Tati Moffat Makgoka (born 13 February 1968) is a South African judge of the Supreme Court of Appeal. Formerly an attorney in Pretoria,he served in the Gauteng High Court from August 2009 until June 2018,when he was elevated to the Supreme Court of Appeal. He was an acting judge in the Constitutional Court in 2023.
Makgoka was born on 13 February 1968 in Moletši outside Polokwane in the former Northern Transvaal (now Limpopo Province). [1] [2] He matriculated at Hwiti High School and went on to the University of the North,where he completed a BProc in 1992. [1] 30 years later,in 2021 and while serving as a judge,he also completed an LLB at the University of South Africa. [1]
After graduating from the University of the North,Makgoka served his articles of clerkship at a firm in Pretoria. Thereafter,between 1994 and 2009,he practised as an attorney in Pretoria. [1] He acted as a judge in the High Court of South Africa in 2007,sitting in the Transvaal Provincial Division. [1]
On 26 August 2009,Makgoka joined the High Court permanently when he was appointed as a judge of the Gauteng High Court. [3] Notable judgements handed down by Makgoka included a judgement confirming that Harmony Gold and other mining companies were obligated to rehabilitate environmental damage produced by corporate pollution. [3] His order in that matter was upheld by the Supreme Court of Appeal in Harmony Gold v Free State Department of Water Affairs. [4] In October 2013,Makgoka ordered Legal Aid to provide legal representation at the Farlam Commission to mineworkers who had been injured or arrested during the Marikana massacre. [5]
During his nearly nine years in the High Court,Makgoka was seconded to appellate courts three times. He was an acting judge in the Labour Appeal Court from June to November 2015 and in the Supreme Court of Appeal on two occasions,from June to November 2016 and then from October 2017 to May 2018. [1] During that period,he wrote the Supreme Court of Appeal's judgement in a vicarious liability matter. [6] He also acted in the Constitutional Division of the Lesotho High Court in April 2015. [1]
In April 2018,Makgoka was one of nine candidates whom the Judicial Service Commission shortlisted and interviewed for possible permanent appointment to one of three vacancies in the Supreme Court of Appeal. During his interview,he was asked about his impression of the level of collegiality in the Supreme Court of Appeal,and he expressed his support for gender-based affirmative action in the judiciary. [7] [8] The Judicial Service Commission recommended him for appointment,alongside Mahube Molemela and Ashton Schippers, [9] and the trio joined the bench on 1 June 2018. [1]
In November 2022,Makgoka wrote the court's unanimous judgement in the controversial matter of the parole of former President Jacob Zuma,who had been imprisoned for contempt of court. Makgoka's judgement said that Arthur Fraser,the National Commissioner for Correctional Services,had acted unlawfully and irrationally in granting Zuma medical parole;the court ordered that Zuma should return to prison to serve out his sentence. Between February and May 2023,Makgoka was an acting judge in the Constitutional Court of South Africa. [1] He wrote the court's judgement in N.O. v Minister of Police,which overturned a Supreme Court of Appeal ruling on the application of the "once-and-for-all" rule for claiming damages. [12]
Makgoka was highly involved in judicial education and training,including through the Legal Education Centre of the Black Lawyers Association,and he serves on the editorial committee of the South African Institute of Judicial Education Journal. [1] He has been the chancellor of the Anglican Diocese of Pretoria since 2012 and a member of the advisory board of Judges to the World Intellectual Property Organisation since 2020. [1] Since 2019,he has been a member of the Judicial Conduct Committee of the Judicial Service Commission,in which capacity he served on the three-member tribunal that found Western Cape Judge President John Hlophe guilty of gross misconduct for attempting to improperly influence the views of Justices Chris Jafta and Bess Nkabinde. Mandlakayise John Hlophe is a South African jurist. He was the Judge President of the Western Cape Division of the High Court of South Africa from May 2000 until March 2024,when he was impeached. He was the first South African judge to be impeached under the post-apartheid Constitution.
Baaitse Elizabeth "Bess" Nkabinde-Mmono is a South African retired judge who served in the Constitutional Court of South Africa from January 2006 to December 2017. During that time,she was acting Deputy Chief Justice of South Africa from 23 May 2016 to 7 June 2017. She joined the bench in November 1999 as a judge of the Bophuthatswana Provincial Division.
Christopher Nyaole Jafta is a retired South African judge who served in the Constitutional Court of South Africa from October 2009 to October 2021. Formerly an academic and practising advocate in the Transkei,he joined the bench in November 1999 as a judge of the Transkei Division. Thereafter he served in the Supreme Court of Appeal from November 2004 to October 2009.
Xola Mlungisi Petse is a South African judge who has been the Deputy President of the Supreme Court of Appeal since 2019. A former attorney,he joined the Supreme Court as a puisne judge in June 2012. Before that,he was a judge of the Eastern Cape High Court from July 2005 to May 2012.
