The Rajya Sabha or Council of States is the upper house of the bicameral Parliament of India. As of 2021 it has a maximum membership of 245, of which 233 are elected by the legislatures of the states and union territories using single transferable votes through Open Ballot while the President can appoint 12 members for their contributions to art, literature, science, and social services. The potential seating capacity of the Rajya Sabha is 250, according to article 80 of the Indian Constitution. Members sit for staggered terms lasting six years, with elections every year with about a third of the 233 designates up for election every two years, in even-numbered years. The Rajya Sabha meets in continuous sessions, and unlike the Lok Sabha, being the lower house of the Parliament, the Rajya Sabha, which is the upper house of Parliament, is not subjected to dissolution. However, the Rajya Sabha, like the Lok Sabha can be prorogued by the President.

Barthakur is married into the influential Nehru-Gandhi family of India, and was thus appointed Advisor to the Chief Minister of Assam under the Congress Government. He was asked to resign when the BJP Government came to power in 2016.
Biswajit Daimary is an Indian politician from Bharatiya Janata Party. He is current speaker of Assam Legislative Assembly. He represents Assam in Rajya Sabha as a member of the Bharatiya Janata Party and as a member of the Bodoland People's Front. He was first elected as Member of Assam Legislative Assembly from 2001 to 2006. Later elected as Member of Parliament to Rajya Sabha from 2008 to 2014. He was elected for second term from 2014 to 2020 as a member of Bodoland People's Front and from 2021 as a member of the BJP. In November 2020, Daimary left BPF to join Bharatiya Janata Party before election Bodoland Territorial Council elections. On 21 November 2020, Daimary resigned from the Rajya Sabha. He was re-elected on 23 February 2021.

The 2016 Rajya Sabha elections were held as part of a routine six-year cycle among certain of the State Legislatures in India on March 14 and June 11, 2016, to elect 13 and 57 of its 245 members, of which the states through their legislators elect 233, and the remaining 12 are appointed by the President. Being even-numbered, 2016 was a year in which about 30% of the State Legislature-elected 233-seat component of the body is elected.

2020 Rajya Sabha elections is the set of indirect elections by the members of State legislatures of India, to elect new members to fill vacancies in the Rajya Sabha – the upper house of the Parliament of India. The elections are held annually and throughout the year on an ad hoc basis. The elections in 2020 are for a total of 73 seats of which 55 of them were to be elected by March 26.
