Elizabeth Dorothy Baartman (born 3 December 1960) is a South African judge of the Western Cape Division of the High Court of South Africa. Before President Jacob Zuma appointed her to the bench in August 2009,she was an advocate and prosecutor for the National Prosecuting Authority. She also served a decade as a magistrate in Cape Town.
Born on 3 December 1960, [1] Baartman grew up in Hangberg in Cape Town. [2] Her father was a fisherman, [3] and she was classified as Coloured under apartheid. [4] After attending grade school in Hout Bay, [3] she matriculated in 1979 at Grassy Park High School on the Cape Flats. [1] Thereafter she studied law at the University of the Western Cape,completing a BJuris in 1986 and an LLB in 1992. [1]
Baartman worked full-time throughout her LLB studies:she was a prosecutor from February 1986 to February 1991,working primarily in the district courts of Athlone and Wynberg, [2] and then she took up a position as a magistrate. [1] She continued her work as a magistrate after her graduation,handling family law and civil matters. [2] In addition,she was admitted as an advocate of the High Court of South Africa on 3 September 1993. [1]
She left the magistracy at the end of July 2001. [1] Thereafter,from December 2001 to June 2003,she was the director of the Peoples Family Law Centre,a non-profit organisation which provided family law services. [1] In July 2003,she returned to the National Prosecuting Authority (NPA) as a senior state advocate in the Asset Forfeiture Unit. [1] She also deputised Willie Hofmeyr as the unit's deputy director,initially in an acting capacity from 2005 and then in a permanent capacity from 2008. [2]
However,in June 2007,Baartman entered the Office of the Chief Justice's Aspirant Women Judges training programme. [1] However,the leadership of the NPA was concerned that it would create a conflict of interest for her to hold acting positions in the judiciary while employed as a prosecutor,an argument that she came to agree with. [2] [4] She therefore resigned from the NPA with effect from 30 September 2008. [1] Thereafter she was an acting judge in the High Court's Western Cape Division from October 2008 until she was appointed to the bench permanently in August 2009. [1]
In July 2009,while serving as an acting judge,Baartman was one of five candidates whom the Judicial Service Commission shortlisted and interviewed for possible permanent appointment to one of two judicial vacancies in the Western Cape High Court. [5] The Judicial Service Commission recommended her for appointment,and President Jacob Zuma confirmed her and Ashley Binns-Ward to the vacancies the following month. In 2021,Baartman presided in Busisiwe Mkhwebane's challenge against the constitutionality of the parliamentary section 194 inquiry instituted to impeach her. [7] [8]
Baartman was an acting judge in the Supreme Court of Appeal from June 2015 to May 2016 and later from December 2023 to March 2024. [1] She was twice shortlisted and interviewed for possible permanent appointment to the Supreme Court,once in April 2016 and again (this time with the support of former Constitutional Court justice Kate O'Regan) in April 2018. [4] On the first occasion,Supreme Court President Lex Mpati told her during her interview that the other judges of appeal believed that she "needed more honing with more acting stints" before she was ready to serve in the appellate court permanently;likewise,her lack of experience in complex constitutional adjudication was a matter of concern in the 2018 interview. [4] The Judicial Service Commission did not recommend her for appointment on either occasion.
Baaitse Elizabeth "Bess" Nkabinde-Mmono is a South African retired judge who served in the Constitutional Court of South Africa from January 2006 to December 2017. During that time,she was acting Deputy Chief Justice of South Africa from 23 May 2016 to 7 June 2017. She joined the bench in November 1999 as a judge of the Bophuthatswana Provincial Division.
Christopher Nyaole Jafta is a retired South African judge who served in the Constitutional Court of South Africa from October 2009 to October 2021. Formerly an academic and practising advocate in the Transkei,he joined the bench in November 1999 as a judge of the Transkei Division. Thereafter he served in the Supreme Court of Appeal from November 2004 to October 2009.

Busisiwe Mkhwebane is a South African advocate and prosecutor served as the 4th Public Protector of South Africa from October 2016 until her impeachment in September 2023. Following her impeachment,she served as a Member of the National Assembly of South Africa from October 2023 to October 2024,representing the EFF. She is the first head of a Chapter 9 institution to be removed through impeachment.
