Holding
The ordinance was content-neutral because it regulated conduct alone, did not target nudity that contained an erotic message, and petitioner's interest in preventing harmful secondary effects associated with adult entertainment establishments was not related to the suppression of the exotic message conveyed by nude dancing. The O'Brien test for evaluating restrictions on symbolic speech therefore applied, and was successfully met. Reversed.

Erie v. Pap's A. M., 529 U.S. 277 (2000), was a landmark decision by the Supreme Court of the United States regarding nude dancing as free speech. The court held that an ordinance banning public nudity did not violate the operator of a totally nude entertainment establishment's constitutional right to free speech. [1]

Prior history

On September 28, 1994, the city council of Erie, Pennsylvania, enacted Ordinance 75–1994, a public indecency ordinance that makes it a summary offense to knowingly or intentionally appear in public in a "state of nudity." [1] [2] The respondent, Pap's, a Pennsylvania corporation, operated an establishment in Erie known as "Kandyland" that featured totally nude erotic dancing performed by women. To comply with the ordinance, these dancers would need to wear, at a minimum, pasties and a G-string. [1] [2] On October 14, 1994, two days after the ordinance went into effect, Pap's filed a complaint against the city of Erie, the mayor (Joyce Savacchio), city solicitor (Gregory A. Karle), and members of the city council, seeking declaratory relief and a permanent injunction against the enforcement of the ordinance. [1]

The Court of Common Pleas struck down the ordinance as unconstitutional, but the Commonwealth Court reversed the decision. The Pennsylvania Supreme Court in turn reversed the Commonwealth Court, finding that the ordinance's public nudity section was an unconstitutional violation of Pap's First Amendment rights. Certiorari was granted on appeal from the State Supreme Court.

Case

Mootness

The Court proceeded to the merits despite a possible mootness issue. While the case was pending, Pap's A.M. went out of business, meaning that no concrete private rights were left to litigate. Despite going out of business, the Supreme Court still proceeded to decide the case on the merits because 1) the City of Erie was suffering an "ongoing injury" and 2) Pap's was still incorporated and could potentially go back into business.

After determining that the ordinance was content neutral, the Court then applied the O'Brien test. The first factor of the O'Brien test for evaluating restrictions on symbolic speech is whether the government regulation is within the constitutional power of the government to enact. [1] The second factor of the O'Brien test for evaluating restrictions on symbolic speech is whether the regulation furthers an important or substantial government interest. [1] The third O'Brien factor is that the government interest must be unrelated to the suppression of free expression. [1] The fourth and final O'Brien factor is that the restriction be no greater than is essential to the furtherance of the government interest. [1]

The court found that the ordinance met all four factors of the O'Brien test, and that a "least restrictive means" analysis was not necessary. [1] The Court reversed the decision of the Pennsylvania Supreme Court, and found the ordinance to be constitutional.

Aftermath

The effects of this case reach beyond simple restriction of nudity. The majority opinion noted:

The government generally has a freer hand in restricting expressive conduct than it has in restricting the written or spoken word. [1]

Concurrence

Justice Scalia, joined by Justice Thomas, agreed that the Pennsylvania Supreme Court's decision must be reversed, but disagreed with the mode of analysis that should be applied. [1]

In the United States, freedom of speech and expression is strongly protected from government restrictions by the First Amendment to the U.S. Constitution, many state constitutions, and state and federal laws. Freedom of speech, also called free speech, means the free and public expression of opinions without censorship, interference and restraint by the government. The term "freedom of speech" embedded in the First Amendment encompasses the decision what to say as well as what not to say. The Supreme Court of the United States has recognized several categories of speech that are given lesser or no protection by the First Amendment and has recognized that governments may enact reasonable time, place, or manner restrictions on speech. The First Amendment's constitutional right of free speech, which is applicable to state and local governments under the incorporation doctrine, prevents only government restrictions on speech, not restrictions imposed by private individuals or businesses unless they are acting on behalf of the government. However, It can be restricted by time, place and manner in limited circumstances. Some laws may restrict the ability of private businesses and individuals from restricting the speech of others, such as employment laws that restrict employers' ability to prevent employees from disclosing their salary to coworkers or attempting to organize a labor union.

United States v. O'Brien, 391 U.S. 367 (1968), was a landmark decision of the United States Supreme Court, ruling that a criminal prohibition against burning a draft card did not violate the First Amendment's guarantee of free speech. Though the court recognized that O'Brien's conduct was expressive as a protest against the Vietnam War, it considered the law justified by a significant government interest unrelated to the suppression of speech and was tailored towards that end.

Forsyth County, Georgia v. The Nationalist Movement, 505 U.S. 123 (1992), was a case in which the United States Supreme Court limited the ability of local governments to charge fees for the use of public places for private activities. By a 5–4 vote, the court ruled that an ordinance allowing the local government to set varying fees for different events violated the First Amendment due to the lack of "narrowly drawn, reasonable, and definite standards" governing the amount of the fee.

United States v. Playboy Entertainment Group, 529 U.S. 803 (2000), is a United States Supreme Court case in which the Court struck down Section 505 of the Telecommunications Act of 1996, which required that cable television operators completely scramble or block channels that are "primarily dedicated to sexually-oriented programming" or limit their transmission to the hours of 10 pm to 6 am.

Virginia v. Black, 538 U.S. 343 (2003), was a landmark decision of the Supreme Court of the United States in which the Court held, 5–4, that any state statute banning cross burning on the basis that it constitutes prima facie evidence of intent to intimidate is a violation of the First Amendment to the Constitution. Such a provision, the Court argued, blurs the distinction between proscribable "threats of intimidation" and the Ku Klux Klan's protected "messages of shared ideology". In the case, three defendants were convicted in two separate cases of violating a Virginia statute against cross burning. Intermediate scrutiny, in U.S. constitutional law, is the second level of deciding issues using judicial review. The other levels are typically referred to as rational basis review and strict scrutiny.

