Joint industrial council

A joint industrial council (JIC) or national joint industrial council (NJIC), known as a Whitley council in some fields, especially white-collar and government, is a statutory council of employers and trade unions established in the United Kingdom and elsewhere. It is a workplace partnership, an institution that serves for a forum of consultation between employees and employers. Councils were established in 1919. They typically worked to determine wage rates, terms and conditions in a specific industry. There were dozens of JICs, one for each industry. Most JICs were established between the 1920s and the 1940s. The larger JICs also had regional councils throughout the country and some industries had separate JICs for England and Wales, Scotland and Northern Ireland. The Isle of Man had its own councils.

Background

During World War I, in 1917, John Henry Whitley was appointed to chair a committee, which soon produced a Report on the Relations of Employers and Employees in the wake of the establishment of the Shop Stewards Movement and the widespread protest action against dilution. The smooth running of industry was vital to the war effort so maintaining good industrial relations was a priority. [1]

He proposed a system of regular formal consultative meetings between workers and employers, known to this day as "Whitley councils". These would be empowered to cover any issue related to pay and conditions of service, and to take matters through to arbitration if necessary. This was a strong model which was to influence industrial relations in Canada, [2] Australia [3] and elsewhere.

The intention was to establish Whitley councils in the private sector, in particular in those industries most affected by the strike wave – to offset the demand for 'workers' control' – a demand which was rapidly gaining ground after the Russian revolution.

However, the councils failed to gain ground in coal, cotton, engineering and other heavy industries, but succeeded only in the sphere of government employment [4] where they remain a major feature of public sector industrial relations to this day.

The Royal Institute of Public Administration commissioned Henry Parris, then of Durham University, to write a history of Whitleyism, [5] published in 1973, to mark the 50th anniversary of the foundation of the National Whitley Council.

The Whitley council system was reviewed in detail by Lord McCarthy in 1976. [6]

Membership

Whitley councils comprise employee representatives, often referred to as the "staff side" and employer representatives, also known as the "official side".

Organisation

Whitley councils may be organised in a hierarchical manner, reflecting the structure of the employing organisation. For example, within the UK civil service, Whitley councils exist at local, workplace level, then at departmental level and ultimately at national level. In other institutions a geographic hierarchy (local, area, regional, national) may be followed.

National Health Service

Functional Whitley councils were established in the NHS in 1948 to negotiate pay. In addition there was a Nurses and Midwives Whitley Council for Great Britain which negotiated conditions of service. It had 64 members, 41 for the staff side and 23 for the management side. The National Union of Public Employees and the Confederation of Health Service Employees each had four seats and the National Union of General and Municipal Workers had three. The Royal College of Nursing had twelve. [9]

In 1979 there were eight functional councils in the National Health Service covering all NHS staff, except doctors and dentists, and a few other NHS workers who negotiated directly with the health departments. [6]

The Working Time Regulations 1998 give the right to 28 days paid holidays, breaks from work, and attempt to limit long working hours. The Canada Labour Code is an Act of the Parliament of Canada to consolidate certain statutes respecting labour. The objective of the Code is to facilitate production by controlling strikes & lockouts, occupational safety and health, and some employment standards.

An Australian workplace agreement (AWA) was a type of formalised individual agreement negotiated between an employer and employee in Australia that existed from 1996 to 2009. Employers could offer a "take it or leave it" AWA as a condition of employment. They were registered by the Employment Advocate and did not require a dispute resolution procedure. These agreements operated only at the federal level. AWAs were individual written agreements concerning terms and conditions of employment between an employer and employee in Australia, under the Workplace Relations Act 1996. An AWA could override employment conditions in state or territory laws except those relating to occupational health and safety, workers' compensation, or training arrangements. An AWA was required to meet only the most minimal Australian Fair Pay and Conditions Standard. Agreements were not required to include effective dispute resolution procedures, and could not include prohibited content. Agreements were for a maximum of five years; approved, promoted and registered by the Workplace Authority; operated to the exclusion of any award; and prohibited industrial action regarding details in the agreement for the life of the agreement. The introduction of AWAs was a very controversial industrial relations issue in Australia.

<span class="mw-page-title-main">Equal Pay Act 1970</span> United Kingdom legislation

The Equal Pay Act 1970 was an Act of the Parliament of the United Kingdom that prohibited any less favourable treatment between men and women in terms of pay and conditions of employment. The Act was proposed by the then Labour government, and was based on the Equal Pay Act of 1963 of the United States. It has now been mostly superseded by Part 5, chapter 3! of the Equality Act 2010.

