Rauf Habibulla oghlu Mirgadirov (born 1961) is an Azerbaijani columnist and journalist. He has worked for the Baku based Russian-language newspaper Zerkalo. A believer in "citizen diplomacy" between Armenia and Azerbaijan over the Nagorno-Karabakh conflict, Mirgadirov was arrested for allegedly spying for Armenia and has been detained since April 2014. In December 2015, he was found guilty and sentenced to six years of prison. Following an appeal of his case, the ruling was upheld in March 2016, but Mirgadirov was released on suspended sentence. Life and career

Rauf Mirgadirov was born in Baku, Azerbaijan in 1961. Mirgadirov studied journalism at Azerbaijan State University and graduated from there. After graduation he worked in the publishing house "Azerneshr." Rauf Mirgadirov was part of the newspaper "Azadlig" (Freedom) in its initial years. In December 1989, he was in Jalilabad region during clashes between internal forces and the local population. Since 1991, he engaged in journalism and worked in the newspaper "Ayna-Zerkalo" ("Ayna" being the Azerbaijani version of the newspaper). [3]

The state of emergency Rauf Mirgadirov and a group of other journalists produced newspaper "Bizim Yol" (Our way). Thereafter, since the mid-1990s, Mirgadirov worked at the "Shargh" news agency. He was then deputy editor of the magazine "Monitor" and edited the opposition newspaper "Azerbaijan Democrática". He also became the chief editor of "Millet" newspaper. [3]

Since the beginning of the 2000s, Rauf Mirgadirov worked in the newspaper "Zerkalo". Since 2010 he lived in Turkey with his family working as correspondent. [4]

Rauf Mirgadirov has participated in various international conferences on the issues and settlement of the Nagorno-Karabakh conflict. [3] A believer in "citizen diplomacy" between the two countries, Mirgadirov visited Armenia several times. [5] While in Armenia, Mirgadirov, a member of Institute for Peace and Democracy (IPD), held meetings with Armenian NGOs. [6]

In 2005, Mirgadirov was awarded the title "Honored Journalist of Azerbaijan" by Azerbaijani President Ilham Aliyev. [3]

In 2008, Rauf Mirgadirov was awarded the "Free Press of Eastern Europe" international prize of Gerd Bucerius in 2008 for achievements in the development of independent media. [3]

Arrest, trial and sentence

Since 2010 Rauf Mirgadirov lived in Turkey with his family working as correspondent for Zerkalo and Ayna. However, in April 2014, he was deported from Turkey to Azerbaijan where he was arrested upon arrival at the airport. [7] Mirgadirov was arrested on charges of spying for Armenia. [8] The deportation of Mirgadirov to Azerbaijan was made immediately after Turkish Prime Minister Recep Tayyip Erdoğan's visit to Baku. This sequence of events made Mirgadirov's lawyer assume that the deportation was due to an arrangement between Azerbaijan and Turkey. [9] Since the arrest, Mirgadirov remained in pretrial custody. His initial detention period was three months but this has been extended several times. [10]

The charges stem from Mirgadirov's visits to Armenia between 2008 and 2009, where he allegedly transferred information to Armenian intelligence about Azerbaijan's political and military status which include "photos and schemes to be used against Azerbaijan." [9] Mirgadirov's lawyer claims the allegations are groundless and that it is impossible for Mirgadirov that have such information in his possession. [9] Leyla Yunus, another human rights activist arrested on similar charges, considered Mirgadirov's arrest as a start to a "full, unofficial ban on contacts with Armenia." [9] Yunus also questioned the timing of the arrest and states: "If the Ministry of National Security, as alleged, had suspected Mirgadirov of espionage back in 2008–2009, why did it keep quiet until now?" [9]

A spokeswoman for the Human Rights Watch stated that "The context and timing of Mirgadirov's arrest suggest that the case against him is politically motivated and intended to punish him for his outspoken views and to send a chilling message to others that dissent will not be tolerated." [4]

Throughout the trial, Mirgadirov maintained his innocence. On 28 December 2015, he was found guilty of spying and sentenced to six years of prison. The ruling was upheld by the Court of Appeal on 17 March 2016, but Mirgadirov was released on suspended sentence. He vowed to seek the overruling of the sentence in order to clear his name and be reunited with his family. Mirgadirov also complained about failing health. At the same time, he denied being mistreated while in custody or being forced to testify against other political prisoners, noting that it would be "unfair" of him to accuse the authorities of putting pressure on him. He stressed his intention to continue his journalism activity in the future. [1] [11]

International condemnation

Rauf Mirgadirov's arrest was condemned by the Human Rights Watch, [12] European Union officials, [13] World Organisation Against Torture, [14] International Federation for Human Rights, [14] Committee to Protect Journalists, [15] Reporters Without Borders, [16] United States Mission to the OSCE, [17] and others.

