The Leland Olds hearing in 1949 was the unsuccessful re-nomination of the head of the Federal Power Commission which has been cited as a precursor to McCarthyism.
Olds was an economist who in the 1920s, before he was appointed by Roosevelt as chairman of the commission, had been the Industrial editor for the Federated Press [1] a left wing news agency which served Trade Union newspapers but had an ambiguous relationship with the American Communist Party. [2]
The Federal Power Commission was a five-member regulatory body appointed by the President and confirmed by the Senate. [3] One of the FPC's strongest leaders was Leland Olds who by 1949 had served two terms. Olds' insistence on enforcing the Natural Gas Act of 1938 raised the ire of the oil industry in Texas.
In 1944, when Olds was renominated by Roosevelt, his writing for the Federated Press had been brought up by the anti-New Deal Republican Edward Moore of Oklahoma used as evidence that Olds was "opposed fundamentally to private enterprise." [4] During these re-nomination hearings a number of state public utility commissioners were opposed to Olds due to concerns with over centralizing utility regulation away from the States. [5] However Olds was confirmed both within the Committee and on the Senate floor. [4]
In 1948 in the debate over the deregulating Kerr Bill, Olds together with another Commissioner Claude L. Draper published a study, and also testified, [6] that forcefully argued that the Federal Power Commission had both the authority and the duty to regulate the prices that Natural Gas was sold to wholesalers. The Federal Power Commission did not take a position on the Bill [7] and it was opposed by Senators from the gas-producing Southwest, including Robert Kerr of Oklahoma, who was seen at the time as Olds' principle opponent for re-nomination, [5] and Lyndon Johnson of Texas. [1]
Like many other Presidential appointments Olds would need to be approved by the Senate, which in almost every case would delegate that task to a Senate committee, in this case the Committee on Interstate and Foreign Commerce. The nomination had been lodged very close to the end of Olds' term due to the delay in the nomination of another pro regulation commissioner, Thomas C. Buchanan. [5]
In 1949 Lyndon Johnson persuaded the committee chairman, Edwin C. Johnson to make him chairman of a subcommittee and later that this subcommittee should be tasked with Olds' renomination. [6] As well as Lyndon and Edwin Johnson the members of the subcommittee were Ernest McFarland, Herbert O'Conor, Clyde Reed, Homer Capehart and John Bricker [8]
The witnesses who testified against Olds were all directly or indirectly connected to oil and natural gas interests. [5] While the electricity companies made no public opposition although there was an assumption that they privately opposed Olds. [5] However there were Republicans who were not attached to oil interests who were opposed to Olds' regulatory ideas, with both his home state New York senators, future Eisenhower Republicans Irving Ives and John Foster Dulles both declining to support his re-nomination. [9]
Robert Caro's book Master of the Senate claims that Lyndon Johnson, whose campaign in the 1948 United States Senate election in Texas received extensive funding from Texas oilmen, defeated Olds' re-appointment by orchestrating a smear campaign to accuse Olds of Communist sympathies. [4] This was co-ordinated by the Texan lobbyist Alvin Wirtz to dig up old writings which were then taken out of context to falsely paint Olds as a communist or communist sympathizer. The House Un-American Activities Committee prepared a memorandum summarizing the information in their files. [6]
The subcommittee in charge of reappointment was stacked against Olds,[ citation needed ] with the main anti-Olds witness, Representative John Lyle being coached by Johnson. [6] Olds had support from liberals such as Eleanor Roosevelt [10] and the liberal Democratic Senator Paul Douglas. [11]
Despite coming out publicly against Olds, [12] at the end of the nomination fight Johnson came up to Olds and said “Lee, I hope you understand there’s nothing personal in this. We’re still friends, aren’t we? It’s only politics, you know.” [13]
Truman insisted on the nomination going to the Senate floor [14] although Olds faced a similar rejection by 53 votes to 13. [5] [15]
Following such episodes, the FPC was reluctant to impose price regulation on the producers with many regulations being reversed after he left. [16]
The Olds hearings were seen by many as a template for later McCarthyite purges. [13]
The lack of action by the FPC after Olds left was seen as the cause of the Phillips Petroleum Co. v. Wisconsin lawsuit.

