Attacks on RTI activists in India

Many Right to Information Act (RTI) activists, including policemen, have been harassed and even murdered for seeking information to "promote transparency and accountability in the working of every public authority" in India. Many face assaults on a regular basis. People seeking information from their gram panchayat and the local administration also face social ostracism. A few activists who sought information under RTI related to MNREGA scams, were killed. [1] [2] [3] Many threats and attacks (including murder) go unreported by the media. [4] [5]

Media reports of more than 300 instances of attacks on or harassment of citizens and at least 51 murders and 5 suicides can be linked to information sought under The Right to Information Act. Maharashtra followed by Gujarat tops the list for states with the most attacks on RTI users. [6]

Overview

RTI activists are vulnerable human rights defenders (HRDs) in India. Unlike other HRDs, a majority of the RTI activists are not part of an organisation; they often act alone, moved by anger at corruption and other illegal activities. RTI activists are vulnerable because they live in the same areas as public authorities and political leaders who do not want information about their activities to be disclosed. [7] For the most part, human rights defenders receive media attention only when killed or seriously injured. When complaints are made by RTI activists, law enforcement personnel (who often work with corrupt officials) do not take appropriate action . The Right to Information Act, 2005 provides inadequate protection to whistleblowers. The Central Information Commission and the State Information Commissions are not mandated to deal with such threats or attacks or to provide protection when needed. [8] Attacks on RTI users have not ceased despite directions from several information commissions and state governments to protect them from harm. [9]

There are two sources of crowd sourced lists maintained of the attacks on people using RTI to seek transparency and accountability, primarily based on media reports. The first is via the National Campaign for People's Right to Information. A "Hall of Shame" is maintained by CHRI. [10]

<span class="mw-page-title-main">Right to Information Act, 2005</span> Act of the Government of India

The Right to Information (RTI) is an act of the Parliament of India which sets out the rules and procedures regarding citizens' right to information. It replaced the former Freedom of Information Act, 2002. Under the provisions of RTI Act, any citizen of India may request information from a "public authority" which is required to reply expeditiously or within thirty days. In case of matter involving a petitioner's life and liberty, the information has to be provided within 48 hours. The Act also requires every public authority to computerize their records for wide dissemination and to proactively publish certain categories of information so that the citizens need minimum recourse to request for information formally.

An encounter killing, often simply called an encounter, is an extrajudicial killing by police or the armed forces in South Asia, supposedly in self-defence when they encounter suspected gangsters or terrorists. The officers typically described the incidents as a shootout situation, often allegedly starting when a criminal grabs for the gun of a police officer. The term encounter came into widespread use for such incidents in the late 20th century.

Satish Shetty, popularly known as "Satish", was an Indian social activist, noted for exposing many land scams in Maharashtra. He had used the Right to Information Act to expose irregularities in Government offices in the last five years. He was killed on 13 January 2010, by unknown attackers in Talegaon.

<span class="mw-page-title-main">Amit Jethwa</span> Indian environmentalist and social worker(1975–2010)

Amit Jethwa was an Indian environmentalist and social worker, active in the Gir Forest area near Junagadh, Gujarat. He had filed several court cases against illegal mining in the protected area, naming Dinu Solanki as one of the respondents. On 20 July 2010 he was shot dead by two assailants on a motorbike. In September 2012, the Gujarat High Court, severely criticized investigations by the Gujarat police who had "given a clean chit" to Solanki, despite arresting his nephew; the court ordered the Central Bureau of Investigations (CBI) to take up the case. In November 2013, CBI arrested Dinu Solanki in connection with having ordered the murder. On 11 July 2019, Dinu Solanki and his nephew Shiva Solanki were convicted of the murder.

Whistle Blowers Protection Act, 2011 is an Act of the Parliament of India which provides a mechanism to investigate alleged corruption and misuse of power by public servants and also protect anyone who exposes alleged wrongdoing in government bodies, projects and offices. The wrongdoing might be in the form of fraud, corruption or mismanagement. The Act will also ensure punishment for false or frivolous complaints.

Shehla Masood (1973–2011) was an Indian environmentalist, wildlife and Right to Information activist. She was shot dead on 16 August 2011 in front of her house in Bhopal while she was sitting in her car, by three persons who were hired by a local female interior designer.

Rinku Singh Rahi is an Indian whistleblower and PCS officer fighting against corruption in sponsored welfare schemes in Uttar Pradesh (UP). He was shot six times by local gangsters, damaging his jaw and the vision of one eye, for exposing corruption.

National Campaign for People's Right to Information (NCPRI) was established in 1996 to advocate for a legal backing to citizens right to information. This resulted in the historic and pro-people law - the Right to Information Act, 2005. More recently, this movement has also campaigned for Grievance redressal bill and Whistleblowers protection bill. It is a network of organisations and individuals who use the Right to Information law to demand transparency and accountability of government, but also support the use of the RTI in various other sectors to demand accountability.

Subhash Chandra Agrawal is an Indian businessman and right to information activist. He holds the Guinness World Record for having written the most published letters to newspaper editors.

Movement against Intimidation, Threat and Revenge against Activists (MITRA) is a network of NGOs and activists based in Mumbai to protect people taking up public interest causes through Right to Information, grass root activism, or public-interest litigation (India) against intimidation from threat and attack from vested interests they may oppose in the course of their work. MITRA was founded in 2004 after an attack on activist Sumaira Abdulali by the politically led sand mafia at Kihim Beach, Alibag. MITRA was chaired by late Mr. B.G Deshmukh IAS, Retired Cabinet Secretary of India.

<span class="mw-page-title-main">Rajeev Kumar (academic)</span> Indian activist and whistleblower

Rajeev Kumar is now at Jawaharlal Nehru University. He is known for his fight with IITs to fix the eligibility criteria of admission through the JEE. A "protracted legal struggle" over years with several tiers of the IIT administration, led to in 2010, the Delhi High Court ordering the IITs to reveal such information. Since 2012, every candidate gets a carbon copy of their paper, and the various cutoffs are announced. Due to this activism he was suspended, then compulsorily retired by IIT Kharagpur in 2014; he was reinstated in 2017 by the President Pranab Mukherjee.

Sanjiv Chaturvedi is an Indian Forest Service (IFS) officer posted as Chief Conservator of Forest (Research) at Haldwani in the Nainital district of Uttarakhand. Chaturvedi was a Chief Vigilance Officer (CVO) at AIIMS, New Delhi from 2012 to 2014, and served in the government of Haryana from 2005 to 2012.
