Ashok Bhushan (born 5 July 1956) is a former judge of the Supreme Court of India and the chairperson of the National Company Law Appellate Tribunal. He was the 31st chief justice of the Kerala High Court. He is a former judge of the Kerala High Court and Allahabad High Court. [1] [2]
Ashok Bhushan was born in Jaunpur district,Uttar Pradesh on 5 July 1956 to the late Shri Chandrama Prasad Srivastava and his wife Smt. Kalavathi Srivasthava. After receiving a Bachelor of Arts in 1975 he studied law in Allahabad University and graduated in 1979. [1]
Bhushan started his career in advocacy by enrolling with Bar Council of Uttar Pradesh on 6 April 1979 and started practising in civil and original side at Allahabad High Court until the elevation to the bench. [1] [3] While practising as an advocate in Allahabad High Court,he served as the standing counsel for various institutions such as Allahabad University,State Mineral Development Corporation Limited and several municipal boards,banks and education institutions and also as the senior vice–president of the Allahabad High Court Bar Association. He was elevated as permanent judge of the Allahabad High Court on 24 April 2001 he served as chairman of the Higher Judicial Service committee and headed several other committees. [1] [3]
He was appointed as a judge of the High Court of Kerala on 10 July 2014,has taken charge as Acting Chief Justice on 1 August 2014 [4] and as chief justice on 26 March 2015. [1] [2] [3]
He was appointed as a judge of the Supreme Court of India on 13 May 2016. [5]
On the farewell speech organised by the Supreme Court Bar Association,Ashok said “Grant of appropriate remedy is not the discretion of the judge but his obligation. Justice must be tempered with mercy but justice cannot be substituted for mercy.”He retired on 4 July 2021.[ citation needed ]
On 8 November 2021,he took the oath as the chairperson of National Company Law Appellate Tribunal. [6]
M. Fathima Beevi was an Indian judge who was a justice of the Supreme Court of India. Appointed to the apex Court in 1989,she became the first female judge to be a part of the Supreme Court of India,and the first Muslim woman to be appointed to any of the higher judiciaries in the country. On her retirement from the court,she served as a member of the National Human Rights Commission and later as the Governor of the Indian state of Tamil Nadu from 1997 to 2001. In 2023,she was honoured with Kerala Prabha Award,the second-highest honour given by the Government of Kerala. In the 2024 honours list,she was posthumously awarded the Padma Bhushan.
The high courts of India are the highest courts of appellate jurisdiction in each state and union territory of India. However,a high court exercises its original civil and criminal jurisdiction only if the subordinate courts are not authorized by law to try such matters for lack of peculiar or territorial jurisdiction. High courts may also enjoy original jurisdiction in certain matters,if so designated,especially by the constitution,a state law or union law.
The High Court of Kerala is the highest court in the Indian state of Kerala and the Union territory of Lakshadweep. It is located in Kochi. Drawing its powers under Article 226 of the Constitution of India,the High Court has the power to issue directions,orders and writs including the writs of habeas corpus,mandamus,prohibition,quo warranto and certiorari for ensuring the enforcement of the Fundamental Rights guaranteed by the Constitution to citizens or for other specified purposes. The High Court is empowered with original,appellate and revisional jurisdiction in civil as well as criminal matters,and the power to answer references to it under some statutes. The High Court has the superintendence and visitorial jurisdiction over all courts and tribunals of inferior jurisdiction covered under its territorial jurisdiction.
Konakuppakatil Gopinathan Balakrishnan is an Indian judge who served as Chief Justice of the Supreme Court of India and later the chairperson of the National Human Rights Commission of India. He was the first judge from Kerala to become the Chief Justice of the Supreme Court. His tenure lasting more than three years has been one of the longest in the Supreme Court of India. While being Chief Justice of Gujarat High Court,he was appointed as the acting governor of Gujarat from 16 January 1999 to 18 March 1999. In 2010,he was conferred with an honorary doctorate by Cochin University of Science and Technology.
