Population Control Bill, 2019

The Population Control Bill, 2019 (or, Population Regulation Bill, 2019) is a proposed bill introduced in the Rajya Sabha in July 2019 by Rakesh Sinha. The purpose of the bill is to control the population growth of India. According to the World Population Prospects 2019 report by the United Nations, the population of India is set to overtake that of China within a decade. The proposed bill was signed by 125 Members of Parliament (MP) and is yet to become an act of law. [1] [2]

Summary

On 7 February 2020, the Constitution (Amendment) Bill, 2020 was introduced in the Rajya Sabha by Anil Desai, a Shiv Sena MP. Desai proposed to amend the Article 47A of the Constitution of India to state [3] -

The State shall promote small family norms by offering incentives in taxes, employment, education etc. to its people who keep their family limited to two children and shall withdraw every concession from and deprive such incentives to those not adhering to small family norm, to keep the growing population under control.

The 2020 bill proposes to introduce a two-child policy per couple and aims to incentivize its adoption through various measures such as educational benefits, taxation cuts, home loans, free healthcare, and better employment opportunities. The 2019 bill proposed by Sinha talks about introducing penalties for couples not adhering to the two-child policy such as debarment from contesting in elections and ineligibility for government jobs. In July 2022, it was reported that BJP Mp Ravi Kishan was going to introduce private members' bill on Population control. [4] [5] [6] In the same mouth Giriraj Singh supported calls for Population control laws. [7] [8]

Reception

The bill has been criticised by some commentators as rooted in islamophobic sentiment. [9] [10] Columnist Shivanshu K. Srivastava wrote "It is urgently required that our lawmakers pass the Population Control Bill under which an upper limit to the number of children a couple can have is specified. Couples exceeding this limit must be penalised." [11]

Sanjay Singh is an Indian politician who has served as a member of the Rajya Sabha from Delhi since 2018. Singh has been a senior leader of the party since its inception in November 2012 and is a member of the party's foremost decision-making body, the Political Affairs Committee (PAC). Supreme Court of India, in its judgement dated 10 July 2013 while disposing the Lily Thomas v. Union of India case, ruled that any Member of Parliament (MP), Member of the Legislative Assembly (MLA) or Member of a Legislative Council (MLC) who is convicted of a crime and given a minimum of two years' imprisonment, loses membership of the House with immediate effect. This is in contrast to the earlier position, wherein convicted members held on to their seats until they exhausted all judicial remedy in lower, state and supreme court of India. Further, Section 8(4) of the Representation of the People Act, which allowed elected representatives three months to appeal their conviction, was declared unconstitutional by the bench of Justice A. K. Patnaik and Justice S. J. Mukhopadhaya.

Anil Desai is an Indian politician belonging to the Shiv Sena. He is a member of the Rajya Sabha, the Upper house of Indian Parliament from Maharashtra. Anil Desai is considered to be excellent at managing elections, legal matters and back room activities. He has played a major role in managing the party’s resources and floated ideas like coining slogan, UTha Maharashtra. He is known as the party’s sober face.

The Repealing and Amending Act, 2019 is an Act of the Parliament of India that repealed 58 Acts. It also made minor amendments to the Income Tax Act, 1961 and The Indian Institutes of Management Act, 2017. The Act was the sixth such repealing act aimed at repealing obsolete laws tabled by the Narendra Modi administration, and the first tabled during its second term. The government had repealed 1,428 Acts during its first term between 2014 and 2019.
