Manohar Lal Sharma is an Indian Supreme Court advocate, popular among Indian lawyers and known for filing several public interest litigations in India. [1]

Career

Starting with a public interest litigation in 1991 against provisions of the Places of Worship Act, 1991, Sharma has litigated a number of issues in Indian courts that have attracted media attention. [1]

He had filed the first petition before the Supreme Court about the Indian coal allocation scam. [2] He was also the first to challenge the government's decision to abrogate Article 370 of Indian Constitution. [1]

In 2007, as an independent advocate, he filed a public interest litigation petition in the Supreme Court in the case of Sant Muktabai Sahakari Sakhar Karkhana. [3] He also defended the accused in the 2012 Delhi gang rape case. [4] [1] The Delhi gang rape case shot him into the international media limelight [1] He was, at the time, the only lawyer prepared to defend the rape accused in the face of a boycott call by various advocate associations. [5]

Blaming the Nirbhaya Case victims for using public transport and lack of character

In defence of the accused in the 2012 Delhi gang rape and murder case, Sharma blamed the victim for using public transportation. He said, "Until today I have not seen a single incident or example of rape with a respected lady. Even an underworld don would not like to touch a girl with respect." [1] [6] Sharma claimed the gang rape was "planned by her boyfriend to gain political mileage." [7]

Contempt notice over false averments

On 18 November 2022, Supreme Court of India issued contempt notice to Sharma for allegedly attributing motives to Madhya Pradesh High Court Chief Justice Ravi Malimath in their petition challenging the High Court verdict. [8] [9]

The chief instrument through which judicial activism has flourished in India is public interest litigation (PIL) or social action litigation (SAL). It refers to litigation undertaken to secure public interest and demonstrates the availability of justice to socially-disadvantaged parties and was introduced by Justice P. N. Bhagwati and Justice V.R. Krishna Iyer. It is a relaxation on the traditional rule of locus standi. The Bombay High Court later passed an order to de-freeze NGO's domestic accounts. The case is ongoing in the Supreme Court of India.

The Juvenile Justice Act, 2000 is the primary legal framework for juvenile justice in India. The act provides for a special approach towards the prevention and treatment of juvenile delinquency and provides a framework for the protection, treatment and rehabilitation of children in the purview of the juvenile justice system. This law, brought in compliance of the 1989 UN Convention on the Rights of the Child (UNCRC), repealed the earlier Juvenile Justice Act of 1986 after India signed and ratified the UNCRC in 1992. In the wake of Delhi gang rape, the law suffered a nationwide criticism owing to its helplessness against crimes where juveniles get involved in heinous crimes like rape and murder. In 2015, responding to the public sentiment, both the houses of parliament in India further amended the bill that proposed adult-like treatment for juveniles aged 16–18 above accused of heinous crimes. The lower house, i.e. Lok Sabha passed the bill on 7 May 2015 and the upper house, i.e. Rajya Sabha on 22 December 2015. The bill was approved by President Pranab Mukherjee's assent on 31 December 2015.

Prashant Bhushan is an Indian author and a public interest lawyer in the Supreme Court of India. He was a member of the faction of the India Against Corruption (IAC) movement known as Team Anna which supported Anna Hazare's campaign for the implementation of the Jan Lokpal Bill. After a split in IAC, he helped Team Anna form the Aam Aadmi Party. In 2015, he made several allegations against the party's leadership, its functioning and its deviation from the core ideology, values and commitments. He is one of the founders of Swaraj Abhiyan and Sambhaavnaa, an Institute of Public Policy and Politics.

The 2G spectrum case was a political controversy in which politicians and private officials of the United Progressive Alliance (UPA) coalition government India were allegedly involved in selling or allotting 122 2G spectrum licenses on conditions that provided an advantage to specific telecom operators. A. Raja, then Telecom Minister, was accused of selling 2G spectrum licenses at a very low cost which resulted in the loss of ₹1,760 billion in government revenue. Raja was also accused of not following rules and regulations as well as not recognizing any advice from the Ministries of Finance and Law and Justice of India while allotting 2G spectrum licenses to telecom operators. Series of allegations were made on allotting 2G spectrum licenses including allegations from Central Bureau of Investigation after investigating the case alleging Raja for intentionally advancing the cut-off date to favour some specific firms, which were allegedly ineligible for applying for telecom licenses, in return for bribes.

The Centre for Public Interest Litigation (CPIL) is an Indian non-governmental organisation that conducts litigation on matters of public interest. The CPIL was established by late Justice V. M. Tarkunde, a former judge of the Supreme Court of India.

The 2012 Delhi gang rape and murder, commonly known as the Nirbhaya case, involved a rape and fatal assault that occurred on 16 December 2012 in Munirka, a neighbourhood in South Delhi. The incident took place when Jyoti Singh, a 22-year-old physiotherapy intern, was beaten, gang-raped, and tortured in a private bus in which she was travelling with her male friend, Avnindra Pratap Pandey. There were six others in the bus, including the driver, all of whom raped the woman and beat her friend. She was rushed to Safdarjung Hospital in Delhi for treatment and, as the public outrage mounted, the government had her transferred to the prestigious Mount Elizabeth hospital, Singapore eleven days after the assault, where she succumbed to her injuries two days later. The incident generated widespread national and international coverage and was widely condemned, both in India and abroad. Subsequently, public protests against the state and central governments for failing to provide adequate security for women took place in New Delhi, where thousands of protesters clashed with security forces. Similar protests took place in major cities throughout the country. Since Indian law does not allow the press to publish a rape victim's name, the victim was widely known as Nirbhaya, meaning "fearless", and her struggle and death became a symbol of women's resistance to rape around the world.

Pran Nath Lekhi was an Indian Lawyer. He was one of India's leading lawyers, who primarily practiced at the Supreme Court of India and the High Court of Delhi. Lekhi was a well-known practitioner of constitutional laws and is famous for various Public Interest Litigations.

India's Daughter is a documentary film directed by Leslee Udwin and is part of the BBC's ongoing Storyville series. The film is based on the 2012 Delhi gang rape and murder of 22-year-old "Nirbhaya", who was a physiotherapy student. The documentary explores the events of the night of 16 December 2012, the protests which were sparked both nationally and internationally as a result of the assault, and the lives of the men before they committed the attack. The film is told through the use of reconstructed footage and interviews with those involved in the case, including the defence lawyers, psychiatrists, and one of the rapists.

Aman Lekhi is a senior advocate of the Supreme Court of India and is the former Additional Solicitor General of India in the Apex Court. He is named in the list of Top 100 Legal Luminaries of India by LexisNexis in May 2016.

Pratibha Rani is a former judge of the Delhi High Court, in Delhi, India. She gained public attention after writing several controversial judicial orders, including an granting bail to political activist Kanhaiya Kumar, in which she quoted Bollywood song lyrics and described surgical procedures to caution him, and another order describing the offence of rape as a "weapon for vengeance and personal vendetta". She has also written several significant judgments, including the reaffirmation of death penalty to the convicts of the 2012 Delhi gang-rape and murder, and the reduction of sentences and grant of bail to convicted offenders of child sexual abuse on the grounds that the child victim may have consented to the abuse.
