand, William Holdsworth wrote that the Commission was riven by strife between its lawyerly members and those of a more radical nature, and that its proposals were sometimes extreme. Other academics argued that the reform scheme was of great merit, [3] and Hostettler, writes that "there is no evidence to confirm the belief of Sir William Holdsworth that the lawyers had a difficult time with the laymen". [4] Mary Cotterell, writing in the English Historical Review , notes that 13 of the 21 members were certainly not radicals, although Moyer and Bemers, Blount and Peters certainly were. [17] The lawyers, all moderates, nevertheless dominated the discussions. Debate was on a highly technical level which prevented many of the laymen contributing much, [18] although six of them had been educated at the Inns of Court. [4] The large number of meetings and sheer volume of work produced also suggests that there was little dissent and argument. [19] John Hostettler, in his biography of Hale, has suggested that if the measures had been put into law immediately, "we would have been honouring such pioneers for their farsightedness in enhancing our legal system and the concept of justice". [16]
The Commonwealth was the political structure during the period from 1649 to 1660 when England and Wales, later along with Ireland and Scotland, were governed as a republic after the end of the Second English Civil War and the trial and execution of Charles I. The republic's existence was declared through "An Act declaring England to be a Commonwealth", adopted by the Rump Parliament on 19 May 1649. Power in the early Commonwealth was vested primarily in the Parliament and a Council of State. During the period, fighting continued, particularly in Ireland and Scotland, between the parliamentary forces and those opposed to them, as part of what is now generally referred to as the Third English Civil War.
The Long Parliament was an English Parliament which lasted from 1640 until 1660. It followed the fiasco of the Short Parliament, which had convened for only three weeks during the spring of 1640 after an 11-year parliamentary absence. In September 1640, King Charles I issued writs summoning a parliament to convene on 3 November 1640. He intended it to pass financial bills, a step made necessary by the costs of the Bishops' Wars in Scotland. The Long Parliament received its name from the fact that, by Act of Parliament, it stipulated it could be dissolved only with agreement of the members; and those members did not agree to its dissolution until 16 March 1660, after the English Civil War and near the close of the Interregnum.

The Protectorate was the period of the Commonwealth during which England and Wales, Scotland, Ireland and the English overseas possessions were governed by a Lord Protector as a republic. The Protectorate began in 1653, when the dissolution of the Rump Parliament and then Barebone's Parliament allowed Oliver Cromwell to be appointed Lord Protector of the Commonwealth under the terms of the Instrument of Government. In 1659, the Protectorate Parliament was dissolved by the Committee of Safety as Richard Cromwell, who had succeeded his father as Lord Protector, was unable to keep control of the Parliament and the Army. That marked the end of the Protectorate and the start of a second period of rule by the Rump Parliament as the legislature and the Council of State as the executive.
The Petition of Right, passed on 7 June 1628, is an English constitutional document setting out specific individual protections against the state, reportedly of equal value to Magna Carta and the Bill of Rights 1689. It was part of a wider conflict between Parliament and the Stuart monarchy that led to the 1638 to 1651 Wars of the Three Kingdoms, ultimately resolved in the 1688 Glorious Revolution.
The Rump Parliament was the English Parliament after Colonel Thomas Pride commanded soldiers to purge the Long Parliament, on 6 December 1648, of those members hostile to the Grandees' intention to try King Charles I for high treason.
Barebone's Parliament, also known as the Little Parliament, the Nominated Assembly and the Parliament of Saints, came into being on 4 July 1653, and was the last attempt of the English Commonwealth to find a stable political form before the installation of Oliver Cromwell as Lord Protector. It was an assembly entirely nominated by Oliver Cromwell and the Army's Council of Officers. It acquired its name from the nominee for the City of London, Praise-God Barebone. The Speaker of the House was Francis Rous. The total number of nominees was 140, 129 from England, five from Scotland and six from Ireland.
Thomas Erskine, 1st Baron Erskine, was a British lawyer and politician. He served as Lord High Chancellor of Great Britain between 1806 and 1807 in the Ministry of All the Talents.
Sir Samuel Romilly, was a British lawyer, politician and legal reformer. From a background in the commercial world, he became well-connected, and rose to public office and a prominent position in Parliament. After an early interest in radical politics, he built a career in chancery cases, and then turned to amelioration of the British criminal law.
