Massachusetts Comprehensive Permit Act: Chapter 40B

The Comprehensive Permit Act [1] is a Massachusetts law which allows developers of affordable housing to override certain aspects of municipal zoning bylaws and other requirements. It consists of Massachusetts General Laws (M.G.L.) Chapter 40B, Sections 20 through 23, along with associated regulations issued and administered by the Massachusetts Department of Housing and Community Development. [2] [3] Chapter 40B was enacted in 1969 to address the shortage of affordable housing statewide by reducing barriers created by local municipal building permit approval processes, local zoning, and other restrictions. Its goal is to encourage the production of affordable housing in all communities throughout the Commonwealth.

For the purposes of this statute, affordable housing is defined as a unit which could be purchased or rented by a household making up to 80% of the median income of the area. Such housing must be subject to affordable housing restrictions to preserve affordability in the long term.

Comprehensive permitting process

Under Chapter 40B, in any municipality where none of the three statutory minima identified by the State are met for the amount of affordable housing that exists in the community, a developer can build more densely than the municipal zoning bylaws would permit, allowing more units per acre of land when building a new development, if at least 25% (or 20% in certain cases [4] ) of the new units have long-term affordability restrictions. The three statutory minima are the following: [5]

Chapter 40B continues to be controversial and it has not overcome the multiple barriers that exist to building affordable housing in the state. A study by the National Low Income Housing Coalition rated Massachusetts as being the least affordable state in which to rent an apartment in 2003. [6] Despite the law, fewer new affordable housing units are built in Massachusetts compared to the state's needs. The state government as a policy works toward increasing the supply of inexpensive housing. The shortage contributes to sprawl as workers move further away from jobs in order obtain affordably priced houses. The high price of housing is one reason that young adults move away from Massachusetts. [7]

Municipalities have occasionally attempted to gain "affordable" classification for existing inexpensive housing units which are not deed restricted to maintain the long-term future affordable status of the units. Some municipalities have requested that mobile homes be allowed. [8] [9] As of April 2016, state legislators are currently considering making this change. [10]

Impact

The goal of the Affordable Housing Law (Chapter 40B) is to make at least 10% of every Massachusetts's community's housing stock affordable for moderate income households. As of June 30, 2011, 39 communities had met that goal. Details are available on the Department of Housing and Community Development (DHCD) Subsidized Housing Inventory. In addition, 101 communities have developed Affordable Housing Production Plans that have been approved by DHCD. Six of those communities have been certified as meeting the benchmarks in their plans, which entitles them to "safe-harbor" protections from Chapter 40B proposals under 760 CMR 56.03()(b) and 56.03(4)(f).

Over the last decade, the Affordable Housing Law has been directly responsible for approximately 80% of the affordable housing built in Massachusetts outside the major cities. More than 58,000 homes have been created for working families, seniors, and people with disabilities all across the state because of this law. Nearly half of all of the units were created by non-profits, like Habitat for Humanity. [11]

Enforcement

The Massachusetts Office of the Inspector General, from 2005 to 2012, issued several reports criticizing lax enforcement of developers' profit limitations for 40B developments, and described subterfuges used by developers to earn more profit on affordable housing than the statute and regulations permit, and that the municipalities and the state have inadequate supervision, auditing, and enforcement of the municipal agreements with developers and developers' reporting of sales and profits under the agreements and law. [12] [13] In addition, until he left office in 2012, Massachusetts Inspector General Gregory Sullivan frequently criticized Chapter 40B. [14] As a result of recommendations from the Office of the Inspector General, the Department of Housing and Community Development has "taken constructive actions to address the identified weaknesses that will strengthen the overall control process exercised by both Chapter 40B rental development owners and project administrators to ensure that only income-qualified households occupy affordable apartments developed under Chapter 40B." [15]

Changes in the law, 2008: SJC decisions and revised regulations

In 2008 the Massachusetts Department of Housing and Community Development issued a comprehensive revision of regulations and guidelines for Chapter 40B. In the same year, the Massachusetts Supreme Judicial Court issued seven decisions on substantive and procedural issues in regard to Chapter 40B law, nearly the number of decisions rendered during the previous decade. Opposition

Historically and at present, there has been opposition to Chapter 40B, with some claiming that it encourages building unaffordable homes at high densities with few affordable units. The law is criticized heavily that it gives real-estate developers tremendous abilities to abuse the law and overthrow any municipal rights by building minimum amounts of low-income housing while turning large profits on many high end properties.

