Dick DeGuerin (born February 16, 1941, in Austin, Texas) is an American criminal defense attorney based in Houston, [1] [2] most notable for defending Tom DeLay, Allen Stanford, David Koresh, and Robert Durst. In 1994, DeGuerin was named Outstanding Criminal Defense Lawyer of the Year by the State Bar of Texas Criminal Justice Section. [3]

Education

DeGuerin earned a Juris Doctor degree in 1965 from the University of Texas at Austin and that same year, he was admitted to the State Bar.

Career

Early in his career (1971–1982), he was an associate with Percy Foreman. In 2005, he defended former House Majority Leader Tom DeLay in DeLay's defense against indictments for money laundering and conspiracy, brought by Texas prosecutor Ronnie Earle. [4]

DeGuerin, a Democrat, previously prevailed over Earle in a case involving misconduct charges against U.S. Senator Kay Bailey Hutchison. DeLay was found guilty, [5] but the conviction was overturned on appeal. [6] He also represented bankers involved in fraud cases tied to the Enron collapse.

He represented David Koresh, the Branch Davidian cult leader, during Koresh's standoff with the FBI and the ATF agents near Waco, Texas. DeGuerin used a self-defense argument, and won, when he represented New York real estate heir Robert Durst, who admitted to killing and then dismembering the body of Durst's 71-year-old neighbor Morris Black, bagging the body parts and tossing them into Galveston Bay. [7] DeGuerin once again represented Durst at his arraignment in New Orleans on March 16, 2015, for the murder of Susan Berman in 2000 (which arose out of the HBO miniseries special The Jinx: The Life and Deaths of Robert Durst). [8]

Other cases include participating in the Congressional impeachment hearing of U.S. District Court Judge Samuel B. Kent. [9] He represented Celeste Beard, Senator Kay Bailey Hutchison, David Mark Temple, convicted of killing his wife, who was 8 months pregnant, Allen Stanford, and Billy Joe Shaver.

In early June 2023, the Texas House committee investigating Texas attorney general Ken Paxton announced the hiring of DeGuerin and fellow high-profile attorney Rusty Hardin as impeachment prosecutors. [10] [11]

DeGuerin is an adjunct professor at the University of Texas School of Law, teaching criminal law. [12]

Personal life

DeGuerin is the older brother of attorney Mike DeGeurin, despite the different way they spell their last names. [13]

A 2008 Houston Chronicle article about the brothers mentioned that Dick DeGuerin is married to his third wife. [13]

The Waco siege, also known as the Waco massacre, was the siege by U.S. federal government and Texas state law enforcement officials of a compound belonging to the religious cult known as the Branch Davidians, between February 28 and April 19, 1993. The Branch Davidians, led by David Koresh, were headquartered at Mount Carmel Center ranch in unincorporated McLennan County, Texas, 13 miles northeast of Waco. Suspecting the group of stockpiling illegal weapons, the Bureau of Alcohol, Tobacco, and Firearms (ATF) obtained a search warrant for the compound and arrest warrants for Koresh and several of the group's members.

Ronald Dale Earle was an American politician and judge who was, from January 1977 to January 2009, the District Attorney for Travis County, Texas. He became nationally known for filing charges against House majority leader Tom DeLay in September 2005 for conspiring to violate Texas' election law and/or to launder money. In Texas, Earle was known for his criminal justice reform efforts which focused on crime prevention, alternative sentencing, victim advocacy, and the reintegration of former offenders into society. In 1983, Earle – an Eagle Scout – prosecuted himself for an election law violation after missing a campaign finance filing deadline by one day; he was fined $212. Earle was a fixture in Travis County politics and served in public office there for more than 30 years, joking that he was asked if he was the "District Eternity".

Bob Perkins is an American judge who sits on Travis County District Court in Austin, Texas. In November 2005, he was assigned to preside over the Tom DeLay money-laundering case. DeLay's attorneys objected, arguing that Perkins was a member of the Democratic Party, and had contributed to the liberal group MoveOn.org which DeLay's lawyers alleged sold anti-DeLay T-shirts, which MoveOn.org denied.

Robert Alan Durst was an American real estate heir and convicted murderer. The eldest son of New York City real estate magnate Seymour Durst, he garnered attention as a suspect in the unsolved 1982 disappearance of his first wife, Kathleen McCormack; the 2000 murder of his longtime friend, Susan Berman; and the 2001 killing of neighbor Morris Black. Acquitted of murdering Black in 2003, Durst did not face further legal action until his participation in the 2015 documentary miniseries The Jinx led to him being charged with Berman's murder. Durst was convicted in 2021 and sentenced to life imprisonment without parole. He was also charged with McCormack's murder shortly after his sentencing, but died in 2022 before a trial could begin.

<span class="mw-page-title-main">Tom DeLay campaign finance trial</span>

Tom DeLay, a Republican U.S. Representative from Texas from 1979–83, and from 1985–2006 and the House Majority Leader from 2003–05, was convicted in 2010 of money laundering and conspiracy charges related to illegal campaign finance activities aimed at helping Republican candidates for Texas state office in the 2002 elections. In 2013, a Texas Court of Appeals panel acquitted DeLay when it overturned his conviction. This decision was affirmed by the Texas Court of Criminal Appeals on October 1, 2014. DeLay had three years from that date, i.e. until October 1, 2017, to file any lawsuits for wrongful action.

In October 2001, the dismembered remains of 71-year-old Morris Black were discovered floating in Galveston Bay. Black's neighbor, real estate heir Robert Durst, was charged with his murder. Durst testified he shot Black in self-defense and was acquitted due to a lack of forensic evidence to contest his account. Following the acquittal, Durst pled guilty to evidence tampering by dismembering Black's body.
