Ponderosa Twins Plus One was an American soul vocal group formed in 1970 in Cleveland, Ohio. The group featured two sets of identical twins, Alfred and Alvin Pelham, and Keith and Kirk Gardner, along with Ricky Spicer. The group released one studio album, 2 + 2 + 1 = Ponderosa Twins Plus One , in 1971, before disbanding in 1975.

The group came into prominence after their track, "Bound" was sampled by rapper Kanye West in his 2013 song, "Bound 2". This was followed by a copyright lawsuit by Ricky Spicer. "Bound" was also sampled by rapper Tyler, the Creator in his 2019 song "A Boy Is a Gun".

History

The group was founded in 1969 while the original members attended the Patrick Henry Jr. High School on the east side of Cleveland. The group was managed by Tony Wilson, who brought them to the attention of Bobby Massey of the O'Jays. Through Massey, the group eventually signed to Chuck Brown's Astroscope record label. [1]

Accompanied by Massey, the group recorded three singles in a studio. Sylvia Robinson, the owner of All Platinum Records, agreed to distribute singles. The group's first single, "You Send Me" became their best-selling single, [1] [2] peaking at number 23 at Billboard 's Best Selling Soul Singles. [3] Following the success of the single, the group toured with artists such as the Moments, the Whatnauts, Linda Jones and Lonnie Youngblood. [1]

In 1971, the group released their only album, 2 + 2 + 1 = Ponderosa Twins Plus One . [1] "Bound" became their second single and peaked at number 47 on Best Selling Soul Singles chart. [4] The second single off the album, a cover of Frankie Lymon's "Why Do Fools Fall in Love", was also released in 1971. It was produced by Calvin Simon of Parliament and Funkadelic. [1]

Due to the lack of royalties and earnings from live shows, the group disbanded in 1975. Following the disestablishment of the act, the Pelham twins have since died and both Gardner twins are in prisons. [5] [6]

Kirk Gardner has been incarcerated at Belmont Correctional Institution since June 9, 1980 for receiving stolen property, felony assault, rape, kidnapping and aggravated murder. He is doing 28 years to life. [1] In 2013, a petition was started to free Kirk Gardner from prison with the motive “he has served 33 years in prison. He has did his time”. The petition was closed with only five supporters. Keith Gardner was sentenced to 25 years in 1977 for murder, was released in 2007 but charged in 2010 for attempted murder and robbery, after shooting at a man. He was sentenced to nine years in January 2011. [7] [8]

Ricky Spicer became a construction worker in the greater Cleveland area [1] and maintained a friendship with the Gardners. [5]

Lawsuits

In 2013, Ricky Spicer filed a lawsuit against rapper Kanye West, as well as Roc-A-Fella Records, the Island Def Jam Music Group, Rhino Entertainment and Universal Music Group, citing copyright infringement in West's track, "Bound 2", from his 2013 album, Yeezus . [9] [10] Spicer alleged that West didn't ask his permission to use the sample and it was audible in the record, seeking an injunction and damages for alleged violations. [11] [12] In 2015, Ricky Spicer's attorney, Brittany Weiner from the law firm Imbesi Law P.C. confirmed that both parties had entered into a confidential settlement agreement and that the case was resolved. [13]

In 2014, Spicer sued Vogue magazine and its publisher Condé Nast, after "Bound 2" was used in the promotional behind the scenes video for the magazine's April edition cover, which featured Kanye West and Kim Kardashian. [14] [15]

It was released on August 8, 2011, by Roc-A-Fella Records, Roc Nation, and Def Jam Recordings. Prior to its release, Jay-Z and West had collaborated on various singles, and with the latter as a producer on the former's work. They originally sought to record a five-song collaborative extended play, which evolved into a full-length album. The album features guest appearances from Frank Ocean, The-Dream, Beyoncé and Mr Hudson. Kanye West Presents: GOOD Music – Cruel Summer, commonly referred to simply as Cruel Summer, is a compilation album by recording artists of American record label GOOD Music, released on September 14, 2012, by the label itself and its parent company, Def Jam Recordings. GOOD Music's founder, American rapper Kanye West, first revealed plans for the label's collaborative album in October 2011. It was preceded by four singles—"Mercy", "Cold", "New God Flow", and "Clique"—that saw mixed success on the US Billboard Hot 100 chart. The album features West himself, alongside the label's then-signees Pusha T, Big Sean, Teyana Taylor, Kid Cudi, John Legend, Common, D'banj and Malik Yusef, as well as affiliates Jay-Z, 2 Chainz, Travis Scott, and Cyhi the Prynce, among others. The album also features guest vocals from Justin Vernon, Chief Keef, Kid Cudi, Assassin, King L, Charlie Wilson, and Frank Ocean.

"New Slaves" is a song by American hip hop recording artist Kanye West, from his sixth studio album Yeezus (2013). It was produced primarily by West, with additional production by Ben Bronfman, Mike Dean, Travis Scott, Noah Goldstein, Sham Joseph, and Che Pope. The song's lyrics discuss slavery and segregation, as well as racism in general, materialism, and stereotypes of African Americans in the United States. It features vocals from American recording artist Frank Ocean, whom West previously collaborated with on Watch the Throne (2011). The song's coda features a sample of "Gyöngyhajú lány" by Hungarian composer Gábor Presser, who later sued West in 2016 over its use.

"Bound 2" is a song by American rapper Kanye West, featured as the final track from his sixth studio album, Yeezus (2013). It was produced by West and Che Pope, with additional production being handled by Eric Danchick, Noah Goldstein, No ID and Mike Dean. The song features vocals from American soul singer Charlie Wilson and serves as the album's second single. "Bound 2" incorporates samples from "Bound" by Ponderosa Twins Plus One and the lines "Uh-huh, honey" and "Alright" from Brenda Lee's "Sweet Nothin's". The song also interpolates Wee's "Aeroplane (Reprise)" for the bridge, sung by Charlie Wilson.

"No Mistakes" is a song by American rapper Kanye West from his eighth studio album, Ye (2018). The song features vocals from Kid Cudi, Charlie Wilson and Caroline Shaw. "FML" is a song by American rapper Kanye West from his seventh studio album The Life of Pablo (2016), which features vocals from Canadian singer The Weeknd. It contains a sample of "Hit" by Section 25, which two of the band members praised West for sampling. In the song, West references his issues with mental health. The song charted in the United States, United Kingdom and Canada in 2016.

"Ultralight Beam" is a song by American recording artist Kanye West from his seventh studio album The Life of Pablo (2016). The song features vocals by R&B singers The-Dream and Kelly Price, rapper Chance the Rapper, gospel singer Kirk Franklin and a ten-piece choir, with additional vocals by Natalie Green and Samoria Green. It was first performed live on Saturday Night Live in February 2016.
