Harpooner was launched at Bristol in 1791. A French privateer captured her in 1793 on Harpooner's first whaling voyage to the South Seas and took her into Boston. This gave rise to an important court case.

Career

Harpooner entered Lloyd's Register (LR) in 1791 with Ramsdall, master, changing to B. Folger, J. Caves, owner, and trade Bristol—South Seas fishery. [3] She was reported to have been at 50°N8°W / 50°N 8°W / 50; -8 on 11 September 1791, and on the coast of Peru on 10 April 1792 with 25 tons of sperm oil. [2] Also, in 1792, she visited Callao.

Lloyd's List (LL) reported on 27 August 1793 that the French privateer Marsellois, of 22 guns and 180 men, from Dunkirk, had captured Harpooner and two Dutch vessels from the West Indies, and sent all three into Boston. [4] [lower-alpha 1]

Court case

The case of Folger vs. Lecuyer was important because it resulted in the United States ending French extraterritorial rights with respect to privateers and their prizes.

On 6 December 1793, a federal court in Boston declared federal jurisdiction in the prize case involving the British whaler Harpooner. The French privateer Marseilles, Jacques Louis Lecuyer, master, of Le Havre, had seized. Unfortunately for the French, her captain was Brown Folger, who was a well-known whaler from Nantucket. Not only was he an American citizen, he was part owner of the cargo. Folger argued that his cargo was landed before the outbreak of war between France and Britain, and that Article 14 of the Franco-American Treaty of Amity and Commerce exempted cargoes of whale oil. Lecuyer argued that the French Republic's consulate in Boston had jurisdiction based on the Treaty of Alliance of 1778 and the Consular Convention of 1787. [7]

By its decision the Massachusetts District Court asserted Federal jurisdiction in Admiralty matters, and ended the French Republic's extraterritorial rights in such matters. Justice John Lowell ruled that it was not the intent of the Treaty to bind the United States and France to make common cause in all future wars that either country might engage in. [7]

  1. Marseillaise (the -ois termination gave way to -ais at this period), was a 300-ton, 16-gun privateer corvette from Martinique, commissioned in 1793. The French Navy took her into service as Vengeur. [5] In 1794 she was stationed at Martinique when on 5 February, a fleet under the command of Admiral Sir John Jervis landed troops under the command of General Charles Grey. On 17 February British troops captured Venguer at St Pierre. The British Royal Navy took her into service as HMS Avenger. [6]

Vautour was a French privateer launched in 1797 at Nantes that made three privateering voyages. The Royal Navy captured her in 1800 during her fourth cruise. Private owners acquired her prior to late 1801 and employed her as the whaler Vulture in the South Seas whale fisheries between 1801 and 1809. A Spanish privateer captured her in 1809.

HMS Flirt was launched in 1782 but was completed too late to see any significant service in the American War of Independence. She then spent most of the years of peace in British waters. She sailed to Jamaica in 1791, but was laid up in Deptford in November 1792, and did not return to service before being sold in 1795. Daniel Bennett purchased her, had her almost rebuilt, and then employed her as a whaler in the Southern Whale Fishery. A French privateer captured her in 1803 as Flirt was returning to Britain from a whaling voyage.

Chardon was a whaler that Aget, Kenny, and Coffyn purchased in 1787 and commissioned at Dunkirk that same year. Benjamin Hussey purchased her in 1789 and renamed her Judith. Judith made four whaling voyages as a French ship. The British captured her but her crew recaptured her. She then sailed to New Bedford.

Butterworth was launched in 1778 in France as the highly successful 32-gun privateer Américaine, of Granville. The British Royal Navy captured her early in 1781. She first appeared in a commercial role in 1784 as America, and was renamed in 1785 as Butterworth. She served primarily as a whaler in the Greenland whale fisheries. New owners purchased her in 1789. She underwent a great repair in 1791 that increased her size by almost 20%. She is most famous for her role in the "Butterworth Squadron", which took her and two ship's tenders on an exploration, sealing, otter fur, and whaling voyage to Alaska and the Pacific Coast of North America. She and her consorts are widely credited with being the first European vessels to enter, in 1794, what is now Honolulu harbour. After her return to England in 1795, Butterworth went on three more whaling voyages to the South Pacific, then Africa, and then the South Pacific again. In 1802 she was outward bound on her fourth of these voyage, this to the South Pacific, when she was lost.

