The Old Scottish Poor Law was the Poor Law system of Scotland between 1574 and 1845. [1]
Population growth and economic dislocation from the second half of the sixteenth century led to a growing problem of vagrancy. The government reacted with three major pieces of legislation in 1575, 1579 and 1592. The kirk became a major element of the system of poor relief and justices of the peace were given responsibility for dealing with the issue. The 1575 act, enabled through a Convention of the Estates, was modelled on the English act passed two years earlier and limited relief to the deserving poor of the old, sick and infirm, imposing draconian punishments on a long list of "masterful beggars", including jugglers, palmisters and unlicensed tutors. Parish deacons, elders or other overseers were to draw up lists of deserving poor and each would be assessed. Those not belonging to the parish were to be sent back to their place of birth and might be put in the stocks or otherwise punished, probably actually increasing the level of vagrancy. Unlike the English act, there was no attempt to provide work for the able-bodied poor. [2] In practice, the strictures on begging were often disregarded in times of extreme hardship. [3] This legislation provided the basis of what would later be known as the "Old Poor Law" in Scotland, which remained in place until reforms in 1845. [4] In most of Scotland a Poor Rate (local property tax for the relief of the poor) was not levied before the act of 1845.
Most subsequent legislation built on the principles of provision for the local deserving poor and punishment of mobile and undeserving "sturdie beggars". The most important later act was that of 1649, which declared that local heritors were to be assessed by kirk session to provide the financial resources for local relief, rather than relying on voluntary contributions. [5] The system was largely able to cope with the general level of poverty and minor crises, helping the old and infirm to survive and provide life support in periods of downturn at relatively low cost, but was overwhelmed in the major subsistence crisis of the 1690s. [6]
The English Poor Laws were a system of poor relief in England and Wales that developed out of the codification of late-medieval and Tudor-era laws in 1587–1598. The system continued until the modern welfare state emerged after the Second World War.

Agriculture in Scotland includes all land use for arable, horticultural or pastoral activity in Scotland, or around its coasts. The first permanent settlements and farming date from the Neolithic period, from around 6,000 years ago. From the beginning of the Bronze Age, about 2000 BCE, arable land spread at the expense of forest. From the Iron Age, beginning in the seventh century BCE, there was use of cultivation ridges and terraces. During the period of Roman occupation there was a reduction in agriculture and the early Middle Ages were a period of climate deterioration resulting in more unproductive land. Most farms had to produce a self-sufficient diet, supplemented by hunter-gathering. More oats and barley were grown, and cattle were the most important domesticated animal. From c. 1150 to 1300, the Medieval Warm Period allowed cultivation at greater heights and made land more productive. The system of infield and outfield agriculture may have been introduced with feudalism from the twelfth century. The rural economy boomed in the thirteenth century, but by the 1360s there was a severe falling off in incomes to be followed by a slow recovery in the fifteenth century.

Scottish religion in the eighteenth century includes all forms of religious organisation and belief in Scotland in the eighteenth century. This period saw the beginnings of a fragmentation of the Church of Scotland that had been created in the Reformation and established on a fully Presbyterian basis after the Glorious Revolution. These fractures were prompted by issues of government and patronage, but reflected a wider division between the Evangelicals and the Moderate Party. The legal right of lay patrons to present clergymen of their choice to local ecclesiastical livings led to minor schisms from the church. The Highlands were subdivided by the Great Glen and the Lowlands into the fertile Central Lowlands and the Southern Uplands. The Uplands and Highlands had a relatively short growing season, exacerbated by the Little Ice Age, which peaked towards the end of the seventeenth century.

This era saw the impact of the Little Ice Age, which peaked towards the end of the seventeenth century. Almost half the years in the second half of the sixteenth century saw local or national scarcity, necessitating the shipping of large quantities of grain from the Baltic. In the early seventeenth century famine was relatively common, but became rarer as the century progressed. The closing decade of the seventeenth century saw a slump, followed by four years of failed harvests, in what is known as the "seven ill years", but these shortages would be the last of their kind.
The Seven Ill Years, also known as the Seven Lean Years, is the term used for a period of widespread and prolonged famine in Scotland during the 1690s, named after the biblical famine in Egypt predicted by Joseph in the Book of Genesis. Estimates suggest between 5 and 15% of the total Scottish population died of starvation, while in areas like Aberdeenshire death rates may have reached 25%. One reason the shortages of the 1690s are so well remembered is because they were the last of their kind.
The Royal Court of Scotland was the administrative, political and artistic centre of the Kingdom of Scotland. It emerged in the tenth century and continued until it ceased to function when James VI inherited the throne of England in 1603. For most of the medieval era, the king had no "capital" as such. The Pictish centre of Forteviot was the chief royal seat of the early Gaelic Kingdom of Alba that became the Kingdom of Scotland. In the twelfth and thirteenth centuries Scone was a centre for royal business. Edinburgh only began to emerge as the capital in the reign of James III but his successors undertook occasional royal progress to a part of the kingdom. Little is known about the structure of the Scottish royal court in the period before the reign of David I when it began to take on a distinctly feudal character, with the major offices of the Steward, Chamberlain, Constable, Marischal and Lord Chancellor. By the early modern era the court consisted of leading nobles, office holders, ambassadors and supplicants who surrounded the king or queen. The Chancellor was now effectively the first minister of the kingdom and from the mid-sixteenth century he was the leading figure of the Privy Council.
The Scottish poorhouse, occasionally referred to as a workhouse, provided accommodation for the destitute and poor in Scotland. The term poorhouse was almost invariably used to describe the institutions in that country, as unlike the regime in their workhouse counterparts in neighbouring England and Wales residents were not usually required to labour in return for their upkeep.
The Vagrancy Act 1898 was a piece of legislation in England and Wales that criminalised men who lived off the earnings of prostitution (pimping) and who solicited in public places. The bill was generally viewed as successful in its impact, leading to the similar Immoral Traffic (Scotland) Act.