Overtime bans are a type of strike in which workers refuse to engage in overtime work, being any work that falls outside of contracted hours. They do this to leverage their employer into negotiating various working conditions. Often organised in unions, workers may choose this form of industrial action to bargain for a higher rate of pay, better working conditions or to discourage an employer from making redundancies. Unlike a full strike in which employees are usually in breach of their contract, workers engaging in overtime bans are typically well protected. Employers cannot legally withhold normal wages during an overtime ban if employees are not breaching the terms of their employment contracts by refusing to do overtime work. However, the legalities of overtime bans do vary between countries. Overtime bans are effective where "industries and organisations run on such habitually high levels of overtime or goodwill that overtime bans ... can have a significant and immediate impact upon the availability of a good or service". Historically, unions have at times received criticism on ethical grounds for choosing to enact overtime bans. The literature records the occurrence of such bans from the 1800s and there is documentation of their use in four continents.

Though the public system dominates healthcare provision in England, private health care and a wide variety of alternative and complementary treatments are available for those willing and able to pay.

Codetermination in Germany is a concept that involves the right of workers to participate in management of the companies they work for. Known as Mitbestimmung, the modern law on codetermination is found principally in the Mitbestimmungsgesetz of 1976. The law allows workers to elect representatives for almost half of the supervisory board of directors. The legislation is separate from the main German company law Act for public companies, the Aktiengesetz. It applies to public and private companies, so long as there are over 2,000 employees. For companies with 500–2,000 employees, one third of the supervisory board must be elected.

Iranian labor law describes the rules of employment in Iran. As a still developing country, Iran is considerably behind by international standards. It has failed to ratify the two basic Conventions of the International Labour Organization on freedom of association and collective bargaining, and one on abolition of child labor. Countries such as the US and India have also failed to ratify many of these Conventions and a mere 14 other Conventions, only 2 since the Islamic Revolution.

Indian labour law refers to law regulating labour in India. Traditionally, the Indian government at the federal and state levels has sought to ensure a high degree of protection for workers, but in practice, this differs due to the form of government and because labour is a subject in the concurrent list of the Indian Constitution. The Minimum Wages Act 1948 requires companies to pay the minimum wage set by the government alongside limiting working weeks to 40 hours. Overtime is strongly discouraged with the premium on overtime being 100% of the total wage. The Payment of Wages Act 1936 mandates the payment of wages on time on the last working day of every month via bank transfer or postal service. The Factories Act 1948 and the Shops and Establishment Act 1960 mandate 15 working days of fully paid vacation leave each year to each employee with an additional 7 fully paid sick days. The Maternity Benefit (Amendment) Act, 2017 gives female employees of every company the right to take 6 months' worth of fully paid maternity leave. It also provides for 6 weeks worth of paid leaves in case of miscarriage or medical termination of pregnancy. The Employees' Provident Fund Organisation and the Employees' State Insurance, governed by statutory acts provide workers with necessary social security for retirement benefits and medical and unemployment benefits respectively. Workers entitled to be covered under the Employees' State Insurance are also entitled to 90 days worth of paid medical leaves. A contract of employment can always provide for more rights than the statutory minimum set rights. The Indian parliament passed four labour codes in the 2019 and 2020 sessions. These four codes will consolidate 44 existing labour laws. They are: The Industrial Relations Code 2020, The Code on Social Security 2020, The Occupational Safety, Health and Working Conditions Code, 2020 and The Code on Wages 2019.

The International Association of Sheet Metal, Air, Rail, and Transportation Workers (SMART) is a North American labor union headquartered in Washington, D. C., was chartered by the AFL–CIO in 2013. The product of a merger between the Sheet Metal Workers’ International Association (SMWIA) and the United Transportation Union (UTU), SMART represents over 210,000 sheet metal workers, service technicians, bus operators, engineers, conductors, sign workers, welders, and production employees, among others, throughout the United States, Puerto Rico, and Canada. The Transportation Division represents employees on Class I railroad, Amtrak, and regional and short line railroads; bus and mass transit employees on some 45 transit systems; and airline pilots, flight attendants, dispatchers and other airport personnel. The Division's 500 local unions organize conductors, brakemen, switch men, ground service personnel, locomotive engineers, hostlers, and railroad yard masters, as well as bus drivers and mechanics.