Amnesty International states that Mirgadirov has been "arrested on what appear to be trumped-up charges of spying for Armenia." [18] Reporters Without Borders spokesman Johann Bihr said "The grave charges brought against Mirqadirov are totally absurd and fool no one. He is just the latest victim of the Azerbaijani government's campaign to eradicate its media critics. How could this journalist have transmitted state secrets to which he did not have access?" [19] In its statement the Committee to Protect Journalists spokeswoman Nina Ognianova stated: "We call on Azerbaijani authorities to drop these trumped-up charges and stop abusing the law to silence independent reporting on the country, Azerbaijan is quickly becoming one of the leading jailers of journalists in the Eurasia region." [15]

United States State Department spokesman Jen Psaki stated that the United States is "disturbed by allegations that his arrest may have been connected with his critical reporting about the Azerbaijani government or his participation in people-to-people programs aimed at easing tensions and building confidence in the region." [20]

Personal life

Rauf Mirgadirov has a wife and three daughters. His wife, two daughters and Rauf have fled Azerbaijan and have been granted political asylum in Switzerland. [9] [21]

International organizations have frequently alleged that Azerbaijan has violated human rights standards established in international law. Human Rights Watch issued a 2013 report accusing Azerbaijan of imprisoning and harassing political activists and human rights defenders. In 2019, Human Rights Watch called the situation of human rights in Azerbaijan "appalling", citing "rigid control" by the government, "severely curtailing freedoms of association, expression, and assembly", as well as "torture and ill-treatment" of journalists, lawyers, and opposition activists. According to Reporters without Borders, Azerbaijan ranks 167 of 180 countries on the Press Freedom Index. A 2020 report by the U.S. State Department accused Azerbaijan of a wide variety of human rights abuses, including "unlawful or arbitrary killing", "heavy restrictions on free expression, the press, and the internet", and "the worst forms of child labor".

Rafiq Tağı, born Rafig Nazir oglu Taghiyev was an Azerbaijani short story writer and a journalist who worked for Sanat newspaper until police arrested him and Sanat editor Samir Sadagatoglu for "Europe and Us", an article that was deemed to be critical of Islam and the Islamic prophet Muhammad. He was considered to be inciting racial hatred and sentenced to three years in prison. Released on a presidential pardon some months later he was assassinated in a car park.

Eynulla Fatullayev

Eynulla Emin oglu Fatullayev is an Azerbaijani journalist and editor-in-chief of the independent Russian-language weekly Realny Azerbaijan and Azerbaijani-language daily Gündəlik Azərbaycan newspapers. He was imprisoned for four years in Azerbaijan for his criticism of government's policies and for his comments on the Khojaly massacre. His sentence was condemned by Reporters Without Borders, International PEN, and the Committee to Protect Journalists, and Amnesty International named him a prisoner of conscience and 2011 "priority case."

Azerbaijan State Oil Academy shooting Civilian attack in 2009

The Azerbaijan State Oil Academy shooting occurred on 30 April 2009, at the Azerbaijan State Oil Academy (ASOA), a public university in Baku, Azerbaijan. Twelve people were killed by an armed assailant and several others were wounded. A joint statement by the Azerbaijan Interior Ministry and Prosecutor General's Office identified the perpetrator as 28-year-old Farda Gadirov, a Georgian citizen of Azerbaijani descent.

Ilham Heydar oghlu Aliyev is the fourth president of Azerbaijan, serving in the post since 31 October 2003.

The 2011 Azerbaijani protests were a series of demonstrations held to protest the government of President Ilham Aliyev. Common themes espoused by demonstrators, many of whom were affiliated with Müsavat and the Popular Front Party, the main opposition parties in Azerbaijan, included doubts as to the legitimacy of the 2008 presidential election, desire for the release of political prisoners, calls for democratic reforms, and demands that Aliyev and his government resign from power. Azerbaijani authorities responded with a security crackdown, dispersing protests and curtailing attempts to gather with force and numerous arrests.

