The Consolidation of the Justice System in Albania (EURALIUS) was an EU funded technical assistance project that sought the strengthening of the Albanian Justice System. [1] The objective of EURALIUS was to strengthen the independence, transparency, efficiency, accountability and public trust in the Albanian justice system in line with the EU Acquis and best practices. EURALIUS was composed of long-term international experts from various EU Member States and of Albanian legal professionals who act as national experts, as well as support staff consisting of project assistants, translators, etc.

The transformation of the Albanian justice system toward EU standards was a condition and a process that aimed to restore the people's confidence to the justice system, to the consolidation of the democracy and to the rule of law as required by the Stabilization and Association Agreement. The EU had devised specific instruments in order to facilitate the country accession and fulfillment of the conditions. Concerning the consolidation of the justice system in Albania EU funded the EURALIUS project.

Among the Albanian project partners and beneficiaries were the Ministry of Justice, the Judiciary (Courts), the High Council of Justice, the Prosecution Office, the Parliament of Albania, the Office for the Administration of the Judicial Budget, the School of Magistrates, [2] the National Chamber of Advocacy and the National Chamber of Notaries.

Since Albania submitted its application for European Union membership, it had to meet the membership criteria and key priorities set out in the Commission's Opinion. One of the major requirements for the EU membership is Functioning of the Judiciary. Therefore, the Commission Report on Albania (2015) has stated that: "Albania's judicial system is at an early stage of preparation. Besides the perception of the public toward the justice system in Albania is very low.

To consolidate the justice in Albania and to strength the transparency, efficiency and the public trust in the Albanian justice system, the EU funded the EURALIUS project. Initially the project was operating under the Albania CARDS 2002 programme in the form of the EURALIUS I mission. Then, during the period 2007-2010 the project was undertaken by the EURALIUS II mission.

The project contractor for the first two missions was the Austrian Federal Ministry of Justice and managed by Center of Legal Competence (CLC). The main objective remained to development of a more independent, neutral, effective, proficient, transparent and modern justice system in Albania, therefore contributing to the restoring of people's confidence in their institutions.

Euralius III started on 15 September 2010 and was finalized on 15 June 2013. This mission was managed by International and Ibero-American Foundation for Administration and Public Policies (FIIAPP) and had similar objectives as the previous missions.

EURALIUS IV started in September 2014 and ended in March 2018. EURALIUS IV implementation was awarded to a consortium led by the German Deutsche Stiftung für Internationale Zusammenarbeit e.V. (IRZ), in cooperation with the Dutch Center for International Legal Cooperation (CILC) and the Austrian Agency for Economic Cooperation and Development (aed), which are all mandated bodies of respective Ministries of Justice.

The main objective of the project was to assist the Albanian justice institutions to bring their enactment closer to the EU standards. Except from supporting the work on judicial reform, the project was also charged with implementing a diverse array of objectives, arranged around the following components: [3] Justice Reform and Organization of the Ministry; High Council of Justice (HCJ) and High Court; Criminal Justice and Prosecution Office; Judicial Administration and Efficiency; Legal Professions; Change Management; High Judicial Inspectorate (HJI); Court Organisation and Management; High Prosecutorial Council and Prosecution Offices; and Judicial Training.

EURALIUS V started in April 2018 and ended in December 2021. Following the comprehensive justice reform accompanied by EURALIUS IV, EURALIUS V focused on supporting the justice institutions to consolidate the justice system. The project was implemented by a consortium composed of the German Foundation for International Legal Cooperation (IRZ) as Lead Partner. IRZ is mandated by the Federal Ministry of Justice and Consumer Protection. Junior partners were the Dutch Center for International Legal Cooperation (CILC), Austrian Agency for Economic Cooperation and Development (aed) and the Italian High Council for the Judiciary (CSM).

EURALIUS V concentrated its assistance on five main areas of intervention, namely legal initiatives and capacity building of the Ministry of Justice and Parliament; Justice Governance institutions; Consolidation of courts, prosecutions offices and free legal professions; Information technology in the justice sector; and judicial training.

Justice Reform

EURALIUS played an important role in the consolidation of the justice system in Albania, especially through the contribution of the EURALIUS IV mission in the setting up of the Justice Reform process. Throughout the reform, the international and national experts have assisted the process of drafting the Albanian legislation, amendments to the laws in the justice sector and supported the set up and strengthening of Albanian institutions. A pivotal part of the Justice Reform process was the approval of the constitutional amendments by the Albanian Assembly on 21 July 2016, [4] and of the legislative package of Organic Reform Laws, [5] with the most important being the Law on the Transitional Re-evaluation of Judges and Prosecutors of the Republic of Albania. European Union Rule of Law Mission in Kosovo Delegation

The European Union Rule of Law Mission in Kosovo, known as Eulex Kosovo or simply as EULEX, is the largest civilian mission ever launched under the Common Security and Defence Policy (CSDP) of the European Union. EULEX supports selected Kosovo rule of law institutions on their path towards increased effectiveness, sustainability, multi-ethnicity and accountability, free from political interference and in full compliance with international human rights standards and best European practices through monitoring activities and limited executive functions with the aim of handing over remaining tasks to other long-term EU instruments and phasing out residual executive functions. The Mission's mandate covered the period until 14 June 2020 based on Council Decision CFSP 2018/856 and has been extended to 14 June 2021 by Council Decision CFSP 2020/792. EULEX works within the framework of UN Security Council Resolution 1244.

