Baratang Constance Mocumie (born 10 August 1965) is a South African judge of the Supreme Court of Appeal. Before joining the Supreme Court,she was a judge of the Free State High Court from March 2008 until June 2016. She is also a judge in the Military Court of Appeal and the primary South African liaison judge to the Hague Conference on Private International Law,and she was the president of the South African chapter of the International Association of Women Judges between 2010 and 2014. She began her legal career as a prosecutor and magistrate in the North West and Gauteng provinces.
Mocumie was born on 10 August 1965 in Warrenton in the Northern Cape. [1] Both of her parents were teachers,although her mother had begun her career as a domestic worker. [2] After attending high school in Warrenton,Mocumie matriculated from St. Paul's High School in Taung and attended the University of Zululand,where she completed a BJuris in 1988. [3] As a student in 1986,she was charged under the Riotous Assemblies Act for her participation in anti-apartheid protest during that year's state of emergency. [2]
Later,Mocumie received an LLB from the University of the North West in 2000 and an LLM,specialising in family law, [2] from the University of South Africa in 2005. [3]
Mocumie began her career in the Odi Magistrate's Court of Ga-Rankuwa,where she worked as a legal assistant between 1988 and 1990. [1] After that,for the decade between 1991 and 2001,she served as a public prosecutor,stationed at the Molopo Magistrate's Court until 1995 and thereafter at the Klerksdorp Magistrate's Court. [3] From 2001 to 2005,she was a magistrate,including,for a stint between 2002 and 2003,as acting regional magistrate for Pretoria;she also lectured magistrates at the Justice College. [3] At the same time,in 2003,she was admitted as an advocate of the High Court of South Africa. [3]
In 2005,Mocumie enrolled in the Aspirant Women Judges Programme,which was designed to elevate women to the bench of the High Court. [1] After completing the programme,she was invited to serve several stints,between 2005 and 2008,as an acting judge in the High Court's Northern Cape Division,North West Division,and Free State Division. [3]
In November 2007,President Thabo Mbeki announced that he would appoint Mocumie permanently to the Free State High Court; [4] she joined the bench in March 2008. [3] One of her influential judgements in the court was handed down in De Necker v MEC for the Free State Department of Health,where she articulated an interpretation of the Compensation for Occupational Injuries and Diseases Act which was later upheld by the Supreme Court of Appeal. [1] She also served lengthy stints as an acting judge in several appellate courts:in the Labour Appeal Court from April to September 2011,in the Supreme Court of Appeal from December 2013 to November 2014,and in the Competition Appeal Court from April 2015 to March 2016. [3] At the same time,she was the president of the South African chapter of the International Association of Women Judges between 2010 and 2014. [3] [5]
In April 2014,Mocumie was shortlisted and interviewed for appointment as Judge President of the Free State High Court,although none of her judgements had yet been reported. [6] However,the Judicial Service Commission was unable to reach agreement on a recommendation,and the vacancy was re-advertised. [7] [8] Mocumie interviewed for the position again in October 2014, [9] but,on that occasion,the Judicial Service Commission resolved to recommend Mocumie's colleague,Mahube Molemela,for the position. [10]
Nonetheless,despite Molemela's appointment,Mocumie served as acting Judge President of the Free State High Court between April and May 2015. In the same year,she was appointed as a judge in the Military Court of the South African National Defence Force,a position she held for the next four years,and was also appointed as South Africa's primary liaison judge at the Hague Conference on Private International Law. In April 2016,Mocumie was shortlisted and interviewed for one of two vacancies on the permanent bench of the Supreme Court of Appeal. The Judicial Service Commission recommended her for appointment, [11] [12] which was confirmed by President Jacob Zuma in June 2016 with effect from 1 July. [13] While in the Supreme Court,she continued to serve as a judge of the Military Court until 2019,when she was promoted to become a judge of the Military Court of Appeal. [3]
In July 2022,Mocumie was one of two candidates shortlisted for the position of chairperson of the Electoral Court,the other being Dumisani Zondi,her colleague on the Supreme Court of Appeal. [14] [15] During her interview with the Judicial Service Commission,she discussed her ongoing role as liaison to the Hague Conference,urging Justice Minister Ronald Lamola –a member of the commission –to convey the urgency of participation to his department. [16] The Judicial Service Commission recommended Zondi for the Electoral Court position. [17] [18]

Zukisa Laura Lumka Tshiqi is a South African judge of the Constitutional Court of South Africa. She formerly served in the Supreme Court of Appeal from December 2009 until October 2019,when President Cyril Ramaphosa elevated her to the Constitutional Court. She was a practising attorney until she was first appointed to the bench in the Gauteng High Court in 2005.