John Sadler was an English lawyer, academic, Member of Parliament, Town Clerk of London, Hebraist, Neoplatonist and millenarian thinker, private secretary to Oliver Cromwell, and member of the Parliamentarian Council of State. He was Master of Magdalene College, Cambridge from 1650 to 1660.
Sir William Garrow was an English barrister, politician and judge known for his indirect reform of the advocacy system, which helped usher in the adversarial court system used in most common law nations today. He introduced the phrase "presumed innocent until proven guilty", insisting that defendants' accusers and their evidence be thoroughly tested in court. Born to a priest and his wife in Monken Hadley, then in Middlesex, Garrow was educated at his father's school in the village before being apprenticed to Thomas Southouse, an attorney in Cheapside, which preceded a pupillage with Mr. Crompton, a special pleader. A dedicated student of the law, Garrow frequently observed cases at the Old Bailey; as a result Crompton recommended that he become a solicitor or barrister. Garrow joined Lincoln's Inn in November 1778, and was called to the Bar on 27 November 1783. He quickly established himself as a criminal defence counsel, and in February 1793 was made a King's Counsel by HM Government to prosecute cases involving treason and felonies.
The Court of King's Bench, formally known as The Court of the King Before the King Himself, was a court of common law in the English legal system. Created in the late 12th to early 13th century from the curia regis, the King's Bench initially followed the monarch on his travels. The King's Bench finally joined the Court of Common Pleas and Exchequer of Pleas in Westminster Hall in 1318, making its last travels in 1421. The King's Bench was merged into the High Court of Justice by the Supreme Court of Judicature Act 1873, after which point the King's Bench was a division within the High Court. The King's Bench was staffed by one Chief Justice and usually three Puisne Justices.
Richard Salwey was an English politician who sat in the House of Commons variously between 1645 and 1659. He was a republican in politics and fought on the Parliamentary side in the English Civil War.
The Five Knights' case (1627) 3 How St Tr 1, is a case in English law, and now United Kingdom constitutional law, fought by five knights in 1627 against forced loans placed on them by King Charles I in a common law court.
Sir Nicholas Fuller was an English barrister and Member of Parliament. After studying at Christ's College, Cambridge, Fuller became a barrister of Gray's Inn. His legal career there began prosperously—he was employed by the Privy Council to examine witnesses—but was hampered later by his representation of the Puritans, a religious tendency which did not conform with the established Church of England. Fuller was repeatedly in contention with the ecclesiastical courts, including the Star Chamber and Court of High Commission, and was once expelled for the zeal with which he defended his client. In 1593 he was returned as the Member of Parliament for St Mawes, where he campaigned against the extension of recusancy laws. Outside of Parliament, he successfully brought a patents case which not only undermined the right of the Crown to issue patents but accurately predicted the attitude taken by the Statute of Monopolies two decades later.
The Case of the Dean of St Asaph, formally R v Shipley, was the 1784 trial of William Davies Shipley, the Dean of St Asaph, for seditious libel. In the aftermath of the American War of Independence, electoral reform had become a substantial issue, and William Pitt the Younger attempted to bring a Bill before Parliament to reform the electoral system. In its support Shipley republished a pamphlet written by his brother-in-law, Sir William Jones, which noted the defects of the existing system and argued in support of Pitt's reforms. Thomas FitzMaurice, the brother of British Prime Minister Earl of Shelburne, reacted by indicting Shipley for seditious libel, a criminal offence which acted as "the government's chief weapon against criticism", since merely publishing something that an individual judge interpreted as libel was enough for a conviction; a jury was prohibited from deciding whether the material was actually libellous. The law was widely seen as unfair, and a Society for Constitutional Information was formed to pay Shipley's legal fees. With financial backing from the society Shipley was able to secure the services of Thomas Erskine KC as his barrister.
Samuel Moyer was an English merchant and politician who sat in the House of Commons in 1653. He was a strong republican and supporter of the Parliamentary cause in the English Civil War.
In England, burning was a legal punishment inflicted on women found guilty of high treason, petty treason, and heresy. Over a period of several centuries, female convicts were publicly burnt at the stake, sometimes alive, for a range of activities including coining and mariticide.
