The Supreme Court of Appeal (SCA), formerly known as the Appellate Division, is the second-highest court of appeal in South Africa below the Constitutional Court. The country's apex court from 1910 to 1994, it no longer holds that position, having been displaced in constitutional matters by the Constitutional Court in 1994, and in all matters by 2013. It is located in Bloemfontein. Bloemfontein is often, and has been traditionally referred to, as the "judicial capital" of South Africa because of the court, although the Constitutional Court is based in Johannesburg. [1] [2]

History

On the creation of the Union of South Africa from four British colonies in 1910, the supreme courts of the colonies became provincial divisions of the new Supreme Court of South Africa, and the Appellate Division was created as a purely appellate court superior to the provincial divisions. It was the seat of some of the country's most outstanding judges including Innes CJ, Watermeyer CJ, Galgut JA, Wessels CJ and Schreiner JA.

In 1994 the Constitutional Court of South Africa was created with jurisdiction superior to the Appellate Division, but it could hear only in constitutional matters. The Appellate Division, therefore, remained the highest court in non-constitutional matters. In 1997 the Appellate Division became the Supreme Court of Appeal and was given constitutional jurisdiction, though the system of two apex courts remained: the Constitutional Court was the country's highest court in constitutional matters, but the SCA was the highest court in non-constitutional matters. However, the Constitutional Court took a broad reading of its jurisdiction, and in August 2013 the position was regularised by an amendment to the South African Constitution which gave the Constitutional Court general jurisdiction.

Current judges

The court is composed of a President, a Deputy President, and the number of ordinary Judges of Appeal determined in terms of an Act of Parliament; at present there are 23 ordinary positions on the court. [3] Cases before the court are generally heard by panels of five judges.

Judges are appointed by the President of South Africa on the advice of the Judicial Service Commission. Judges of Appeal are cited in judgments with the surname of the judge followed by "JA". (The President and Deputy President are cited with a "P" and "DP" respectively, and acting judges are cited with "AJA".)

Johan Coenraad Froneman is a South African retired judge who was a justice of the Constitutional Court of South Africa from October 2009 to May 2020. He joined the judiciary as a judge of the Eastern Cape Division in 1994 and was elevated to the apex court by President Jacob Zuma. He was also the inaugural Deputy Judge President of the Labour Court of South Africa between 1996 and 1999.

Lex Mpati is a South African retired judge who was the President of the Supreme Court of Appeal of South Africa from August 2008 to May 2016. He was appointed to the bench in February 1997 as a judge of the Eastern Cape Division and he joined the Supreme Court as a puisne judge in December 2000. Before his elevation to the presidency, he was the Supreme Court's first Deputy President from 2003 to 2008. He was also an acting judge in the Constitutional Court in 2007.

The Gauteng Division of the High Court of South Africa is a superior court of law which has general jurisdiction over the South African province of Gauteng and the eastern part of North West province. The main seat of the division is at Pretoria, while a local seat at Johannesburg has concurrent jurisdiction over the southern parts of Gauteng. Dunstan Mlambo has been the Judge President of the division since 1 November 2012.

Mandisa Muriel Lindelwa Maya is the Chief Justice of South Africa. She was formerly the President of the Supreme Court of Appeal from 2017 to 2022 before she was elevated to the position of Deputy Chief Justice of South Africa in September 2022. She joined the bench in May 2000 as a judge of the Transkei Division of the High Court of South Africa and was elevated to the Supreme Court of Appeal in 2006.

Xola Mlungisi Petse is a retired South African judge who was the Deputy President of the Supreme Court of Appeal between 2019 and 2024. A former attorney, he joined the Supreme Court as a puisne judge in June 2012. Before that, he was a judge of the Eastern Cape High Court from July 2005 to May 2012.

Rammaka Steven Mathopo is a judge of the Constitutional Court of South Africa. Before his elevation to that court in January 2022, he served in the Supreme Court of Appeal between June 2015 and December 2021. He was formerly a judge of the Gauteng High Court from January 2006 to May 2015, and he practised as an attorney for 17 years before then.

Nambitha Dambuza is a South African judge of the Supreme Court of Appeal. A former attorney, she sat in the Eastern Cape High Court from 2005 until her appointment to the Supreme Court in June 2015.

Mahube Betty Molemela is a South African judge who has been the President of the Supreme Court of Appeal since 1 June 2023. Before her appointment to the Supreme Court in June 2018, she was the first woman Judge President of the Free State High Court from 2015 to 2018. A former attorney, she was appointed to the bench in the Free State in July 2008.

Keoagile Elias Matojane is a South African judge of the Supreme Court of Appeal. Formerly an attorney, he was a judge of the Gauteng High Court from December 2009 until December 2022, when he was appointed to the Supreme Court of Appeal.

Baratang Constance Mocumie is a South African judge of the Supreme Court of Appeal. Before joining the Supreme Court, she was a judge of the Free State High Court from March 2008 until June 2016. She is also a judge in the Military Court of Appeal and the primary South African liaison judge to the Hague Conference on Private International Law, and she was the president of the South African chapter of the International Association of Women Judges between 2010 and 2014. She began her legal career as a prosecutor and magistrate in the North West and Gauteng provinces.

Nolwazi Penelope Mabindla-Boqwana is a South African judge of the Supreme Court of Appeal. Before she joined the Supreme Court in July 2021, she was a judge in the Western Cape High Court between 2013 and 2021. She has additionally served on the Competition Appeal Court since January 2017. Before entering the judiciary, she practiced as an attorney in Johannesburg with a specialty in labour law.

Fayeeza Kathree-Setiloane is a South African judge of the Supreme Court of Appeal. She joined the appellate court in December 2023 after 13 years in the Gauteng High Court. Before her appointment to the bench in October 2010, she practiced as an advocate of the High Court in Johannesburg; she was involved in constitutional litigation, including through the Legal Resources Centre, and also served a stint in corporate advisory at Werksmans.

David Unterhalter is a South African jurist and judge of the Supreme Court of Appeal of South Africa. He is also professor of law at the University of Cape Town. Before he was appointed to the bench of the Gauteng High Court in January 2018, Unterhalter was a prominent advocate, specialising in public law, competition law, and trade law. He was called to the Johannesburg Bar in 1990 and took silk in 2002.

Anna Maleshane Kgoele, also spelled Annah Malefsane Kgoele, is a South African judge of the Supreme Court of Appeal. She joined the appellate court in December 2023 after 14 years in the High Court of South Africa. From 2014 to 2018, she was the president of the South African chapter of the International Association of Women Judges.

Mokgere Busisiwe Shareen Masipa is a South African judge of the High Court of South Africa. She was appointed to the KwaZulu-Natal Division in July 2016 after 14 years as a practising attorney in Durban. She is an expert on labour law.

The Competition Appeal Court is a specialist South African court that hears appeals from the Competition Tribunal. The court was established by the Competition Act 89, 1998 and has national jurisdiction in matters of South African competition law. Judges of the Competition Appeal Court are judges of the High Court of South Africa and are appointed by the President of South Africa on the advice of the Judicial Service Commission.

Matsaro Violet Semenya is a South African judge who has been Deputy Judge President of the Limpopo High Court since July 2021. She was appointed that court as a puisne judge in January 2017. Before joining the judiciary, she was a magistrate in Limpopo between 1991 and 2017.
