Privately owned public space (POPS), or alternatively, privately owned public open spaces (POPOS), are terms used to describe a type of public space that, although privately owned, is legally required to be open to the public under a city's zoning ordinance or other land-use law. The acronym POPOS is preferentially used over POPS on the west coast of the US. Both terms can be used to represent either a singular or plural space or spaces. These spaces are usually the product of a deal between cities and private real estate developers in which cities grant valuable zoning concessions and developers provide in return privately owned public spaces in or near their buildings. Privately owned public spaces commonly include plazas, arcades, small parks, and atriums. Many cities worldwide, including Auckland, [1] New York City, San Francisco, Dublin, [2] Seattle, [3] [4] Seoul, and Toronto, have privately owned public spaces.
The term privately owned public space was popularized by Harvard professor Jerold S. Kayden through his 2000 book Privately Owned Public Space: The New York City Experience, written in collaboration with the New York City Department of City Planning and the Municipal Art Society of New York. [5] It attributed this type of public space to a "legal innovation" introduced in 1961 in New York City, an "incentive zoning" mechanism offering developers the right to build 10 square feet of bonus rentable or sellable floor area in return for one square foot of plaza, and three square feet of bonus floor area in return for one square foot of arcade. [5] Between 1961 and 2000, 503 privately owned public spaces, scattered almost entirely in downtown, midtown, and upper east and west sides of New York City's borough of Manhattan, were constructed at 320 buildings. The book cited the quantitative success of the program's public space production but reported that 41 percent of these spaces were of "marginal" quality and roughly 50 percent of buildings had one or more spaces apparently out of compliance with applicable legal requirements resulting in privatization. While privately owned public space as a term of art refers specifically to private property required to be usable by the public under zoning or similar regulatory arrangements, the phrase in its broadest sense can refer to places, like shopping malls and hotel lobbies, that are privately owned and open to the public, even if they are not legally required to be open to the public.[ citation needed ]
In 2017, The Guardian published a study of the phenomenon in London, [6] facing a lack of response from both landowners and local authorities they questioned on the subject. In reaction to the report, the Mayor of London, Sadiq Khan promised to publish new guidelines on how these spaces are governed. [6]
A public space is a place that is open and accessible to the general public. Roads, pavements, public squares, parks, and beaches are typically considered public space. To a limited extent, government buildings which are open to the public, such as public libraries, are public spaces, although they tend to have restricted areas and greater limits upon use. Although not considered public space, privately owned buildings or property visible from sidewalks and public thoroughfares may affect the public visual landscape, for example, by outdoor advertising. Recently, the concept of shared space has been advanced to enhance the experience of pedestrians in public space jointly used by automobiles and other vehicles.
The Seagram Building is a skyscraper at 375 Park Avenue, between 52nd and 53rd Streets, in the Midtown Manhattan neighborhood of New York City. Designed by Ludwig Mies van der Rohe along with Philip Johnson, Ely Jacques Kahn, and Robert Allan Jacobs, the high-rise tower is 515 feet (157 m) tall with 38 stories. The International Style building, completed in 1958, initially served as the headquarters of the Seagram Company, a Canadian distiller.
One Worldwide Plaza is the largest tower of Worldwide Plaza, a three-building commercial and residential complex in the Hell's Kitchen neighborhood of Manhattan in New York City. Designed by David Childs of Skidmore, Owings & Merrill (SOM), One Worldwide Plaza is an office building measuring 778 feet (237 m) tall, with an alternative address of 825 Eighth Avenue. It is the easternmost building in the Worldwide Plaza complex, which occupies the entire city block bounded by Eighth Avenue, Ninth Avenue, 49th Street, and 50th Street and is built on the site of New York City's third Madison Square Garden. Adjacent to One Worldwide Plaza to the west are a public plaza and two residential buildings.
28 Liberty Street, formerly known as One Chase Manhattan Plaza, is a 60-story International Style skyscraper between Nassau, Liberty, William, and Pine Streets in the Financial District of Manhattan in New York City. The building, designed by Gordon Bunshaft of Skidmore, Owings & Merrill (SOM), opened in 1961. It is 813 feet (248 m) tall.
