On 17 May 2023, Clare Nowland, a 95-year-old resident with dementia, was tasered by New South Wales police at an aged care home in Cooma, Australia. She was hospitalized after she fell and fractured her skull when she received the Taser electric current. [1] She died a week later, on 24 May. The officer who fired the Taser has been suspended and charged with a number of offences. [2]

Clare Nowland

Nowland was a 95-year-old resident at an aged care home in Cooma. She had dementia and used a walker. [3] Nowland was known for skydiving to celebrate her 80th birthday. [4]

Kristian White

White was a 33-year-old senior constable with 12 years' experience at the time of the incident. [5]

Incident

In the early hours of 17 May 2023, Nowland obtained a steak knife from the kitchen of the aged care home where she had lived for the previous five years. [6] Staff were unable to retrieve the knife from her, and called the local police. Two officers, White and a female officer, arrived at the home about 4 am, and found Nowland in her room. They called on her to drop the knife, but she walked slowly towards them with her walker, carrying and raising the knife. [6] According to The Daily Telegraph, the female police officer allegedly said she could take the knife from Nowland. White allegedly said "no, bugger it" before firing his Taser. [7] White fired his Taser twice, hitting Nowland in the back and the chest. Nowland fell, fracturing her skull. [8] [9] [10] She was taken to Cooma District Hospital where she was given end-of-life care. [11] She died on 24 May. [1]

Aftermath

On 23 May, White was suspended from duty. [12] On 24 May, hours before Nowland's death, he was charged with recklessly causing grievous bodily harm, assault occasioning actual bodily harm, and common assault. [13] On 29 November, White's charges were upgraded to manslaughter. [14]

On 27 May, a small group of protestors marched on NSW Police headquarters in Parramatta. [15]

Nowland's funeral was held in Cooma on 13 June 2023. [16]

In June 2023, following a freedom of information request by The Sydney Morning Herald , it was discovered that NSW Police media had deliberately withheld advice to the public that a Taser had been used on Nowland. [17]

White was due to appear in Cooma Local Court on 5 July 2023, with the court committing to considerable expense in arranging security for the appearance. Unbeknown to the magistrate hearing the matter, the Office of the Director of Public Prosecutions had allowed White to appear via video link, which angered the magistrate. On 7 February 2024, White's lawyer indicated that White would plead not guilty to manslaughter. The other three charges were withdrawn by the prosecution. [18]

Nowland's family has lodged a civil lawsuit against the state of New South Wales seeking undisclosed damages for trespass to the person (assault and battery) and negligence. [19] The matter has been adjourned until late August. [20]

Taser safety issues relate to the lethality of the Taser. The TASER device is a less-lethal, not non-lethal, weapon, since the possibility of serious injury or death exists whenever the weapon is deployed. It is a brand of conducted electroshock weapon sold by Axon, formerly TASER International. Axon has identified increased risk in repeated, extended, or continuous exposure to the weapon; the Police Executive Research Forum says that total exposure should not exceed 15 seconds.

On September 17, 2007, a University of Florida student was stunned by police with a taser at a forum featuring then–U.S. Senator John Kerry. Kerry was addressing a Constitution Day forum at the University of Florida campus in Gainesville that was organized by the ACCENT Speakers Bureau, an agency of the university's student government. Andrew Meyer, a 21-year-old fourth-year undergraduate mass communication student, had initially been allowed to ask a question after the close of the question period. He asked Kerry whether he was a member of the Skull and Bones society and used the term "blowjob" in reference to the impeachment of Bill Clinton. Meyer was forcibly pulled away from the microphone. He was immediately restrained, removed, and subsequently arrested by university police. During his arrest, Meyer struggled and screamed for help. While six officers held Meyer down, one of the officers drive-stunned him with a taser following Meyer's shouted plea to the police "Don't tase me, bro!"

The body of Dean Shillingsworth was discovered by children in a pond in Mandurama Reserve at Ambarvale, New South Wales, Australia on 17 October 2007. The child's body was wrapped in two plastic bags contained within a tartan suitcase. Due to the length of time the child was in the water, the body was decomposed. The local police set up a crime scene which was investigated by NSW Police Forensic Services Group. The forensic evidence and investigation led to the boy's mother. Police subsequently arrested his mother, Rachel Pfitzner, who lived in nearby Rosemeadow. She was charged with Dean's murder. She pleaded guilty to murder and was sentenced to a maximum of 25½ years in prison.

Adam Salter was shot and killed in his Sydney home in November 2009 after police responded to a call that the 36-year-old was stabbing himself with a knife. He was shot in the back by a New South Wales Police Sergeant Sheree Bissett who yelled "Taser, Taser, Taser" before discharging her gun. The shooter later claimed that Salter was threatening another officer with the knife and that lethal force was her only option. However, the coroner found that there was strong evidence that the policewoman mistakenly used her gun instead of her taser.

Roberto Laudisio Curti, known as Beto Laudisio, was a 21-year-old man from São Paulo, Brazil. He died on 18 March 2012 after being pursued, tackled, tasered, sprayed with OC spray, and physically compressed under the weight of multiple police officers of the New South Wales Police Force in Sydney, Australia.

<span class="mw-page-title-main">Killing of Sammy Yatim</span> Police shooting

The death of Sammy Yatim occurred early in the morning of July 27, 2013, in Toronto, Ontario, Canada. Yatim, an 18-year-old Toronto male armed with a switchblade knife, was shot at nine times, and was hit by eight of the shots fired by 30-year-old Toronto Police Service (TPS) officer James Forcillo. After being shot, while lying on the floor of the streetcar he was tasered. He later died from the injuries. The incident occurred after Yatim, brandishing a 12 cm (4.7 in) switchblade knife in a Toronto streetcar, advanced on a passenger, threatened other passengers, and exposed himself. The confrontation between Yatim and the police was recorded and footage of it was released publicly, prompting strong reactions across Canada.

Gunn, a 58-year-old African-American man, was shot and killed near his home after fleeing from a stop-and-frisk initiated by Aaron Cody Smith, a white police officer. Smith was charged with murder and indicted by a grand jury in 2016. The case came to trial in late 2019 following a change of venue to Ozark, Alabama. Smith was found guilty of manslaughter, and, in January 2020, was sentenced to 14 years in prison.

On April 11, 2021, Daunte Wright, a 20-year-old black American man, was fatally shot in Brooklyn Center, Minnesota, by police officer Kimberly Potter during a traffic stop and attempted arrest for an outstanding warrant. After a brief struggle with officers, Potter shot Wright in the chest once at close range. Wright then drove off a short distance until his vehicle collided with another and hit a concrete barrier. An officer administered CPR to Wright; paramedics were unable to revive him, and he was pronounced dead at the scene. Potter said she meant to use her service Taser, shouting "Taser! Taser! Taser!" just before firing her service pistol instead.

Charlise Mutten, a nine-year-old Australian girl, allegedly disappeared from the Wildenstein Estate wedding venue at Mount Wilson in the Blue Mountains area of New South Wales, Australia on 13 January 2022. Mutten, who lived with her grandmother in Coolangatta, Queensland was visiting her mother, Kallista Mutten, and her mother's fiancé, Justin Stein, at the property, which is owned by Stein's family. The child's body was discovered on 18 January, about 65 km from Mount Wilson. Stein has been charged with her murder.