The German Foundation for International Legal Cooperation was set up in 1992 on the initiative of the German Federal Minister of Justice, Dr. Klaus Kinkel, as a registered non-profit association. Its headquarters are in Bonn, with an additional office in Berlin.

The Supreme Court of the Republic of Albania is the highest court of Albania and is the final court of appeals in the country's judicial system. It is composed of seventeen judges: the Chief Justice and sixteen Members.

Giovanni Kessler

Giovanni Kessler is an Italian prosecutor. He was until 2017 the Director-General of the European Anti-Fraud Office (OLAF). OLAF is a department of the European Commission, but it is independent in its investigative function. Based in Brussels, OLAF is tasked with protecting the financial interests of the European Union by investigating fraud, corruption and any other illegal activities. It also investigates serious matters relating to the discharge of professional duties by members and staff of the EU institutions and it supports the EU institutions, in particular the European Commission, in the development and implementation of anti-fraud legislation and policies.

Judiciary of Poland is a responsibility, as defined by the constitution of Poland, of a four-tier court system: the Supreme Court of Poland, the common courts, administrative courts and military courts. Therefore, tribunals are, in a strict definition, not part of Polish judiciary, but in a broad definition, they are included in it.

Law of Kosovo

Kosovo has a civil law system which is also sometimes known as Continental European law system. The central source of law that is recognized as authoritative is codifications in a constitution or statute passed by legislature, to amend a code. The Judiciary of Kosovo is the collection of the central Kosovo institutions that exercises judicial authority in Kosovo. According to the 2008 Constitution of Kosovo, the judicial system is composed of the Supreme Court and subordinate courts, a Constitutional Court, and an independent prosecutorial institution. The courts are administered by the Kosovo Judicial Council.

The Albanian School of Magistrates, officially known as the School of Magistrates of the Republic of Albania is an Albanian post-graduate school, where Albanian judges and public prosecutors are trained. The institution was established in 1997 by virtue of Law no. 8136, date 31.7.1996 “On the School of Magistrates of the Republic of Albania”, as amended by Law no. 9414, date 20.05.2005 and Law no. 97/2014. It is located in Tirana, with its campus located inside the Tirana Grand Park, sharing premises with the Faculty of Geology and Mining of the Polytechnic University of Tirana.

Spanish Attorney General

The Spanish Attorney General, officially, Attorney General of the State(Spanish: Fiscal General del Estado), is the head of the Prosecution Ministry, the body with functional autonomy in the Judiciary, that has constitutionally been entrusted with the promotion of the action of the justice in defense of the legality, protecting citizens rights and the public interest, and ensuring the independence of the courts and to seek the satisfaction of the social interest.

After gaining independence, Azerbaijan has taken important measures throughout the country to improve its legal system, enhance justice and efficiency.

Prosecution Ministry

The Prosecution Ministry is a constitutional body integrated into the Judiciary of Spain but with full autonomy entrusted with the promotion of justice to defend the rule of law, the rights of the citizents and the public interest as well as watch over the independence of the courts of justice.

European Union Advisory Mission in Ukraine

European Union Advisory Mission Ukraine is a civilian Common Security & Defence Policy (CSDP) mission of the European Union. It aims to assist Ukrainian authorities to reform civilian security sector. It provides strategic advice and practical support to make Ukrainian civilian security sector more effective, efficient, transparent and enjoying public trust. EUAM Ukraine works with a number of law enforcement and rule of law institutions of Ukraine and it formally began operation on December 1, 2014, following Ukrainian Government's request.

SPAK

SPAK, Special Anti-Corruption Structure is an independent judicial body tasked with investigating corruption and organized crime at the highest levels of government and society in Albania. It consists of the National Bureau of Investigation, the Special Prosecution and the Special Courts.

Part Ten of the Constitution of Albania is the tenth of eighteen parts. Titled The Office of the Prosecutor, it consists of 13 articles. Together with Part Eight (Constitutional Court), and Part Nine (The Courts) underwent radical changes in 2016 during the so-called Justice Reform, which were the efforts of lawmakers to fight corruption, organized crime, nepotism in the justice system.
