Compendium of U.S. Copyright Office Practices

The Compendium of U.S. Copyright Office Practices is a manual produced by the United States Copyright Office, intended for use primarily by the Copyright Office staff as a general guide to policies and procedures such as registration, deposit and recordation. [1] It does not cover every principle of copyright law or detail every aspect of the Office's administrative practices.

The Compendium is directed to policy under the 1976 Copyright Act, as amended. It is now in its third edition, replacing the earlier "Compendium II", which in turn replaced the original Compendium that described policy under the earlier 1909 Copyright Act.

The Compendium is an internal manual, and does not have the force of law, unlike the U.S. Copyright Act or Copyright Office regulations. [2] However, some courts have cited to it as persuasive authority and given it deference based on the Copyright Office's specialized experience and broader investigations and information. [2] For some issues that are not addressed in the statute or regulations (for example, whether to issue a registration to a government body claiming a copyright in its enacted laws), it can provide guidance as to the Copyright Office's practice.

The Compendium is sometimes, but not often, used by attorneys in dealings with the Copyright Office. A Westlaw search of the FIP-CS database which contains documents from the U.S. Supreme Court, Courts of Appeals, District Courts, Bankruptcy Courts, Court of Federal Claims, U.S. Tax Court, Military Courts, and related federal and territorial courts showed fewer than fifty citations of the Compendium by the courts total. [3] This is in contrast to, for example, the Manual of Patent Examining Procedure, which is heavily relied upon by attorneys and agents dealing with the patent functions of the United States Patent and Trademark Office.

A public draft of the third edition of the Compendium was released by the Copyright Office on August 19, 2014. [4] The official version, entitled Compendium of U.S. Copyright Office Practices, Third Edition, was released on December 22, 2014. [5] Proposed revisions to the Compendium were published on June 1, 2017; [6] After a comment period, a revised version of the Compendium was published on September 29. [7] It includes changes taking the Star Athletica, LLC v. Varsity Brands, Inc. , 580 U.S. __ (2017), decision into account. [8]

As of April 2022, the January 28, 2021 release is the most current.

A patent attorney is an attorney who has the specialized qualifications necessary for representing clients in obtaining patents and acting in all matters and procedures relating to patent law and practice, such as filing patent applications and oppositions to granted patents.

The Intellectual Property Office of the United Kingdom is, since 2 April 2007, the operating name of The Patent Office. It is the official government body responsible for intellectual property rights in the UK and is an executive agency of the Department for Science, Innovation and Technology (DSIT).

China has acceded to the major international conventions on protection of rights to intellectual property. The Manual of Patent Examining Procedure (MPEP) is published by the United States Patent and Trademark Office (USPTO) for use by patent attorneys and agents and patent examiners. It describes all of the laws and regulations that must be followed in the examination of U.S. patent applications, and articulates their application to an enormous variety of different situations. The MPEP is based on Title 37 of the Code of Federal Regulations, which derives its authority from Title 35 of the United States Code, as well as on case law arising under those titles. The first version of the MPEP was published in 1920 by the Patent and Trademark Office Society.

The copyright symbol, or copyright sign, ©, is the symbol used in copyright notices for works other than sound recordings. The use of the symbol is described by the Universal Copyright Convention. The symbol is widely recognized but, under the Berne Convention, is no longer required in most nations to assert a new copyright.

In order to be registered as a patent agent or patent attorney in the United States, one must pass the United States Patent and Trademark Office (USPTO) registration examination, officially called the Examination for Registration to Practice in Patent Cases Before the United States Patent and Trademark Office and known informally as the patent bar.

Title 35 of the United States Code is a title of United States Code regarding patent law. The sections of Title 35 govern all aspects of patent law in the United States. There are currently 37 chapters, which include 376 sections, in Title 35.

The copyright status of the content of patent applications and patents may vary from one legal system to another. Whether scientific literature can be freely copied for the purpose of patent prosecution is also a matter for discussion.

The Trademark Manual of Examining Procedure (TMEP) is a manual published by the United States Patent and Trademark Office (USPTO) for use by trademark attorneys and trademark examiners. It describes all of the laws and regulations that must be followed in order to apply for and maintain a trademark in the United States. It includes explanations of the trademark application and examination process, the various types of trademarks, the Madrid Protocol, and proceedings before the Trademark Trial and Appeal Board.

The history of United States patent law started even before the U.S. Constitution was adopted, with some state-specific patent laws. The history spans over more than three centuries.

Typefaces, fonts, and their glyphs raise intellectual property considerations in copyright, trademark, design patent, and related laws. The copyright status of a typeface and of any font file that describes it digitally varies between jurisdictions. In the United States, the shapes of typefaces are not eligible for copyright but may be protected by design patent. Typefaces can be protected in other countries, including the United Kingdom, Germany, and France, by industrial design protections that are similar to copyright or design patent in that they protect the abstract shapes. Additionally, in the US and some other countries, computer fonts, the digital instantiation of the shapes as vector outlines, may be protected by copyright on the computer code that produces them. The name of a typeface may also be protected as a trademark.

Edict of government is a technical term associated with the United States Copyright Office's guidelines and practices that comprehensively includes laws, which advises that such submissions will neither be accepted nor processed for copyright registration. It is based on the principle of public policy that citizens must have unrestrained access to the laws that govern them. Similar provisions occur in most, but not all, systems of copyright law; the main exceptions are in those copyright laws which have developed from English law, under which the copyright in laws rests with the Crown or the government.

The copyright status of works produced by the governments of states, territories, and municipalities in the United States varies. Copyright law is federal in the United States. Federal law expressly denies U.S. copyright protection to two types of government works: works of the U.S. federal government itself, and all edicts of any government regardless of level or whether or not foreign. Other than addressing these "edicts of government", U.S. federal law does not address copyrights of U.S. state and local government.

Star Athletica, LLC v. Varsity Brands, Inc., 580 U.S. ___ (2017), was a U.S. Supreme Court case in which the court decided under what circumstances aesthetic elements of "useful articles" can be restricted by copyright law. The Court created a two-prong "separability" test, granting copyrightability based on separate identification and independent existence; the aesthetic elements must be identifiable as art if mentally separated from the article's practical use, and must qualify as copyrightable pictorial, graphic, or sculptural works if expressed in any medium.
