The National Security and Homeland Security Presidential Directive (National Security Presidential Directive NSPD 51/Homeland Security Presidential Directive HSPD-20, sometimes called simply "Executive Directive 51" for short), signed by President of the United States George W. Bush on May 4, 2007, is a Presidential Directive establishing a comprehensive policy on the federal government structures and operations in the event of a "catastrophic emergency". Such an emergency is defined as "any incident, regardless of location, that results in extraordinary levels of mass casualties, damage, or disruption severely affecting the U.S. population, infrastructure, environment, economy, or government functions." The unclassified portion of the directive (which replaced President Bill Clinton's 1998 Presidential Decision Directive 67), was posted on the White House website on May 9, 2007, without any further announcement or press briefings, [2] although Special Assistant to George W. Bush Gordon Johndroe answered several questions on the matter when asked about it by members of the press in early June 2007. [2]

Details

This presidential directive defines the "national essential functions" of the federal government, specifies "continuity requirements" for the departments and agencies in the federal government's executive branch, and "provides guidance for state, local, territorial, and tribal governments, and private sector organizations. It also provides for a National Continuity Coordinator who will oversee the "development and implementation of federal continuity policies."

The source text indicates that during a catastrophic emergency the federal government will cooperate as a matter of comity in order to protect the constitution:

(e) "Enduring Constitutional Government," or "ECG," means a cooperative effort among the executive, legislative, and judicial branches of the Federal Government, coordinated by the President, as a matter of comity with respect to the legislative and judicial branches and with proper respect for the constitutional separation of powers among the branches, to preserve the constitutional framework under which the Nation is governed and the capability of all three branches of government to execute constitutional responsibilities and provide for orderly succession, appropriate transition of leadership, and interoperability and support of the National Essential Functions during a catastrophic emergency; [3]

The source text for NSPD51 repeatedly reaffirms constitutionality and specifically states that "(9) Recognizing that each branch of the Federal Government is responsible for its own continuity programs, an official designated by the Chief of Staff to the President shall ensure that the executive branch's Continuity of Operations and Continuity of Government policies in support of Enduring Constitutional Government efforts are appropriately coordinated with those of the legislative and judicial branches in order to ensure interoperability and allocate national assets efficiently to maintain a functioning Federal Government."

Conservative activist Jerome Corsi and Marjorie Cohn of the National Lawyers Guild have said that this is a violation of the Constitution of the United States in that the three branches of government are separate and equal, with no single branch coordinating the others. [4] [5]  The directive, created by the president, claims that the president has the power to declare a catastrophic emergency. It does not specify who has the power to declare the emergency over.

The directive further says that, in the case of such an emergency, the new position of "National Continuity Coordinator" would be filled by the assistant to the president for Homeland Security and Counterterrorism. (This position is currently held by Elizabeth Sherwood-Randall.) The directive also specifies that a "Continuity Policy Coordination Committee", to be chaired by a senior director of the Homeland Security Council staff, and selected by the National Continuity Coordinator, shall be "the main day-to-day forum for such policy coordination".

The directive ends by describing a number of "annexes", of which Annex A is described as being not classified but which does not appear on the directive's Web page:

(23) Annex A and the classified Continuity Annexes, attached hereto, are hereby incorporated into and made a part of this directive.

(24) Security. This directive and the information contained herein shall be protected from unauthorized disclosure, provided that, except for Annex A, the Annexes attached to this directive are classified and shall be accorded appropriate handling, consistent with applicable Executive Orders.

The "National Continuity Policy, Annex A, Categories of Departments and Agencies", available from the Financial and Banking Information Infrastructure Committee website, [6] indicates that "executive departments and agencies are assigned to one of four categories commensurate with their COOP/COG/ECG responsibilities during an emergency".

Reception

The signing of this Directive was generally not covered by the mainstream U.S. media or discussed by the U.S. Congress. While similar executive security directives have been issued by previous presidents, with their texts kept secret, this is the first to be made public in part. It is unclear how the National Security and Homeland Security Presidential Directive will reconcile with the National Emergencies Act, a U.S. federal law passed in 1976, which gives Congress oversight over presidential emergency powers during such emergencies. The National Emergencies Act is not mentioned in the text of the National Security and Homeland Security Presidential Directive.

After receiving concerned communications from constituents, in July 2007 U.S. Representative and Homeland Security Committee member Peter DeFazio made an official request to examine the classified Continuity Annexes described above in a secure "bubbleroom" in the United States Capitol, but his request was denied by the White House, which cited "national security concerns." This was the first time DeFazio had been denied access to documents. He was quoted as saying, "We're talking about the continuity of the government of the United States of America ... I would think that would be relevant to any member of Congress, let alone a member of the Homeland Security Committee." After this denial, DeFazio joined with two colleagues (Bennie Thompson, chairman of the committee; and Chris Carney, chairman of the Homeland Security oversight subcommittee) in a renewed effort to gain access to the documents.[ needs update ]

An executive order is a means of issuing federal directives in the United States, used by the President of the United States, that manages operations of the federal government. The legal or constitutional basis for executive orders has multiple sources. Article Two of the United States Constitution gives the president broad executive and enforcement authority to use his or her discretion to determine how to enforce the law or to otherwise manage the resources and staff of the executive branch. The ability to make such orders is also based on expressed or implied Acts of Congress that delegate to the president some degree of discretionary power.

Continuity of government (COG) is the principle of establishing defined procedures that allow a government to continue its essential operations in case of a catastrophic event such as nuclear war.