Erznoznik v. City of Jacksonville, 422 U.S. 205 (1975), is a United States Supreme Court case concerning a city ordinance prohibiting the showing of films containing nudity by a drive-in theater located in Jacksonville, Florida.

Barnes v. Glen Theatre, Inc., 501 U.S. 560 (1991), was a landmark decision of the U.S. Supreme Court concerning the First Amendment and the ability of the government to outlaw certain forms of expressive conduct. It ruled that the state has the constitutional authority to ban public nudity, even as part of expressive conduct such as dancing, because it furthers a substantial government interest in protecting the morality and order of society. This case is perhaps best summarized by a sentence in Justice Souter's concurring opinion, which is often paraphrased as "Nudity itself is not inherently expressive conduct."

Cox v. New Hampshire, 312 U.S. 569 (1941), was a case in which the Supreme Court of the United States held that, although the government cannot regulate the contents of speech, it can place reasonable time, place, and manner restrictions on speech for the public safety. Here, the Court held that government may require organizers of any parade or procession on public streets to have a license and pay a fee.

The legal status of striptease varies considerably among different countries and the various jurisdictions of the United States. Striptease is considered a form of public nudity and subject to changing legal and cultural attitudes on moral and decency grounds. Some countries do not have any restrictions on performances of striptease. In some countries, public nudity is outlawed directly, while in other countries it may be suppressed or regulated indirectly through devices such as restrictions on venues through planning laws, or licensing regulations, or liquor licensing and other restrictions.

Sorrell v. IMS Health Inc., 564 U.S. 552 (2011), is a United States Supreme Court case in which the Court held that a Vermont statute that restricted the sale, disclosure, and use of records that revealed the prescribing practices of individual doctors violated the First Amendment.

For over a century, the city of San Francisco, California, allowed unrestricted public nudity. In 2012, the city changed the law to require a parade permit for certain displays of public nudity.

Clark v. Community for Creative Non-Violence, 468 U.S. 288 (1984), is a United States Supreme Court case with the National Park Service's regulation which specifically prohibited sleeping in Lafayette Park and the National Mall at issue. The Community for Creative Non-Violence (CCNV) group had planned to hold a demonstration on the National Mall and Lafayette Park where they would erect tent cities to raise awareness of the situation of the homeless. The group obtained the correct permits for a seven-day demonstration starting on the first day of winter. The Park Service however denied the request that participants be able to sleep in the tents. The CCNV challenged this regulation on the basis that it violated their First Amendment right.

Nevada Commission on Ethics v. Carrigan, 564 U.S. 117 (2011), was a Supreme Court of the United States decision in which the Court held that the Nevada Ethics in Government Law, which required government officials recuse in cases involving a conflict of interest, is not unconstitutionally overbroad. Specifically, the law requires government officials to recuse themselves from advocating for and voting on the passage of legislation if private commitments to the interests of others materially affect the official's judgment. Under the terms of this law, the Nevada Commission on Ethics censured city councilman Michael Carrigan for voting on a land project for which his campaign manager was a paid consultant. Carrigan challenged his censure in court and the Nevada Supreme Court ruled in his favor, claiming that casting his vote was protected speech. The Supreme Court reversed, ruling that voting by a public official on a public matter is not First Amendment speech.

United States obscenity law deals with the regulation or suppression of what is considered obscenity and therefore not protected speech under the First Amendment to the United States Constitution. In the United States, discussion of obscenity typically relates to defining what pornography is obscene, as well as to issues of freedom of speech and of the press, otherwise protected by the First Amendment to the Constitution of the United States. Issues of obscenity arise at federal and state levels. State laws operate only within the jurisdiction of each state, and there are differences among such laws. Federal statutes ban obscenity and child pornography produced with real children. Federal law also bans broadcasting of "indecent" material during specified hours.

Reed v. Town of Gilbert, 576 U.S. 155 (2015), is a case in which the United States Supreme Court clarified when municipalities may impose content-based restrictions on signage. The case also clarified the level of constitutional scrutiny that should be applied to content-based restrictions on speech. In 2005, Gilbert, Arizona adopted a municipal sign ordinance that regulated the manner in which signs could be displayed in public areas. The ordinance imposed stricter limitations on signs advertising religious services than signs that displayed "political" or "ideological" messages. When the town's Sign Code compliance manager cited a local church for violating the ordinance, the church filed a lawsuit in which they argued the town's sign regulations violated its First Amendment right to the freedom of speech.

<i>Anderson v. City of Hermosa Beach</i>

Anderson v. City of Hermosa Beach, 621 F. 3d 1051 (2010), was a decision by the U.S. Court of Appeals for the Ninth Circuit, which ruled that tattoos, the process of tattooing, and the business of tattooing are pure expressive activities that are fully protected by the First Amendment's free speech clause. The court determined that the process of tattooing constitutes pure expressive activity rather than conduct that is sufficiently imbued with elements of communication. As pure expressive activity, the process of tattooing can only be regulated by a proper time, place, and manner restriction. The court found in Anderson v. The City of Hermosa Beach that the Hermosa Beach Municipal Code banning tattoo parlors within the city was not a reasonable time, place, and manner restriction because the regulation was not narrowly tailored to meet the government's interest and the regulation did not leave open ample alternative avenues for the same messages to be conveyed.

City of Dallas v. Stanglin, 490 U.S. 19 (1989), was a United States Supreme Court decision considering the First Amendment associational rights of teenagers at a dance hall. The Court upheld an ordinance imposing age limits on teen dance halls, ruling that gathering for recreational dancing is not an "expressive association" under the First Amendment.
