Paul Kihara Kariuki is a Kenyan lawyer and a former court of appeal president and judge. He was nominated for the post of Office of Attorney General of Kenya by President Uhuru Kenyatta on 13 February 2018 [2] following the resignation [3] of Githu Muigai.

Background and education

Paul Kihara Kariuki was born on 11, May 1954 in Kiambu, Kenya. His parents are the Late Bishop of Anglican Church, Bishop Obadiah Kariuki and Lillian Wairimu the daughter of Senior Chief Koinange. He attended Nairobi School and graduated from the University of Nairobi with a Bachelor of Laws degree in 1977.

Judicial career

Between 1977 and 1980 Kariuki was a legal assistant at Hamilton, Harrison, and Matthews in Nairobi and then a partner from 1981 to 1986.

In 1986 he established Ndungu Njoroge and Kwach Advocates with his partners where he practiced until 2000, then was appointed the director of Kenya School of Law, a position that had become vacant after the previous holder, Leonard Njagi, was appointed a High Court judge.

In October 2003, Kariuki was one of the judges appointed as judges of the High Court by President Kibaki. On appointment, Justice Kariuki became the duty judge at the High Court, replacing Justice Isaac Lenaola who had been appointed a member of the tribunal to investigate judges who chose to contest their removal from the bench. Justice Kariuki was to hold the position of duty judge for the next two years. [4]

In 2006, Chief Justice Gicheru appointed an integrity review committee and appointed Kariuki to head this committee.

In 2009, the Chief Justice appointed Justice Kariuki to head the newly established Judicial Training Institute (JTI).

In 2012 Justice Kariuki was appointed as a Court of Appeal Judge and later appointed as President of the Court of appeal. [5]

The Judiciary of Kenya is the system of courts that interprets and applies the law in Kenya. After the promulgation of the Constitution of Kenya in 2010, the general public, through parliament, sought to reform the judiciary. Parliament passed the Magistrates and Judges Vetting Act of 2011. A major part of reforming the judiciary was the vetting of Magistrates and Judges in an attempt to weed out unsuitable ones. The Judicature Act has also been amended to raise the minimum number of Magistrates and Judges allowing more judicial officers to be hired. More magistrates and judges are needed to clear the backlog of cases that have caused great delay in the conclusion of cases and to staff new courts. New courts are needed to bring the courts closer to the people which is in line with devolution, a major principle written into the Constitution of 2010. New courts like the High Court opened in Garissa in November 2014 is a good example. In the past residents of North Eastern Kenya had to go all the way to Embu to access a High Court.

She served as the Registrar of the Supreme Court of Kenya from February 2013 to December 2021 and was involved in handling the petition that led to the annulment of the election of Uhuru Kenyatta as president of Kenya, in August 2017. She serves as a Registrar in the Office of the Chief Registrar of the Judiciary from January 2022.

Justice William Ouko is a Kenyan lawyer and Judge with a wealth of experience in judicial and administrative service spanning over 34 years. He is currently serving as a Judge of the Supreme Court of Kenya. He was nominated by the Judicial Service Commission for the seat of a Judge of the Supreme Court on 5 May 2021. On 14 May 2021, he was appointed to the position by the President of the Republic of Kenya H.E Uhuru Kenyatta, CGH and was subsequently sworn in on 21 May 2021. He served as the President of the Court of Appeal of Kenya prior to his appointment to the Supreme Court, a position to which he was elected on 9 March 2018.

David Ndii & Others V. Attorney General & Others also known as the BBI Judgement, was a landmark ruling made in the Kenya High Court on 13 May 2021, which issued an injunction on Kenya's Independent Electoral and Boundaries Commission (IEBC) from proceeding with President Uhuru Kenyatta's and retired Prime Minister Raila Odinga's Building Bridges Initiative. The five-judge bench was to determine seventeen questions raised on the petition against the BBI Process.
