The members of the court at the start of 2003 were Chief Justice Arthur Chaskalson, Deputy Chief Justice Pius Langa, and judges Lourens Ackermann, Richard Goldstone, Tholie Madala, Yvonne Mokgoro, Dikgang Moseneke, Sandile Ngcobo, Kate O'Regan, Albie Sachs and Zak Yacoob. [1] Justice Goldstone retired in November and Justice Ackermann retired at the end of the year.

Basing its decision on the Bill of Rights in the Constitution – and in particular its explicit prohibition of discrimination based on sexual orientation – the court unanimously ruled that the crime of sodomy, as well as various other related provisions of the criminal law, were unconstitutional and therefore invalid.