HMS <i>Alderney</i> (1757) Sloop of the Royal Navy

HMS Alderney was a 10-gun Alderney-class sloop of the Royal Navy that saw active service during the Seven Years' War and the American Revolutionary War. Launched in 1757, she was principally deployed in the North Sea to protect British fishing fleets and merchant trade. In this capacity she captured two American privateers, Hawk in 1779 and the 12-gun Lady Washington in 1780. She was removed from Navy service at the conclusion of the American Revolutionary War, and sold into private hands at Deptford Dockyard on 1 May 1783. She became the whaler Alderney that operated between 1784 and 1797, when the Spaniards captured her off Chile.

HMS Terror was bomb vessel launched in 1741, converted to a sloop, and sold in 1754. She went into mercantile service, becoming the northern whale fishery whaler Duke of York. In 1784 her name changed to Elizabeth and Margaret, and she continued as a Greenland whaler, before becoming a whaler in the British southern whale fishery. She was last listed in 1794.

Robust was built in France in 1779. The British captured her in 1781 and she was registered at Liverpool in 1783. She first entered Lloyd's Register in 1789 as whaler in the northern whale fishery. Then in December 1788 she left on the first of three voyages as a slave ship in the triangular trade in enslaved people. On her third voyage as a slave ship Robust captured a French slave ship and recaptured two British slave ships that a French privateer had captured earlier. After her third voyage as a slaver owners shifted her registry to Bristol and she then made two voyages to the southern whale fishery. She returned from the second voyage in 1797 and is last listed in 1798.

Commerce was launched at Liverpool in 1791. She was initially a West Indiaman. New owners in 1795 sent Commerce to the southern whale fishery in 1796. The Spanish captured her in 1797, but by 1799 she had returned to British ownership. She then traded generally until a French privateer captured her in 1805.

Cicero was launched at Sunderland in 1796 and initially sailed as a West Indiaman. She was briefly captured in 1799 in a single-ship action with a French privateer. Later, she went whale hunting both in the northern whale fishery (1803-1808), and the southern whale fishery (1816-1823). She capsized at Limerick in September 1832 and was condemned there.

Resolution was launched at Liverpool in 1776 as the West Indiaman Thomas Hall; she was renamed in 1779. She sailed briefly as a privateer. Then between 1791 and 1804 Revolution made some six voyages as a whaler. On one voyage, in 1793, a French frigate captured her, but Resolution was re-captured. In 1804 a new owner returned her to the West Indies trade. She does not appear to have sailed after early 1805.

Mentor was launched in New England in 1781. From 1784 she sailed from Great Britain, trading between London and New York or Quebec. From 1789 she made three complete voyages as a whaler in the British Southern Whale Fishery. The French Navy captured her in early 1795 as she was returning from her fourth whaling voyage.

Castor & Pollux was launched at Teignmouth in 1790. Initially she traded with the Mediterranean, and on one voyage suffered a fire at sea. She then became a West Indiaman. In 1799 she commenced a voyage as a whaler. A Spanish privateer captured her in the Pacific circa 1801.

HMS Spy was a Bonetta-class sloop launched at Rotherhithe in 1756 for the Royal Navy. The Navy sold her in 1773. From 1776, or perhaps earlier she was a transport. Then from 1780 to 1783, as Mars, she was first a privateer and then a slave ship, engaged in the triangular trade in enslaved persons. Between 1783 and 1787 her name was Tartar, and she traded with the Mediterranean. From 1787, as Southampton, she was a whaler in the British southern whale fishery. She made at least four complete whaling voyages and was last listed in 1792.

Several ships have been named Trelawney or Trelawny.

Chaser was built in the East Indies in 1778. The Royal Navy purchased her in 1781 and commissioned her as HMS Chaser. A French frigate captured her in 1782 but the Royal Navy recaptured her in 1783 and took her back into service. She was present at a major battle and then sailed to England where the Navy sold her in 1784. As the mercantile Chaser she made five or six voyages as a whaler in the British northern whale fishery and then two to the southern whale fishery. On her way home from the second a French privateer captured her, but some of her crew recaptured her. Next, she began trading with Honduras but was wrecked in late 1795 as she was returning from there to London.

Chaser first appeared under that name in British records in 1786. She had been launched in 1771 at Philadelphia under another name, probably Lord North. Lord North became Cotton Planter, and then Planter, before she became Chaser. Between 1786 and 1790 Chaser made four voyages as a whaler in the British southern whale fishery. She then became a merchantman. In 1794 a privateer captured her but the Spanish recaptured her. She became a Liverpool-based Slave ship in the triangular trade in enslaved people. In 1796 she was condemned in West Africa on her first voyage in the triangular trade before she could embark any enslaved people.
