TrimSpa

TrimSpa was a dietary supplement designed for weight loss, marketed by the company Goen Technologies and headed by Alexander Szynalski. [1] The ephedra-based supplement was marketed by TrimSpa to help "stave off hunger", [2] until ephedra was banned from the United States. TrimSpa's parent company, Goen Technologies, filed for bankruptcy protection in May 2008.

Company

TrimSpa started sales in 2001. After hiring spokeswoman Anna Nicole Smith, sales jumped to $43 million by 2004. Sales fell to $19.5 million by 2006. [3]

In September 2008, it was decided by a judge to turn the case into Chapter 7 liquidation. At its peak, TrimSpa brought in $141 million in sales, with $17 million operating profits. [4]

Composition

TrimSpa's key ingredient was ephedra and caffeine. The government expressed health concerns, advising against the use of ephedra in 2003, causing the company to seek a new formula. [5] The company changed its formula, making hoodia gordonii the prominent ingredient. The formula was rebranded as TrimSpa X32. In 2007, a class-action lawsuit came forward seeking an injunction against the company from advertising its formula as an effective weight loss product. [6]

Federal Trade Commission fine for false claims

On January 4, 2007, the U.S. Federal Trade Commission announced that the marketers of TrimSpa had agreed to pay a settlement of $1.5 million in response to an FTC complaint of making unsupported claims in advertisements and were prohibited "from making any claims about the health benefits, performance, efficacy, safety, or side effects of TrimSpa, Hoodia gordonii, or any dietary supplement, food, drug, or health-related service or program, unless the claims are true, not misleading, and substantiated by competent and reliable scientific evidence." The FTC also announced similar settlements with the marketers of Xenadrine EFX, CortiSlim, and One-A-Day WeightSmart. [7]

Over-the-counter disclaimer

The original TrimSpa and the new TrimSpa X32 are dietary supplements, regulated by the U.S. Food and Drug Administration (FDA). The FDA regulates dietary supplements under different rules than those governing prescription medicines and other over-the-counter products. [8] Under these regulatory rules, TrimSpa products' safety and effectiveness are not reviewed by the FDA. Rather, TrimSpa's original parent company, Nutramerica Corp., and its original marketer and manufacturer, Goen Technologies Corp., were responsible for ensuring that their products were safe for public consumption. These same rules apply to the new owners.[ citation needed ]

It can be taken by mouth or by injection into a muscle, vein, or just under the skin. Onset with intravenous use is fast, while injection into a muscle can take 20 minutes, and by mouth can take an hour for effect. When given by injection it lasts about an hour and when taken by mouth it can last up to four hours.

Metabolife International, Inc. was a multi-level marketing company based in San Diego, California which manufactured dietary supplements. Metabolife's best-selling product, an ephedra supplement called Metabolife 356, once generated hundreds of millions of dollars in annual sales. However, Metabolife 356 and other ephedra-containing supplements were linked to thousands of serious adverse events, including deaths, which caused the U.S. Food and Drug Administration (FDA) to ban the sale of ephedra-containing dietary supplements in 2004.

<i>Hoodia gordonii</i> Species of succulent plant

Hoodia gordonii, also known as Bushman’s hat, is a leafless spiny succulent plant supposed to have therapeutic properties in folk medicine. It grows naturally in Botswana, South Africa and Namibia. The species became internationally known and threatened by collectors, after a marketing campaign falsely claimed that it was an appetite suppressant for weight loss. The flowers smell like rotten meat and are pollinated mainly by flies. The indigenous San people of the Namib desert call this plant ǁhoba is used to refer to all species of Hoodia.

ConsumerLab.com, LLC. is a privately held American company registered in White Plains, NY. It is a publisher of test results on health, wellness, and nutrition products. Consumer Labs is not a laboratory, but contracts studies to outside testing laboratories. It purchases dietary supplement products and other consumer goods directly from public storefronts and online retailers, contracts for testing by private laboratories, and publishes reports based on the results. It primarily derives revenue from the sale of subscriptions to its online publications, which are paywalled. Other sources of revenue include a proprietary certification program, licensing fees, contents re-publication license fees, and advertising.

Sensa is an American brand of diet aid created by Alan Hirsch, an American neurologist and psychiatrist. The product lacks scientific evidence of effect and has been the subject of controversy and lawsuits. The Chemins Company is a dietary supplement manufacturer based in Colorado Springs, Colorado. The company, founded in 1974 by James Cameron, became embroiled in a series of criminal investigations in 1994 after a woman died and more than 100 other people became ill after taking one of the company’s products marketed under the brand name Nature's Nutrition Formula One. The adverse events were later linked to the product having been tainted with ephedrine. A three-year federal investigation, which revealed that the company had doctored records, misled FDA investigators, and purposely hindered inspections, led to Cameron being sentenced to 21 months in prison and him and the company being fined $4.7 million. The company also paid out $750,000 to settle a class action lawsuit alleging that the company's protein powder supplements contained approximately half the protein content and twice the carbohydrate content listed on the label.