Campaign to Protect the Affordable Housing Law

On November 2, 2010, Massachusetts voters rejected an initiative petition (Question 2) that would have repealed Chapter 40B. The vote was 1,254,759 (58%) against repeal to 900,405 (42%) in favor of repeal. [17] The Campaign to Protect the Affordable Housing Law, a state ballot committee, had been formed to oppose the elimination of the law. The campaign was a coalition of more than 950 individuals and organizations, including civic, business, religious, and academic leaders as well as senior, environmental, housing, and civil rights groups. The campaign was supported by all three gubernatorial candidates: Deval Patrick, Tim Cahill, and Charlie Baker. The group contended that repealing the affordable housing law would immediately halt the creation of housing that is affordable to seniors and working families in many communities across the Commonwealth of Massachusetts. Zoning Government policy allowing certain uses of land in different places

Zoning is a method of urban planning in which a municipality or other tier of government divides land into areas called zones, each of which has a set of regulations for new development that differs from other zones. Zones may be defined for a single use, they may combine several compatible activities by use, or in the case of form-based zoning, the differing regulations may govern the density, size and shape of allowed buildings whatever their use. The planning rules for each zone, determine whether planning permission for a given development may be granted. Zoning may specify a variety of outright and conditional uses of land. It may indicate the size and dimensions of lots that land may be subdivided into, or the form and scale of buildings. These guidelines are set in order to guide urban growth and development.

The Low-Income Housing Tax Credit is a dollar-for-dollar tax credit in the United States for affordable housing investments. It was created under the Tax Reform Act of 1986 (TRA86) and gives incentives for the utilization of private equity in the development of affordable housing aimed at low-income Americans, with affordability restrictions on the properties expring 15-30 years later. LIHTC accounts for the majority of all newly created affordable rental housing in the United States today. As the maximum rent that can be charged is based upon the Area Median Income ("AMI"), LIHTC housing remains unaffordable to many low-income renters. The credits are also commonly called Section 42 credits in reference to the applicable section of the Internal Revenue Code. The tax credits are more attractive than tax deductions as the credits provide a dollar-for-dollar reduction in a taxpayer's federal income tax, whereas a tax deduction only provides a reduction in taxable income. The "passive loss rules" and similar tax changes made by TRA86 greatly reduced the value of tax credits and deductions to individual taxpayers. Less than 10% of current credit expenditures are claimed by individual investors.

Inclusionary zoning (IZ), also known as inclusionary housing, refers to municipal and county planning ordinances that require a given share of new construction to be affordable by people with low to moderate incomes. The term inclusionary zoning indicates that these ordinances seek to counter exclusionary zoning practices, which aim to exclude low-cost housing from a municipality through the zoning code. There are variations among different inclusionary zoning programs. Firstly, they can be mandatory or voluntary. Though voluntary programs exist, the great majority has been built as a result of local mandatory programmes requiring developers to include the affordable units in their developments. There are also variations among the set-aside requirements, affordability levels coupled with the period of control. In order to encourage engagements in these zoning programs, developers are awarded with incentives for engaging in these programs, such as density bonus, expedited approval and fee waivers.

Act 250, Vermont's Land Use and Development Act, 10 V.S.A. § 6001 et seq., is a law passed in 1970 by the Vermont legislature designed to mitigate the effects of development through an application process that addresses the environmental and community impacts of projects that exceed a threshold in size.

Affordable housing Housing affordable to those with a median household income

Affordable housing is housing which is deemed affordable to those with a household income at or below the median as rated by the national government or a local government by a recognized housing affordability index. Most of the literature on affordable housing refers to mortgages and a number of forms that exist along a continuum – from emergency homeless shelters, to transitional housing, to non-market rental, to formal and informal rental, indigenous housing, and ending with affordable home ownership.

The Mount Laurel doctrine is a significant judicial doctrine of the New Jersey State Constitution. The doctrine requires that municipalities use their zoning powers in an affirmative manner to provide a realistic opportunity for the production of housing affordable to low- and moderate-income households.

Mixed-use development Type of urban development strategy

Mixed-use is a kind of urban development, urban design, urban planning and/or a zoning type that blends multiple uses, such as residential, commercial, cultural, institutional, or entertainment, into one space, where those functions are to some degree physically and functionally integrated, and that provides pedestrian connections. Mixed-use development may be applied to a single building, a block or neighborhood, or in zoning policy across an entire city or other administrative unit. These projects may be completed by a private developer, (quasi-) governmental agency, or a combination thereof. A mixed-use development may be a new construction, reuse of an existing building or brownfield site, or a combination.

Secondary suite

Secondary suites, or accessory dwelling units, ADUs, or in-law apartments, are self-contained apartments, cottages, or small residential units, that are located on a property that has a separate main, single-family home, duplex, or other residential unit. In some cases, the ADU or in-law is attached to the principal dwelling or is an entirely separate unit, located above a garage or in the backyard on the same property. In British English the term "annex" or granny annex is used instead. Reasons for wanting to add a secondary suite to a property may be to receive additional income, provide social and personal support to a family member, or obtain greater security.

