The National Dalit Commission is a Nepali constitutional body established with a view to provide safeguards against the exploitation of Dalits to promote and protect their social, educational, economic and cultural interests, special provisions were made in the Constitution. About 20 per cent of Nepal's population are Dalit. [1] [2]
The first Commission for Dalits was set up in 1963 [3] and caste-based discrimination was abolished in Nepal. The Interim Constitution of Nepal provides for freedom of religion and permits the practice of all religious groups; [4] however, there are some restrictions. The Interim Parliament declared the country a secular state in the Interim Constitution in January 2007. The Interim Constitution maintains the stipulation from the 1990 constitution that no one can be discriminated against based on caste. In 2002 the previous government constituted a National Dalit Commission charged with protecting and promoting Dalit (formerly called "untouchable") rights and ensuring active participation of the Dalit community in the development of the country. Before the People's Movement in April 2006, which led to removal of the King and his government, the Commission devised legal and policy arrangements for Dalit rights, made recommendations to implement international conventions to which the country is a party, monitored and coordinated non-governmental organizations (NGOs) on efforts to uplift Dalits, and launched programs on social awareness to end social discrimination and untouchability. After the success of the People's Movement, many members of the Commission were accused of being royalist and resigned, and the Commission was unable to function. The Interim Government nominated 16 members to the Commission on June 3, 2007. Later, the Caste Based Discrimination and Untouchability Act was passed in 2011.
The Constitution prohibits discrimination on the basis of caste; however, the caste system strongly influences society. While the Government has stressed that caste-based discrimination is illegal and temple access for "lower castes" has improved in some areas, caste discrimination was frequently practiced at Hindu temples, where Dalits were forbidden from entering by some Hindu priests.
Although such discrimination is prohibited by the Constitution, the caste system strongly influenced society. Societal discrimination against members of lower castes and Dalits remained widespread despite the Government's efforts to protect the rights of disadvantaged castes. Lower castes also experienced discrimination in many other areas of life, including education, employment, and marriage. Other religious communities did not practice caste discrimination. Entrance into many Hindu temples was often restricted for persons not of South Asian ethnicity, who are unlikely to be Hindu.
On April 11, 2007, the Ministry of Education and Sports reported that Dalit students in Parbat District had been refused admission to the high school completion examination based on their caste. The Ministry said it would take action against those involved; however, at the end of the reporting period, the Ministry had not done so.
On March 4, 2007, more than 100 Dalit families were forced to leave their village in Rautahat District after a clash between a Dalit and a higher caste individual during a religious festival. The families returned to their village on March 8 after police, human rights activists, and Dalit organizations intervened.
In October 2006 a Dalit family in Doti District was banished from its community because family members refused to play music (their traditional role) during a Hindu religious celebration. The family took refuge in a neighboring village.
Bhimrao Ramji Ambedkar was an Indian jurist, economist, social reformer and political leader who headed the committee drafting the Constitution of India from the Constituent Assembly debates, served as Law and Justice minister in the first cabinet of Jawaharlal Nehru, and inspired the Dalit Buddhist movement after renouncing Hinduism.
Untouchability is a form of social institution that legitimises and enforces practices that are discriminatory, humiliating, exclusionary and exploitative against people belonging to certain social groups. Although comparable forms of discrimination are found all over the world, untouchability involving the caste system is largely unique to South Asia.
Mahatma Ayyankali മഹാത്മ അയ്യൻകാളി(28 August 1863 – 18 June 1941) was an Indian politician, prominent social reformer, educator, economist, lawmaker, and revolutionary leader. He worked for the advancement of the oppressed people in the princely state of Travancore. His struggle resulted in many changes that improved the socio-political structure of Kerala. His determined and relentless efforts changed the lives of Dalits. He is known as king of pulaya.
Dalit is a term first coined by the Indian social reformer Jyotirao Phule for untouchables and outcasts, who represented the lowest stratum of the castes in the Indian subcontinent. Dalits were excluded from the fourfold varna of the caste hierarchy and were seen as forming a fifth varna, also known by the name of Panchama. Several scholars have drawn parallels between Dalits and the Burakumin of Japan, the Baekjeong of Korea and the peasant class of the medieval European feudal system.
The Scheduled Castes and Scheduled Tribes are officially designated groups of people and among the most disadvantaged socio-economic groups in India. The terms are recognized in the Constitution of India and the groups are designated in one or other of the categories. For much of the period of British rule in the Indian subcontinent, they were known as the Depressed Classes.
The Mandal Commission or the Socially and Educationally Backward Classes Commission (SEBC), was established in India in 1979 by the Janata Party government under Prime Minister Morarji Desai with a mandate to "identify the socially or educationally backward classes" of India. It was headed by B. P. Mandal, an Indian member of parliament, to consider the question of reservations for people to address caste discrimination, and to use eleven social, economic, and educational indicators to determine backwardness. In 1980, based on its rationale that OBCs identified on the basis of caste, social, economic indicators made up 52% of India's population, the commission's report recommended that members of Other Backward Classes (OBC) be granted reservations to 27% of jobs under the central government and public sector undertakings and seats in the higher education institutions, thus making the total number of reservations for SC, ST and OBC to 49.5%.
Jagjivan Ram, known popularly as Babuji, was an Indian independence activist and politician from Bihar. He was instrumental in the foundation of the All India Depressed Classes League, an organisation dedicated to attaining equality for dalits, in 1935 and was elected to Bihar Legislative Assembly in 1937, after which he organised the rural labour movement.