Johnson and Speaker of the House Sam Rayburn, but unlike most Southern congressmen, Yarborough refused to support the 1956 Southern Manifesto, which called for resistance to the racial integration of schools and other public places. Yarborough voted in favor of the Civil Rights Acts of 1957, 1960, 1964, and 1968, as well as the 24th Amendment to the U.S. Constitution, the Voting Rights Act of 1965, and the confirmation of Thurgood Marshall to the U.S. Supreme Court. Yarborough was the only senator from a state that was part of the Confederacy to vote for all five bills.

A member of the Democratic Party, he served as the 66th Governor of Georgia from 1931 to 1933 before serving in the United States Senate for almost 40 years, from 1933 to 1971. Russell was a founder and leader of the conservative coalition that dominated Congress from 1937 to 1963, and at his death was the most senior member of the Senate. He was a leader of Southern opposition to the civil rights movement for decades.

The Bricker Amendment is the collective name of a number of slightly different proposed amendments to the United States Constitution considered by the United States Senate in the 1950s. None of these amendments ever passed Congress. Each of them would require explicit congressional approval, especially for executive agreements that did not require the Senate's two-thirds approval for treaty. They are named for their sponsor, conservative Republican Senator John W. Bricker of Ohio, who distrusted the exclusive powers of the president to involve the United States beyond the wishes of Congress.

The Natural Gas Act of 1938 was the first occurrence of the United States federal government regulating the natural gas industry. It was focused on regulating the rates charged by interstate natural gas transmission companies. In the years prior to the passage of the Act, concern arose about the monopolistic tendencies of the transmission companies and the fact that they were charging higher than competitive prices. The passage of the Act gave the Federal Power Commission (FPC) control over the regulation of interstate natural gas sales. Later on, the FPC was dissolved and became the Federal Energy Regulatory Commission (FERC) pursuant to a different act. FERC continues to regulate the natural gas industry to this day.
The 1948 United States Senate election in Texas was held on November 2, 1948. After the inconclusive Democratic Party primary in July, a hotly contested runoff was held in August in which U.S. Congressman Lyndon B. Johnson was officially declared to have defeated former Texas governor Coke R. Stevenson for the party's nomination by eighty-seven votes. The state party's executive committee subsequently confirmed Johnson's nomination by a margin of one vote. The validity of the runoff result was challenged before the U.S. Supreme Court due to allegations of irregularities, and in later years, testimony by the parties involved indicated that widespread fraud occurred and that friendly political machines produced the votes needed for Johnson to defeat Stevenson. After years of desultory opposition to Democrats during the post-Reconstruction years of the Solid South, Republicans vigorously contested the general election by nominating businessman and party activist Jack Porter, who waged an aggressive campaign. Johnson won his first term in the Senate, but by a closer margin than usual for Texas Democrats.
Alvin Jacob Wirtz was a lawyer, politician, and undersecretary to the Department of the Interior, and was born in Columbus, Texas to Lewis Milton and Dora (Dent) Wirtz. He attended public schools in Columbus, Texas and graduated from the University of Texas in 1910 with an LL.B. He married Kitty Mae Stamps of Seguin in 1913.
Thurgood Marshall was nominated to serve as an associate justice of the Supreme Court of the United States by U.S. President Lyndon B. Johnson on June 13, 1967 to fill the seat being vacated by Tom C. Clark. Per the Constitution of the United States, the nomination was subject to the advice and consent of the United States Senate, which holds the determinant power to confirm or reject nominations to the U.S. Supreme Court. Marshall was confirmed by the U.S. Senate in a 69–11 vote on August 30, 1967, becoming the first African American member of the Court, and the court's first non-white justice.
The Southern Caucus was a Congressional caucus of Southern Democrats in the United States Senate chaired by Richard Russell, which was an effective opposition to civil rights legislation and formed a vital part of the later conservative coalition that dominated the Senate into the 1960s.

The Kerr Bill was an attempt to deregulate natural gas prices in the United States by amending the Natural Gas Act of 1938 to specifically remove any right of the Federal Power Commission to regulate the price charged for natural gas going into interstate pipelines. It was strongly backed by oil and gas companies. It was opposed by Leland Olds the chairman of the Federal Power Commission, although the Federal Power Commission itself did not take a position on the Bill and it was seen as a big factor in the rejection of Olds when his re-nomination was rejected later that year.