Zoning in the United States

Zoning in the United States includes various land use laws falling under the police power rights of state governments and local governments to exercise authority over privately owned real property. Zoning laws in major cities originated with the Los Angeles zoning ordinances of 1904 and the New York City Zoning resolution of 1916. Starting in the early 1920s, the United States Commerce Department drafted model zoning and planning ordinances in the 1920s to facilitate states in drafting enabling laws. The constitutionality of zoning ordinances was upheld by the Supreme Court of the United States in Village of Euclid, Ohio v. Ambler Realty Co. in 1926

Exclusionary zoning is the use of zoning ordinances to exclude certain types of land uses from a given community, especially to regulate racial and economic diversity. In the United States, exclusionary zoning ordinances are standard in almost all communities. Exclusionary zoning was introduced in the early 1900s, typically to prevent racial and ethnic minorities from moving into middle- and upper-class neighborhoods. Municipalities use zoning to limit the supply of available housing units, such as by prohibiting multi-family residential dwellings or setting minimum lot size requirements. These ordinances raise costs, making it less likely that lower-income groups will move in. Development fees for variance, a building permit, a certificate of occupancy, a filing (legal) cost, special permits and planned-unit development applications for new housing also raise prices to levels inaccessible for lower income people.

In recent years, communities in Massachusetts have adopted resource protection zoning (RPZ) as a tool to protect natural resources and open space. RPZ, which was originally passed in Shutesbury, Massachusetts in spring 2008, includes elements of conservation subdivision regulations and cluster development bylaws, to regulate new subdivisions of land in a manner that maximizes the protection of natural resources.

2010 Massachusetts Question 2 Ballot measure in Massachusetts

The Massachusetts Comprehensive Permits and Regional Planning Initiative, also known as Question 2, appeared on the November 2, 2010 ballot in the state of Massachusetts as an initiative. Question 2 was rejected by the Massachusetts voters by 1,254,759 "No" votes to 900,405 "Yes" votes. The measure had been sponsored by Better Not Bigger, a local advocacy group in the state.

Housing trust fund

Housing trust funds are established sources of funding for affordable housing construction and other related purposes created by governments in the United States (U.S.). Housing Trust Funds (HTF) began as a way of funding affordable housing in the late 1970s. Since then, elected government officials from all levels of government in the U.S. have established housing trust funds to support the construction, acquisition, and preservation of affordable housing and related services to meet the housing needs of low-income households. Ideally, HTFs are funded through dedicated revenues like real estate transfer taxes or document recording fees to ensure a steady stream of funding rather than being dependent on regular budget processes. As of 2016, 400 state, local and county trust funds existed across the U.S.

Howard County Housing and Community Development

Howard County Housing is the umbrella organization for the Howard County Department of Housing and Community Development and the Howard County Housing Commission. The Department is Howard County Government’s housing agency and the Commission is a public housing authority and non-profit. Both have boards that meet monthly.

The Costa–Hawkins Rental Housing Act ("Costa–Hawkins") is a California state law, enacted in 1995, which places limits on municipal rent control ordinances. Costa–Hawkins preempts the field in two major ways. First, it prohibits cities from establishing rent control over certain kinds of residential units, e.g., single-family dwellings and condominiums, and newly constructed apartment units; these are deemed exempt. Second, it prohibits "vacancy control", also called "strict" rent control. The legislation was sponsored by Democratic Senator Jim Costa and Republican Assemblymember Phil Hawkins.

Missing middle housing describes a range of multi-family or clustered housing types that are compatible in scale with single-family or transitional neighborhoods. Missing middle housing is intended to meet the demand for walkable neighborhoods, respond to changing demographics, and provide housing at different price points. The term "missing middle" is meant to describe housing types that were common in the pre-WWII United States such as duplexes, rowhomes, and courtyard apartments but are now less common and, therefore, "missing". Rather than focusing on the number of units in a structure, missing middle housing emphasizes scale and heights that are appropriate for single-family neighborhoods or transitional neighborhoods. After the introduction of the term in 2010, the concept has been applied in the United States, Canada, and Australia.

The 421-a tax exemption is a property tax exemption in the U.S. state of New York that is given to real-estate developers for building new multi-family residential housing buildings in New York City. As currently written, the program also focuses on promoting affordable housing in the most densely populated areas of New York City. The exemption is granted for any buildings that add multiple new residential units, and typically lasts for 15 to 25 years after the building is completed. Longer exemption periods apply in less densely populated areas of the outer boroughs and upper Manhattan.

California Senate Bill 35 (2017)

California Senate Bill 35 is a statute streamlining housing construction in California counties and cities that fail to build enough housing to meet state mandated housing construction requirements. The bill was introduced to the California State Assembly by State Senator Scott Wiener (D-SF) on December 15, 2016. SB 35 aims to address the California housing shortage by increasing housing supply. The bill was signed into law on September 29, 2017 by Governor Jerry Brown as part of California’s 2017 Housing Package – a set of 15 bills that provide “an injection of new regulatory and financial resources” for cities.

Single-family zoning is a type of zoning in the United States that restricts development to only allow single-family detached homes. It disallows townhomes, duplexes, and multi-family housing (apartments) from being built on any plot of land with this zoning designation. It is a form of exclusionary zoning, and was created as a way to keep minorities out of white neighborhoods. It both increases the cost of housing units and decreases the supply. In many United States cities, 75% of land zoned for residential uses is zoned single-family.
