Judicial review in Scotland is a part of United Kingdom constitutional law that functions within the framework of Scots administrative law.
The power of judicial review of all actions of governmental and private bodies in Scotland is held by the Court of Session. The procedure is governed by Chapter 58 of the Rules of Court. [1]
Approximately 600 judicial review cases are raised every year, but most are settled by agreement with only a small minority having to be decided by the court.
There is a 3-month time limit on seeking judicial review (see Courts Reform (Scotland) Act 2014), although if proper administration is prejudiced by delay on the part of the pursuer, the court may exercise its discretion and refuse to grant a review.
Despite the procedural differences, the substantive laws regarding the grounds of judicial review in Scotland are similar to those in other western legal systems, with decisions in one jurisdiction regarded as highly persuasive in the others. There is, however, one substantial difference in Scotland since there is no distinction between review of a public body and a private body, which is different from, for example, judicial review in England and Wales, where review is only possible in the case of a public body or a quasi-public body ( West v. Secretary of State for Scotland ).
Generally, review is confined to purely procedural grounds (the official action was illegal or improper), although the court will also sanction decisions which are, in substance, so unreasonable that no reasonable decision-maker could have reached it (so-called Wednesbury unreasonableness). A more rigorous standard of substantive review is applied where the matter complained of touches upon the pursuer's rights in terms of the Human Rights Act 1998.

United Kingdom administrative law is part of UK constitutional law that is designed through judicial review to hold executive power and public bodies accountable under the law. A person can apply to the High Court to challenge a public body's decision if they have a "sufficient interest", within three months of the grounds of the cause of action becoming known. By contrast, claims against public bodies in tort or contract are usually limited by the Limitation Act 1980 to a period of 6 years. Almost any public body, or private bodies exercising public functions, can be the target of judicial review, including a government department, a local council, any Minister, the Prime Minister, or any other body that is created by law. The only public body whose decisions cannot be reviewed is Parliament, when it passes an Act. Otherwise, a claimant can argue that a public body's decision was unlawful in five main types of case: (1) it exceeded the lawful power of the body, used its power for an improper purpose, or acted unreasonably, (2) it violated a legitimate expectation, (3) failed to exercise relevant and independent judgement, (4) exhibited bias or a conflict of interest, or failed to give a fair hearing, and (5) violated a human right. As a remedy, a claimant can ask for the public body's decisions to be declared void and quashed, or it could ask for an order to make the body do something, or prevent the body from acting unlawfully. A court may also declare the parties' rights and duties, give an injunction, or compensation could also be payable in tort or contract.
Dunsmuir v New Brunswick, 2008 SCC 9, [2008] 1 SCR 190 was, prior to Canada v Vavilov, the leading Supreme Court of Canada decision on the topic of substantive review and standards of review. Dunsmuir is notable for combining the reasonableness (simpliciter) and the patent unreasonableness standards of review into a single reasonableness standard.
Wednesbury unreasonableness is a ground of judicial review in Singapore administrative law. A governmental decision that is Wednesbury-unreasonable may be quashed by the High Court. This type of unreasonableness of public body decisions was laid down in the English case of Associated Provincial Picture Houses v. Wednesbury Corporation (1947), where it was said that a public authority acts unreasonably when a decision it makes is "so absurd that no sensible person could ever dream that it lay within the powers of the authority". Wednesbury unreasonableness was subsequently equated with irrationality by the House of Lords in Council of Civil Service Unions v. Minister for the Civil Service. These cases have been applied numerous times in Singapore, though in some decisions it is not very clear whether the courts have applied such a stringent standard.
The doctrine of legitimate expectation in Singapore protects both procedural and substantive rights. In administrative law, a legitimate expectation generally arises when there has been a representation of a certain outcome by the public authorities to an individual. To derogate from the representation may amount to an abuse of power or unfairness. The doctrine of legitimate expectation as a ground to quash decisions of public authorities has been firmly established by the English courts. Thus, where a public authority has made a representation to an individual who would be affected by a decision by the authority, the individual has a legitimate expectation to have his or her views heard before the decision is taken. Alternatively, an individual may also have a legitimate expectation to a substantive right. The recognition of substantive legitimate expectations is somewhat controversial as it requires a balancing of the requirements of fairness against the reasons for any change in the authority's policy. This suggests the adoption of a free-standing proportionality approach, which has been said not to apply in administrative law.

North and East Devon Health Authority, ex parte Coughlan is a seminal case decided by the Court of Appeal of England and Wales in 1999 which clarified the court's role in relation to cases which involve substantive legitimate expectations. The Court held that when reviewing a decision of a public authority which is contrary to a prior assurance or representation by the authority, its role is not always limited to assessing if the decision is Wednesbury unreasonable or irrational. In some situations, it is entitled to determine whether it is fair to compel the authority to fulfil its representation, or whether there is a sufficient overriding public interest which justifies allowing the authority to depart from the promise made.
South African administrative law is the branch of public law in that country which regulates the legal relations of public authorities, whether with private individuals and organisations or with other public authorities, or better say, in present-day South Africa, which regulates "the activities of bodies that exercise public powers or perform public functions, irrespective of whether those bodies are public authorities in a strict sense." According to the Constitutional Court, administrative law is "an incident of the separation of powers under which the courts regulate and control the exercise of public power by the other branches of government."
Jurisdictional error is a concept in administrative law, particularly in the UK and Australia. Jurisdiction is the "authority to decide", and a jurisdictional error occurs when the extent of that authority is misconceived. Decisions affected by jurisdictional error can be quashed by judicial review. Examples of jurisdictional errors include asking a wrong question, ignoring relevant material, relying on irrelevant material, and breaching natural justice.
Yamataya v. Fisher, 189 U.S. 86 (1903), popularly known as the Japanese Immigrant Case, is a Supreme Court of the United States case about the federal government's power to exclude and deport certain classes of alien immigrants under the Immigration Act of 1891. The Supreme Court held that the courts may not interfere with a pending deportation unless the administrative hearing was unfair. However, deportation procedures are subject to constitutional scrutiny, under the Due Process Clause.
In Canada, judicial review is the process that allows courts to supervise administrative tribunals' exercise of their statutory powers. Judicial review of administrative action is only available for decisions made by a governmental or quasi-governmental authority. The process allows individuals to challenge state actions, and ensures that decisions made by administrative tribunals follow the rule of law. The practice is meant to ensure that powers delegated by government to boards and tribunals are not abused, and offers legal recourse when that power is misused, or the law is misapplied. Judicial review is meant to be a last resort for those seeking to redress a decision of an administrative decision maker.
