Comcare is a statutory authority of the Australian Federal Government established under the Safety, Rehabilitation and Compensation Act 1988 [4] (SRC Act) and covered by the Public Governance, Performance and Accountability Act 2013 [5] (PGPA Act). Comcare administers the Commonwealth's workers' compensation scheme under the SRC [4] Act; and the Work Health and Safety Act 2011 [6] (WHS Act).
The department is headquartered in Canberra, and has offices in Melbourne, Sydney, Brisbane, Adelaide, Perth, Newcastle, Darwin and Launceston.
Comcare also provides secretariat, policy and legislative support to Seacare - the Seafarers' Safety, Rehabilitation and Compensation Authority - in administering the Seafarers Rehabilitation and Compensation Act 1992, the Occupational Health and Safety (Maritime Industry) Act 1993, the Seafarers Rehabilitation and Compensation Levy Act 1992, and the Seafarers Rehabilitation and Compensation Levy Collection Act 1992.
Comcare provides advice to the Minister for Industrial Relations on issues relating to the administration of the Commonwealth's work health and safety and workers' compensation frameworks.

Workers' compensation or workers' comp is a form of insurance providing wage replacement and medical benefits to employees injured in the course of employment in exchange for mandatory relinquishment of the employee's right to sue his or her employer for the tort of negligence. The trade-off between assured, limited coverage and lack of recourse outside the worker compensation system is known as "the compensation bargain". One of the problems that the compensation bargain solved is the problem of employers becoming insolvent as a result of high damage awards. The system of collective liability was created to prevent that, and thus to ensure security of compensation to the workers.

In general, compliance means conforming to a rule, such as a specification, policy, standard or law. Compliance has traditionally been explained by reference to the deterrence theory, according to which punishing a behavior will decrease the violations both by the wrongdoer and by others. However, psychological research on motivation provides an alternative view: granting rewards or imposing fines for a certain behavior is a form of extrinsic motivation that weakens intrinsic motivation and ultimately undermines compliance.

Comcare v Banerji is a decision of the High Court of Australia. It was an appeal brought by Comcare against former public servant Michaela Banerji, seeking to overturn a decision of the Administrative Appeals Tribunal. The tribunal had declared that termination of her employment was not a reasonable administrative action; once regard was had to the implied freedom of political communication.