The Pallar, who prefer to be called Mallar, are an agricultural community from the Indian state of Tamil Nadu. The Pallars traditionally inhabited the fertile wetland area referred to as Marutham in the literary devices of the Sangam landscape. Today, they are the dominant Dalit community of southern Tamil Nadu and have developed a reputation for being assertive about their rights. Due to the demand of the pallar community to classify them under a more dignified generic name Devendrakula Velalar, recently they together with six other related castes have been given the name Devendrakula Velalar; however their original caste name remains valid and they are still part of the Scheduled Caste list.
The caste system in Kerala differed from that found in the rest of India. While the Indian caste system generally divided the four-fold Varna division of the society into Brahmins, Kshatriyas, Vaishyas and Shudras, in Kerala, there existed only two varnas: Brahmins and Shudras, out of these four, while others were classified as Avarna. The Malayali Brahmins formed the priestly class. Brahmins labeled all other castes as "Sat-sudra", "Shudra" and "Avarna" based on their origin and ritual rank. The exception to this were Kings in Kerala like of Travancore and Cochin, who were ritually promoted to the status of Kshatriya by means of the Hiranyagarbha ceremony.
The Nepalese caste system was the traditional system of social stratification of Nepal. The Nepalese caste system broadly borrows the classical Hindu Chaturvarnashram model, consisting of four broad social classes or varna: Brahmin, Kshatriya, Vaishya, Sudra.
The caste system in India is the paradigmatic ethnographic instance of social classification based on castes. It has its origins in ancient India, and was transformed by various ruling elites in medieval, early-modern, and modern India, especially in the aftermath of the collapse of the Mughal Empire and the establishment of the British Raj. It is today the basis of affirmative action programmes in India as enforced through its constitution. The caste system consists of two different concepts, varna and jati, which may be regarded as different levels of analysis of this system.
Constitution of Nepal 2015 is the present governing Constitution of Nepal. Nepal is governed according to the Constitution which came into effect on 20 September 2015, replacing the Interim Constitution of 2007. The constitution of Nepal is divided into 35 parts, 308 Articles and 9 Schedules.
The caste system among South Asian Christians often reflects stratification by sect, location, and the caste of their predecessors. There exists evidence to show that Christian individuals have mobility within their respective castes. But, in some cases, social inertia caused by their old traditions and biases against other castes remain, causing caste system to persist among South Asian Christians, to some extent. Christian priests, nuns, Dalits and similar groups are found in India, Pakistan, Bangladesh, and Nepal.
In India, a caste although it's a western stratification arrived from Portuguese word Casta and Latin word castus ,is a social group where membership is decided by birth. Broadly, Indian castes are divided into the Forward Castes, Other Backward Classes, Scheduled Castes, and Scheduled Tribes. Indian Christians and Indian Muslims are also function as castes. With castes separating individuals into different social groups, it follows that each group will have conflicting interests; oftentimes putting those with lower social standing in less favorable positions. An attempt to address this inequality has been the reservation system, which essentially acts as affirmative action to provide representation to caste groups that have been systematically disadvantaged. There have also been other cases where political parties, like the Bahujan Samaj Party (BSP), was formed to challenge the power of the upper castes.
Persecution and discrimination against Dalits has been observed in the countries such as Bangladesh, India, Pakistan, Nepal, the UK, and the US.
Nepal is a secular state under the Constitution of Nepal 2015, where "secular" means religious, cultural freedoms, including protection of religion and culture handed down from time immemorial.
Achieving Universal Health Care has been a key goal of the Indian Government since the Constitution was drafted. The Government has since launched several programs and policies to realize ‘Health for All’ in the nation. These measures are in line with the sustainable development goals set by the United Nations. Health disparities generated through the Hindu caste system have been a major roadblock in realizing these goals. The Dalit (untouchables) community occupies the lowest stratum of the Hindu caste system. Historically, they have performed menial jobs like - manual scavenging, skinning animal hide, and sanitation. The Indian constitution officially recognizes the Dalit community as ‘Scheduled Castes’ and bans caste-based discrimination of any form. However, caste and its far-reaching effects are still prominent in several domains including healthcare. Dalits and Adivasis have the lowest healthcare utilization and outcome percentage. Their living conditions and occupations put them at high risk for disease exposure. This, clubbed with discrimination from healthcare workers and lack of awareness makes them the most disadvantaged groups in society.
Dalit feminism is a feminist perspective that includes questioning caste and gender roles among the Dalit population and within feminism and the larger women's movement. Dalit women primarily live in South Asia, mainly in Bangladesh, India, Nepal and Pakistan. Dalit women face different challenges than women in oppressor castes in these countries. They are more likely to be poor, uneducated and socially marginalized. Dalit feminists advocate and have advocated for equal rights for Dalit women based on gender, caste and other issues. They have addressed conferences, created organizations and helped elect other Dalit women into political office.
The 2004 Kalapatti violence refers to the violence against Dalits by dominant-caste villagers in the village of Kalapatti, Tamil Nadu on 16 May 2004. About 100 Dalit houses have been burned down by a mob of 200 villagers and Dalits who attempted to escape were attacked. The attacks lasted for 2 hours and 14 people were seriously injured in the violence including a man's arm reportedly hacked off.
Caste discrimination in the United States is a form of discrimination based on the social hierarchy which is determined by a person's birth. Though the use of the term caste is more prevalent in South Asia and Bali, in the United States, Indian Americans also use the term caste.