National security directive

National security directives are presidential directives issued for the National Security Council (NSC). Starting with Harry Truman, every president since the founding of the National Security Council in 1947 has issued national security directives in one form or another, which have involved foreign, military and domestic policies. National security directives are generally highly classified and are available to the public only after "a great many years" have elapsed. Unlike executive orders, national security directives are usually directed only to the National Security Council and the most senior executive branch officials, and embody foreign and military policy-making guidance rather than specific instructions.

Frances Townsend

Frances M. "Fran" Fragos Townsend is the former Homeland Security Advisor to United States President George W. Bush from 2004 to 2007, and is currently a political pundit on TV. She previously served as Deputy Assistant to the President and Deputy National Security Advisor for Combating Terrorism. In 2008, Townsend joined CNN as a contributor, but later switched over to CBS where she is now a national security analyst for them. Townsend is president of the Counter Extremism Project.

The National Security Council Deputies Committee (DC) is a committee of the United States National Security Council and the senior sub-Cabinet interagency forum for consideration of national security policy issues by the United States Government.

The United States National Response Framework (NRF) is part of the National Strategy for Homeland Security that presents the guiding principles enabling all levels of domestic response partners to prepare for and provide a unified national response to disasters and emergencies. Building on the existing National Incident Management System (NIMS) as well as Incident Command System (ICS) standardization, the NRF's coordinating structures are always in effect for implementation at any level and at any time for local, state, and national emergency or disaster response.

Kenneth L. Wainstein

Kenneth Leonard Wainstein is an American lawyer. He served as the first Assistant Attorney General for National Security, and later as the Homeland Security Advisor to United States President George W. Bush.

HSPD-7 was revoked by the Presidential Policy Directive 21 (PPD-21) on Critical Infrastructure Security and Resilience on February 12, 2013. PPD-21 states that "Plans developed pursuant to HSPD-7 shall remain in effect until specifically revoked or superseded." Multiple changes came out of PPD-21, including a six actions with specific deadlines. One of those actions was to update the National Infrastructure Protection Plan within 240 days.

The Integrated Planning System is a structured planning framework adapted from the US military's Joint Operational Planning and Execution System (JOPES) and was developed and released by the US Department of Homeland Security in January 2009.

Homeland Security Presidential Directive (HSPD)-8, National Preparedness, describes the way United States Federal agencies will prepare for an incident. It requires Department of Homeland Security to coordinate with other Federal agencies and with State, local, and Tribal governments to develop a National Preparedness Goal with Emergency management. Congressional laws enacted, following the wake of 9/11, which resulted in new developments in the way security was assessed and addressed in the United States, to prevent and respond to threatened or actual domestic terrorist attacks, disasters, and other emergencies by requiring a national domestic all-hazards preparedness goal. HSPD 5, HSPD-7, HSPD-8, and HSPD-8 Annex 1 are directives that deal with the preparedness goals.

Arctic policy of the United States

The Arctic policy of the United States is the foreign policy of the United States in regard to the Arctic region. In addition, the United States' domestic policy toward Alaska is part of its Arctic policy.

The Comprehensive National Cybersecurity Initiative (CNCI) outlines U.S. cybersecurity goals across multiple agencies including the Department of Homeland Security, the Office of Management and Budget, and the National Security Agency. The initiative was established by President George W. Bush in January 2008 in National Security Presidential Directive 54/Homeland Security Presidential Directive 23 (NSPD-54/HSPD-23).

Presidential Policy Directive 20 (PPD-20), provides a framework for U.S. cybersecurity by establishing principles and processes. Signed by President Barack Obama in October 2012, this directive supersedes National Security Presidential Directive NSPD-38. Integrating cyber tools with those of national security, the directive complements NSPD-54/Homeland Security Presidential Directive HSPD-23.

The US Department of Commerce Office of Security is a division of the US Department of Commerce (DOC) that works to provide security services for facilities of the department. Its aim is to provide policies, programs, and oversight as it collaborates with facility managers to mitigate terrorism risks to DOC personnel and facilities, program managers to mitigate espionage risks to DOC personnel, information, and facilities, and Department and Bureau leadership to increase emergency preparedness for DOC operations.

A presidential directive, or executive action, is a written or oral instruction or declaration issued by the president of the United States, which may draw upon the powers vested in the president by the U.S. Constitution, statutory law, or, in certain cases, congressional and judicial acquiescence. Such directives, which have been issued since the earliest days of the federal government, have become known by various names, and some have prescribed forms and purposes. Presidential directives remain in effect until they are revoked, which the president is free to do. The classification of presidential directives is not easily done, as the distinction between the types can be quite arbitrary, arising from convenience and bureaucratic evolution, and none are defined in the Constitution. Furthermore, the different types may overlap. As one legal scholar put it: "it is a bit misleading to overclassify presidential directives as comprising separate and distinct 'types' just because they have different headings at the top of the first page". In terms of legal applicability, what matters is the substance of the directive, not the form, unless a certain kind of directive is specifically required by relevant statute.

The National Cybersecurity and Communications Integration Center (NCCIC) is part of the Cybersecurity Division of the Cybersecurity and Infrastructure Security Agency, which is an agency of the U.S. Department of Homeland Security. It acts to coordinate various aspects of the U.S. federal government's cybersecurity and cyberattack mitigation efforts, through cooperation with civilian agencies, infrastructure operators, state and local governments, and international partners.
