Lantern laws refer to the 18th-century legal code in New York City that mandated Black, mixed race, and Indigenous people carry candle lanterns while walking the streets after dark and not in company of a white person. [1] [2]
University of Texas at Austin Professor Simone Browne's most recent book, Dark Matters: On the Surveillance of Blackness, published by Duke University Press in 2015, argues that the history of the policing of Black people in and after the institution of chattel slavery remains central to contemporary technologies and practices of surveillance. [3] Browne argues that the candle lantern is an early example of a "supervisory technology," noting that the law carried a number of possible punishments for individuals caught walking without one of these illuminating apparatuses. Furthermore, she points out that during this period, any white person was deputized to stop any Black, mixed race, or Indigenous person they found in violation of the mandate. Browne proposes that this precedent, first devised and implemented during the colonial era, established the "legal framework for stop-and-frisk policing practices... long before our contemporary era." In R. Joshua Scannell's City University of New York dissertation "Electric Light: Automating the Carceral State During the Quantification of Everything," he extends Browne's work, to connect Lantern Laws in the past with the NYPD's present-day militarization of "high-intensity artificial lights, flood lights or the flashing roof lights from the police cars throughout the night in certain housing projects" which "[subject] people to violent illumination." The concept of a carceral archipelago was first used by the French historian and philosopher Michel Foucault in his 1975 publication, Surveiller et Punir, to describe the modern penal system of the 1970s, embodied by the well-known penal institution at Mettray in France. The phrase combines the adjective "carceral", which means that which is related to jail or prison, with archipelago—a group of islands. Foucault referred to the "island" units of the "archipelago" as a metaphor for the mechanisms, technologies, knowledge systems and networks related to a carceral continuum. The 1973 English publication of the book by Solzhenitsyn called The Gulag Archipelago referred to the forced labor camps and prisons that composed the sprawling carceral network of the Soviet Gulag.

Taking up and expanding on the goals of restorative justice such as individual/community accountability, reparation, and non-retributive responses to harm, transformative justice imagines and puts into practice alternatives to the formal, state-based criminal justice system.

Carceral feminism is a critical term for types of feminism that advocate for enhancing and increasing prison sentences that deal with feminist and gender issues. The term criticises the belief that harsher and longer prison sentences will help work towards solving these issues. The phrase "carceral feminism" was coined by Elizabeth Bernstein, a feminist sociologist, in her 2007 article, "The Sexual Politics of the 'New Abolitionism'". Examining the contemporary anti-trafficking movement in the United States, Bernstein introduced the term to describe a type of feminist activism which casts all forms of sexual labor as sex trafficking. She sees this as a retrograde step, suggesting it erodes the rights of women in the sex industry, and takes the focus off other important feminist issues, and expands the neoliberal agenda.

As the reliance on the internet economy grows, smarter technology with higher surveillance concerns and snooping means workers to have increased surveillance at their workplace. Hyper surveillance is highly targeted and intricate observation and monitoring among an individual, group of people, or faction.