One Astor Plaza, also known as 1515 Broadway and formerly the W. T. Grant Building, is a 54-story office building on Times Square in the Theater District of Midtown Manhattan in New York City. Designed by Der Scutt of Ely J. Kahn & Jacobs, the building was developed by Sam Minskoff and Sons. One Astor Plaza occupies a site bounded by Broadway to the east, 45th Street to the north, Shubert Alley to the west, and 44th Street to the south. The building is named for the Hotel Astor, which had occupied the site from 1904 to 1967. SL Green Realty and Allianz own One Astor Plaza, which as of 2022 serves as the headquarters for Paramount Global.
Paley Park is a pocket park located at 3 East 53rd Street between Madison and Fifth Avenues in Midtown Manhattan, New York City, on the former site of the Stork Club. Designed by the landscape architectural firm of Zion Breen Richardson Associates, it opened May 23, 1967. Paley Park is often cited as one of the finest urban spaces in the United States.
3 Park Avenue is a mixed-use office building and high school erected in 1973 on Park Avenue in Manhattan, New York City. The building, surrounded on three sides by a plaza, is categorized as a Midtown South address in the Kips Bay, Manhattan, Murray Hill, and Rose Hill neighborhoods. It is located between East 33rd and 34th Streets, close to the 33rd Street subway station, an entrance to which is built into the building.
The 1916 Zoning Resolution in New York City was the first citywide zoning code in the United States. The zoning resolution reflected both borough and local interests, and was proposed after the Equitable Building was erected in Lower Manhattan in 1915.
Seattle Municipal Tower is a skyscraper in downtown Seattle, Washington. At 220.07 m (722.0 ft), it is the fifth-tallest building in the city. Completed in 1990, it was initially named AT&T Gateway Tower and subsequently KeyBank Tower after its anchor tenants AT&T and KeyBank. It was given its current name on May 17, 2004.

590 Madison Avenue, also known as the IBM Building, is a skyscraper at 57th Street and Madison Avenue in the Midtown Manhattan neighborhood of New York City. Designed by Edward Larrabee Barnes and Associates the 41-story, 603-foot (184 m)-tall tower was developed for the technology company IBM and built from 1978 to 1983.

32 Old Slip, also known as One Financial Square, is a skyscraper in the Financial District of Lower Manhattan in New York City. Completed in 1987, the building has 36 floors and stands at 575 ft 0 in (175.26 m). 32 Old Slip was designed by the firm of Edward Durell Stone Associates for developer Howard Ronson and his firm HRO International. It is home to various office tenants, including a Convene convention center and the New York Regional Office of the United States Census Bureau. The ground floor houses the New York City Fire Department (FDNY) Engine Company 4 and Ladder Company 15.
Golda Meir is an outdoor bronze sculpture of former Israeli prime minister Golda Meir. The sculpture is located at Golda Meir Square near Broadway and 39th Street in the Garment District of Manhattan, New York. It was unveiled in 1984. It is one of only five statues of women in New York City as of 2016.
Park Avenue Plaza is an office building at 55 East 52nd Street in the Midtown Manhattan neighborhood of New York City. The 575-foot (175 m) tall, 44-story building was designed by Skidmore, Owings & Merrill (SOM) for development company Fisher Brothers and was completed in 1981. Despite its name, the building is not actually on Park Avenue, although it abuts the Racquet and Tennis Club building along the avenue. Rather, the building is in the middle of a city block, with entrances on 52nd and 53rd Streets.
View 34 is a 35-story apartment building in the Murray Hill neighborhood of Manhattan in New York City. Occupying the full block bounded by First Avenue, FDR Drive, East 34th Street and East 35th Street, the high-rise was constructed on the former site of a Coca-Cola bottling plant and sparked the redevelopment of the eastern part of Murray Hill from industrial to residential uses beginning in the 1980s.