Idrak Abbasov is an Azerbaijani journalist who works for the newspaper Zerkalo, one of Azerbaijan's few newspapers not controlled by the government of President Ilham Aliyev. The Guardian described him as one of the nation's "leading journalists". He lives in Sulutəpə, a settlement in Baku, the nation's capital. Known for his reporting on forced evictions in Baku, Abbasov was badly beaten in 2012, allegedly by SOCAR security personnel.

Hilal Mammadov is an Azerbaijani journalist and human rights activist. He is the chief editor of the Baku-based newspaper "Tolyshi sado", the only newspaper in Azerbaijan printed in the minority Talysh language. After Novruzali Mammadov died in custody, Hilal Mamedov became a second community leader for the Talysh people. He is also known as the author of the meykhana video Ty kto takoy? Davay, do svidaniya! which became an Internet meme both in Azerbaijan and Post-Soviet states.

Forced evictions in Baku

Since 2008, the government of Azerbaijan has been implementing a program of forced evictions in the capital city of Baku, confiscating and subsequently demolishing privately owned properties to make room for the development of modernized infrastructure. The evictions were first ordered by the city's municipal government as part of a massive reconstruction effort aimed at increasing the appeal of the downtown metropolis. From 2011 onward, the number of housing complexes being forcibly vacated has increased substantially.

Most Azerbaijanis receive their information from mainstream television, which is unswervingly pro-government and under strict government control. According to a 2012 report of the NGO "Institute for Reporters’ Freedom and Safety (IRFS)" Azerbaijani citizens are unable to access objective and reliable news on human rights issues relevant to Azerbaijan and the population is under-informed about matters of public interest.

Leyla Yunus Azerbaijani human rights activist

Leyla Islam qizi Yunusova, better known as Leyla Yunus, is an Azerbaijani human rights activist who serves as the director of Institute of Peace and Democracy, a human rights organisation. She is particularly known for her work helping citizens affected by forced evictions in Baku, on whose behalf she organized several small protests. In July 2014, the Azerbaijani authorities jailed Yunus under allegations of fraud and tax evasion, which are charges widely regarded as dubious. After being sentenced to 8.5 years in jail on 13 August 2015, Leyla Yunus was released on grounds of her deteriorating health on 9 December 2015, with a court converting her sentence into a suspended one.

Arif Yunusov Azerbaijani human rights activist

Arif Yunusov, also known as Arif Yunus, is an Azerbaijani author, historian, and human rights activist. He is the head of the Department of Conflict and Migration of the Institute of Peace and Democracy. Arif Yunusov along with his wife Leyla are supporters of a peaceful resolution to the Nagorno-Karabakh conflict between Armenia and Azerbaijan. On 28 April 2014, Arif Yunusov and his wife Leyla were jailed on charges of extortion and treason for allegedly spying for Armenia. After being detained, Arif Yunusov was sentenced to 7 years in jail; his wife, Leyla Yunus, was sentenced to 8.5 years in jail. Their sentences were suspended 15 months later and the couple was allowed to leave for the Netherlands.

Fuad Gahramanli was the Deputy Chairman of the Whole Azerbaijan Popular Front Party, an opposition political party in Azerbaijan.

Elchin Shikhly

Elchin Shikhly is the creator and editor-in-chief of "Ayna" - "Zerkalo" newspapers since 2001. He is a member of the Azerbaijani Writers' Union since 1989, and is the chairman of the Azerbaijani Journalists' Union since 2006.

Azerbaijan has been a member of the Council of Europe, an international organization that focuses on strengthening democracy and human rights, since 2001. As a member, it has attracted attention for holding political prisoners, low implementation of verdicts of the European Court of Human Rights (ECtHR), and bribing Council of Europe parliamentarians to suppress negative information about its human rights record. In 2017, the Committee of Ministers launched the first ever infringement proceeding against Azerbaijan after it refused to release opposition politician Ilgar Mammadov after a 2014 ECtHR verdict that his imprisonment was unlawful. There has also been criticism of Azerbaijan's continued membership by those who believe its lack of human rights protection undermines the credibility of the Council of Europe.
