Glenn S. Gerstell is an American lawyer, technology writer, and former government official. Gerstell served as the General Counsel of the United States National Security Agency (NSA) from 2015 to 2020. He is a senior adviser at the Center for Strategic & International Studies (CSIS) and previously was a member of the US National Infrastructure Advisory Council and a Commissioner of the Washington, D.C. Homeland Security Commission. [1]

Education

After earning his B.A. cum laude in political science and government at New York University, Gerstell went to Columbia Law School and earned his J.D. degree in 1976. [2]

Career

Gerstell practiced law for nearly 40 years at the international law firm of Milbank LLP where he served for 18 years (1976 to 2015) as the managing partner of the Milbank's Washington, D.C., office. He previously led the firm's Singapore and Hong Kong offices. [3]

Gerstell is a member of the Council on Foreign Relations and an elected member of the American Academy of Diplomacy. He was also an adjunct law professor at the Georgetown University school of Law and the New York Law school. [4]

Government career

Gerstell served as the chairman of the District of Columbia Water and Sewer Authority from 2001 to 2007. He was appointed by President Barack Obama to serve on the National Infrastructure Advisory Council in 2011, and served in the role until 2015. He was a member of the Washington, D.C. Homeland Security Commission from 2013 to 2015. [5]

In August 2015 Gerstell was appointed as the General Counsel of the NSA, in which capacity he served as the principal lawyer for the agency and legal advisor to the Director of the National Security Agency. [6] [7] Gerstell occasionally served as a spokesperson for the NSA in legal and policy areas, [8] especially on technology [9] and privacy topics. [10] [11]

Post-government career

Gerstell resigned from NSA in early 2020 [12] [13] and joined the Center for Strategic and International Studies in Washington DC as a senior adviser. [14] In this role, he has continued to write on technology and national security matters. [15]

In October 2020, Gerstell was among 51 former intelligence officials who signed a letter stating that the leaking of the Hunter Biden laptop story “has the classic earmarks of a Russian information operation; although the officials "emphasize that we do not know if the emails [the subject of the story]...are genuine or not and that we do not have evidence of Russian involvement." [16] It was in fact revealed the laptop contained no concrete evidence of Russian disinformation, and portions of its contents have been verified as authentic. [17]

Gerstell has focused on threats posed by the People's Republic of China. In 2023, Gerstell expressed concern about JPMorgan Chase's commercial partnership with TikTok parent company ByteDance on payments technology. He argued it was a "step in assisting a major Chinese company, ByteDance, facilitate payments on a platform that does present national security risks." [18] He has advocated for improving the security of the U.S. Department of Defense's supply chain to keep out unwanted Chinese components [19] and has warned about the extent of Chinese hacking of American communications systems and infrastructure. [20]

Russian interference in the 2020 United States elections was a matter of concern at the highest level of national security within the United States government, in addition to the computer and social media industries. In 2020, the RAND Corporation was one of the first to release research describing Russia's playbook for interfering in U.S. elections, developed machine-learning tools to detect the interference, and tested strategies to counter Russian interference. In February and August 2020, United States Intelligence Community (USIC) experts warned members of Congress that Russia was interfering in the 2020 presidential election in then-President Donald Trump's favor. USIC analysis released by the Office of the Director of National Intelligence (DNI) in March 2021 found that proxies of Russian intelligence promoted and laundered misleading or unsubstantiated narratives about Joe Biden "to US media organizations, US officials, and prominent US individuals, including some close to former President Trump and his administration." The New York Times reported in May 2021 that federal investigators in Brooklyn began a criminal investigation late in the Trump administration into possible efforts by several current and former Ukrainian officials to spread unsubstantiated allegations about corruption by Joe Biden, including whether they had used Trump personal attorney Rudy Giuliani as a channel.

Michael Ellis is an American attorney, Republican political operative, and former government official. He is a visiting fellow for law and technology with The Heritage Foundation's Meese Center for Legal and Judicial Studies. Ellis previously worked in multiple positions in the George W. Bush administration, for Republican congressman Devin Nunes and the Trump administration, being called a Donald Trump loyalist. He worked as a legal advisor to the National Security Council and was later appointed as Senior Director for Intelligence for the agency. In December 2021, he became the general counsel for the online video platform Rumble.

Anne Neuberger is an American national security official who serves as the deputy national security advisor for cyber and emerging technology in the Biden administration. Prior to this role, she served for over a decade at the NSA, as director of cybersecurity, as assistant deputy director of operations, and as the agency's first chief risk officer. She joined the federal government as a White House fellow, working at the Pentagon, and subsequently served as deputy chief management officer of the Navy, before joining NSA. Before entering government service, Neuberger was senior vice president of operations at American Stock Transfer & Trust Company.

The Biden–Ukraine conspiracy theory is a series of false allegations that Joe Biden, while he was vice president of the United States, improperly withheld a loan guarantee and took a bribe to pressure Ukraine into firing prosecutor general Viktor Shokin to prevent a corruption investigation of Ukrainian gas company Burisma and to protect his son, Hunter Biden, who was on the Burisma board. As part of efforts by Donald Trump and his campaign in the Trump–Ukraine scandal, which led to Trump's first impeachment, these falsehoods were spread in an attempt to damage Joe Biden's reputation and chances during the 2020 presidential campaign, and later in an effort to impeach him.

<span class="mw-page-title-main">Hunter Biden laptop controversy</span> US political controversy

In October 2020, a controversy arose involving data from a laptop that belonged to Hunter Biden. The owner of a Delaware computer shop, John Paul Mac Isaac, said that the laptop had been left by a man who identified himself as Hunter Biden. Mac Isaac also stated that he is legally blind and could not be sure whether the man was actually Hunter Biden. Three weeks before the 2020 United States presidential election, the New York Post published a front-page story that presented emails from the laptop, alleging they showed corruption by Joe Biden, the Democratic presidential nominee and Hunter Biden's father. According to the Post, the story was based on information provided to Rudy Giuliani, the personal attorney of incumbent president and candidate Donald Trump, by Mac Isaac. Forensic analysis later authenticated some of the emails from the laptop, including one of the two emails used by the Post in their initial reporting.