Mandisa Muriel Lindelwa Maya is the Chief Justice of South Africa. She was formerly the President of the Supreme Court of Appeal from 2017 to 2022 before she was elevated to the position of Deputy Chief Justice of South Africa in September 2022. She joined the bench in May 2000 as a judge of the Transkei Division of the High Court of South Africa and was elevated to the Supreme Court of Appeal in 2006.
Rammaka Steven Mathopo is a judge of the Constitutional Court of South Africa. Before his elevation to that court in January 2022,he served in the Supreme Court of Appeal between June 2015 and December 2021. He was formerly a judge of the Gauteng High Court from January 2006 to May 2015,and he practised as an attorney for 17 years before then.

Baratang Constance Mocumie is a South African judge of the Supreme Court of Appeal. Before joining the Supreme Court,she was a judge of the Free State High Court from March 2008 until June 2016. She is also a judge in the Military Court of Appeal and the primary South African liaison judge to the Hague Conference on Private International Law,and she was the president of the South African chapter of the International Association of Women Judges between 2010 and 2014. She began her legal career as a prosecutor and magistrate in the North West and Gauteng provinces.
Fikile Eunice Mokgohloa is a South African judge of the Supreme Court of Appeal. Before her elevation to that court in June 2019,she was a judge of the High Court of South Africa between November 2008 and May 2019. She joined the bench as a judge of the KwaZulu-Natal Division and moved to the Limpopo Division in January 2016,becoming Deputy Judge President in Limpopo in July 2016. Born in Pretoria,she began her career as an attorney in the former Transvaal.
Aubrey Phago Ledwaba is South African judge who is currently serving as the Deputy Judge President of the Gauteng Division of the High Court of South Africa. Formerly a practising attorney in Gauteng,he joined the bench as a puisne judge in November 2005 and was elevated to his leadership position in July 2013. He was an acting judge in the Constitutional Court in 2019 and an acting judge in the Supreme Court of Appeal between 2020 and 2021.
Raylene May Keightley is a South African judge of the Supreme Court of Appeal. She was appointed to the bench in the Gauteng High Court in January 2016 after a career as a legal academic and practising lawyer. She was admitted as an attorney in 1986 and as an advocate in 2006.
Petrus Arnolus Koen is South African judge who is currently serving in the KwaZulu-Natal Division of the High Court of South Africa. Before joining the bench in November 2006,he was Senior Counsel in Pietermaritzburg. He is best known for presiding in the corruption trial of former president Jacob Zuma from May 2021 until he recused himself in January 2023.
Anna Maleshane Kgoele,also spelled Annah Malefsane Kgoele,is a South African judge of the Supreme Court of Appeal. She joined the appellate court in December 2023 after 14 years in the High Court of South Africa. From 2014 to 2018,she was the president of the South African chapter of the International Association of Women Judges.
Cagney John Musi is a South African judge who is currently serving as Judge President of the Free State High Court. He was appointed to the court as a puisne judge in June 2005 and was elevated to the judge presidency in December 2018 after two years' service as Deputy Judge President. Before joining the bench,he was a public prosecutor from 1986 to 1992 and a magistrate from 1992 to 2004.
Mokgere Busisiwe Shareen Masipa is a South African judge of the High Court of South Africa. She was appointed to the KwaZulu-Natal Division in July 2016 after 14 years as a practising attorney in Durban. She is an expert on labour law.
Malesela Francis Legodi is a South African retired judge of the High Court of South Africa. He was the first Judge President of the Mpumalanga Division of the High Court from August 2017 to August 2023. He joined the bench in October 2004 as a puisne judge of the Gauteng Division. Before that,he was a practising attorney in Mpumalanga.
Mandela Makaula is a South African judge who is currently serving in the Eastern Cape Division of the High Court of South Africa. He joined the bench in 2010 after two decades in practice as an attorney and magistrate in the Eastern Cape. He was an acting judge in the Supreme Court of Appeal in 2022.