Rammaka Steven Mathopo is a judge of the Constitutional Court of South Africa. Before his elevation to that court in January 2022,he served in the Supreme Court of Appeal between June 2015 and December 2021. He was formerly a judge of the Gauteng High Court from January 2006 to May 2015,and he practised as an attorney for 17 years before then.
Owen Lloyd Rogers is a South African judge of the Constitutional Court of South Africa. Before his appointment to that court in August 2022,he served in the Western Cape Division of the High Court for nine years,having joined the bench in February 2013. Formerly an advocate and senior counsel at the Cape Bar,he was also a judge of the Competition Appeal Court between 2016 and 2022.
Nambitha Dambuza is a South African judge of the Supreme Court of Appeal. A former attorney,she sat in the Eastern Cape High Court from 2005 until her appointment to the Supreme Court in June 2015.
Keoagile Elias Matojane is a South African judge of the Supreme Court of Appeal. Formerly an attorney,he was a judge of the Gauteng High Court from December 2009 until December 2022,when he was appointed to the Supreme Court of Appeal.
Visvanathan Ponnan is a South African judge of the Supreme Court of Appeal. He joined the Gauteng High Court in 2001 and was elevated to the Supreme Court of Appeal in December 2004. Before that,he practised as an advocate in Durban between 1985 and 2001.
Dumisani Hamilton Zondi is a South African judge of the Supreme Court of Appeal. He was appointed as the chairperson of the Electoral Court in December 2022. Before his elevation to the Supreme Court in June 2014,he served in the Western Cape High Court between 2007 and 2014,as well as in the Competition Appeal Court between 2011 and 2014. He entered legal practice as an attorney in 1986.
Ashton Schippers is a South African judge of the Supreme Court of Appeal. Before his elevation to that court in June 2018,he served in the Western Cape High Court from February 2013 to May 2018. He was formerly an advocate in Cape Town,where he took silk in 2004 and where he was chairperson of the bar council between 2004 and 2006.
Aubrey Phago Ledwaba is South African judge who is currently serving as the Deputy Judge President of the Gauteng Division of the High Court of South Africa. Formerly a practising attorney in Gauteng,he joined the bench as a puisne judge in November 2005 and was elevated to his leadership position in July 2013. He was an acting judge in the Constitutional Court in 2019 and an acting judge in the Supreme Court of Appeal between 2020 and 2021.
Petrus Arnolus Koen is South African judge who is currently serving in the KwaZulu-Natal Division of the High Court of South Africa. Before joining the bench in November 2006,he was Senior Counsel in Pietermaritzburg. He is best known for presiding in the corruption trial of former President Jacob Zuma from May 2021 until he recused himself in January 2023.
Anna Maleshane Kgoele,also spelled Annah Malefsane Kgoele,is a South African judge of the Supreme Court of Appeal. She joined the appellate court in December 2023 after 14 years in the High Court of South Africa. From 2014 to 2018,she was the president of the South African chapter of the International Association of Women Judges.
Cagney John Musi is a South African judge who is currently serving as Judge President of the Free State High Court. He was appointed to the court as a puisne judge in June 2005 and was elevated to the judge presidency in December 2018 after two years' service as Deputy Judge President. Before joining the bench,he was a public prosecutor from 1986 to 1992 and a magistrate from 1992 to 2004.
Gayaat Salie-Hlophe,formerly known as Gayaat Salie-Samuels,is a South African judge of the High Court of South Africa. She was appointed to the Western Cape Division in January 2015 after nearly 17 years as a practising attorney in Cape Town. She was an acting judge in the Supreme Court of Appeal in 2022.
Bantubonke Regent Tokota is a South African judge of the High Court of South Africa. He was appointed to the Eastern Cape Division in October 2017 after 20 years as a practising advocate in Pretoria. He was Senior Counsel from 2006 onwards and also served on the Marikana Commission of Inquiry between 2012 and 2014.
Legoabe Willie Seriti is a South African retired judge who served in the Supreme Court of Appeal between 2010 and 2019. Before his elevation to that court,he was a judge of the Gauteng High Court from 2003 to 2010. He is best known for his role in the Seriti Commission of Inquiry into the Arms Deal,which he chaired between 2011 and 2015. He was formerly an attorney in his hometown of Pretoria.
Selby Mfanelo Mbenenge is the Judge President of the Eastern Cape Division of the High Court of South Africa. He joined the bench as a puisne judge in July 2015 and was elevated to the judge presidency in November 2017. He was formerly an advocate and silk in East London and Mthatha.
On 21 February 2024,the National Assembly of South Africa voted to impeach Judge John Hlophe,a judge of the High Court of South Africa and the judge president of the Western Cape Division. Hlophe was accused of improper interference in the deliberations of the Constitutional Court in litigation involving the interests of Jacob Zuma. His impeachment was the result of a finding by the Judicial Service Commission that his conduct in this regard amounted to gross misconduct. Hlophe was the first judge to be impeached under the post-apartheid Constitution.
