David Philip Benedict Smith (born 25 March 1970) is an Australian politician. On 23 May 2018,the High Court of Australia declared him elected as a Senator for the Australian Capital Territory after Labor senator Katy Gallagher was found ineligible to have been elected. [1]
Before his election,Smith was the ACT director of the Professionals Australia union. [2] He was sworn in to the Australian Senate on 18 June 2018, [3] and at the 2019 federal election,he was elected to the lower-house seat of Bean.
Smith was born in Canberra,Australian Capital Territory. He completed his schooling at Marist College Canberra,and graduated with a Bachelor of Arts with Honours from the Australian National University in 1993. [4]
Before joining the Australian Senate,Smith served in various roles including as an advisor in the Department of Employment and Workplace Relations,as an industrial relations manager for the Australian Federal Police Association,and as a policy advisor in the Australian Capital Territory Chief Minister's Department under Jon Stanhope. [4]
In 2007,he took up the role of Director of the ACT branch of Professionals Australia,a union which primarily focuses on technical workers such as scientists,engineers,architects,IT professionals,pharmacists,and others. [5]
Smith has been a member of the Australian Labor Party since 1992. He ran for the Senate in 2004,and was the second candidate on the ALP's 2016 Senate ticket. [5]
At the 2016 ACT Labor Annual Conference he was elected Senior Vice-President of the ACT Branch of the Australian Labor Party. [6] He says that he was inspired to serve in politics by the judge and attorney general,Terry Connolly. [7]
On 23 May 2018,the High Court of Australia declared him elected as a Senator for the Australian Capital Territory after Labor senator Katy Gallagher was found ineligible to have been elected. [1] He was sworn in on 18 June 2018. [3]
On 1 September 2018,Smith was preselected to run for the Australian Labor Party in the House of Representatives seat of Bean. [8] He resigned from the Senate on 11 April 2019,the day the election was called and the Senate prorogued. [9]
At the 2019 Australian federal election,Smith was elected as the Member for Bean with a margin of 13,971 votes. [10] He was returned to Parliament in the 2022 Australian federal election,now to the Government benches,keeping a substantial margin,winning 62.9% in the two-party preferred count. [11] He is the Government Whip in the lower house for the Albanese government. He also serves on the Standing Committee for Selection and co-chairs the Parliamentary Christian Fellowship with Senator Matt O'Sullivan. [12] [13]
Having been educated in a Marist Brothers college,Smith identifies as a Catholic. [7] He is married to Liesl Centenera. Together,they have three children:Marcus,Eamonn,and Stella. [14]

The 2013 Australian federal election to elect the members of the 44th Parliament of Australia took place on 7 September 2013. The 44th Parliament of Australia opened on 12 November 2013,with the members of the House of Representatives and territory senators sworn in. The state senators were sworn in by the next Governor-General Peter Cosgrove on 7 July 2014,with their six-year terms commencing on 1 July.

This is a list of members of the Australian Senate following the 2016 Australian federal election held on 2 July 2016. The election was held as a consequence of a double dissolution in which both houses of parliament were dissolved. Ordinarily,only half of the senators terms end at each election. In this case,all 76 senators were elected. At the first sitting following the election,half of the senators representing each of the six states of Australia were allocated six-year terms to end on 30 June 2022,with the remainder allocated three-year terms to end on 30 June 2019. The terms of senators from the Australian Capital Territory and the Northern Territory end on the day of the next federal election.
The 45th Parliament of Australia was a meeting of the legislative branch of the Australian federal government,composed of the Australian Senate and the Australian House of Representatives. It met in Canberra from 30 August 2016 to 4 April 2019. The 2016 general election held on 2 July gave the Coalition of the Liberal and National Parties control of the House,albeit with a slimmer majority than the 44th Parliament,allowing their leader Malcolm Turnbull to stay in office as the 29th Prime Minister of Australia. During the term of the parliament,the government slipped into minority due to defections and by-elections. The leadership of the government also changed during the parliament,when Scott Morrison replaced Turnbull as Liberal Leader and Prime Minister in August 2018. The 45th Parliament was officially prorogued by the Governor-General Sir Peter Cosgrove at 8:29 a.m. on 11 April 2019,and the House of Representatives dissolved at 8:30 a.m.
Starting in July 2017,the eligibility of several members of the Parliament of Australia was questioned. Referred to by some as a "constitutional crisis",fifteen sitting politicians were ruled ineligible by the High Court of Australia or resigned pre-emptively. The situation arose from section 44(i) of the Australian Constitution,which prohibits parliamentarians from having allegiance to a foreign power,especially citizenship. On that basis,the High Court had previously held that dual citizens are ineligible for election unless they have taken "reasonable steps" to renounce the foreign citizenship before nomination.
The July 2018 Australian federal by-elections,known colloquially as Super Saturday,were five by-elections held on 28 July 2018,to fill vacancies in the Australian House of Representatives caused by the resignations in May 2018 of five MPs. Three MPs of the Australian Labor Party and the Centre Alliance's sole MP resigned due to dual citizenship concerns after the High Court ruled on 8 May 2018 that Senator Katy Gallagher was ineligible to have been elected to the Australian Senate for being a dual citizen,in similar circumstances to four of the lower house MPs. Labor MP for Perth Tim Hammond resigned for family reasons on the same day,causing the first time ever that five by-elections would be held on the same day in Australia. All sitting MPs apart from Hammond re-contested and won the ensuing by-elections.

The May 2022 federal election gave the Australian Labor Party control of the House. Labor won 77 seats at the election,and it gained an additional seat in April 2023 due to winning the Aston by-election,giving it a three-seat majority government. Labor leader Anthony Albanese became the 31st Prime Minister of Australia,and was sworn in by the Governor-General David Hurley on 23 May 2022. The 47th Parliament opened in Canberra on 26 July 2022.