Nonkosi Zoliswa Mhlantla is a South African judge of the Constitutional Court. Elevated to that court in December 2015,she was formerly a judge of the Supreme Court of Appeal between December 2008 and November 2015. She entered legal practice as an attorney in her hometown,Port Elizabeth,and joined the bench in June 2002,becoming the first woman ever to be appointed to the Eastern Cape Division of the High Court of South Africa.
Leona Valerie Theron is a judge of the Constitutional Court of South Africa. Before her elevation in July 2017,she served in the Supreme Court of Appeal between December 2010 and June 2017. She is the first Coloured judge to serve in the Constitutional Court.
Mandisa Muriel Lindelwa Maya is the Chief Justice of South Africa. She was formerly the President of the Supreme Court of Appeal from 2017 to 2022 before she was elevated to the position of Deputy Chief Justice of South Africa in September 2022. She joined the bench in May 2000 as a judge of the Transkei Division of the High Court of South Africa and was elevated to the Supreme Court of Appeal in 2006.
Xola Mlungisi Petse is a retired South African judge who was the Deputy President of the Supreme Court of Appeal between 2019 and 2024. A former attorney,he joined the Supreme Court as a puisne judge in June 2012. Before that,he was a judge of the Eastern Cape High Court from July 2005 to May 2012.
Rammaka Steven Mathopo is a judge of the Constitutional Court of South Africa. Before his elevation to that court in January 2022,he served in the Supreme Court of Appeal between June 2015 and December 2021. He was formerly a judge of the Gauteng High Court from January 2006 to May 2015,and he practised as an attorney for 17 years before then.
Nambitha Dambuza is a South African judge of the Supreme Court of Appeal. A former attorney,she sat in the Eastern Cape High Court from 2005 until her appointment to the Supreme Court in June 2015.
Mahube Betty Molemela is a South African judge who has been the President of the Supreme Court of Appeal since 1 June 2023. Before her appointment to the Supreme Court in June 2018,she was the first woman Judge President of the Free State High Court from 2015 to 2018. A former attorney,she was appointed to the bench in the Free State in July 2008.
Wendy Hughes,formerly known as Wendy Hughes-Madondo,is a South African judge of the Supreme Court of Appeal. Formerly an attorney in private practice,she was a judge of the Gauteng High Court from July 2013 until July 2021,when she was appointed to the Supreme Court of Appeal.
Nolwazi Penelope Mabindla-Boqwana is a South African judge of the Supreme Court of Appeal. Before she joined the Supreme Court in July 2021,she was a judge in the Western Cape High Court between 2013 and 2021. She has additionally served on the Competition Appeal Court since January 2017. Before entering the judiciary,she practiced as an attorney in Johannesburg with a specialty in labour law.
Dumisani Hamilton Zondi is a South African judge who is the Deputy President of the Supreme Court of Appeal. He was appointed as the chairperson of the Electoral Court in December 2022. Before his elevation to the Supreme Court in June 2014,he served in the Western Cape High Court between 2007 and 2014,as well as in the Competition Appeal Court between 2011 and 2014. He entered legal practice as an attorney in 1986.
Fikile Eunice Mokgohloa is a South African judge of the Supreme Court of Appeal. Before her elevation to that court in June 2019,she was a judge of the High Court of South Africa between November 2008 and May 2019. She joined the bench as a judge of the KwaZulu-Natal Division and moved to the Limpopo Division in January 2016,becoming Deputy Judge President in Limpopo in July 2016. Born in Pretoria,she began her career as an attorney in the former Transvaal.
Tati Moffat Makgoka is a South African judge of the Supreme Court of Appeal. Formerly an attorney in Pretoria,he served in the Gauteng High Court from August 2009 until June 2018,when he was elevated to the Supreme Court of Appeal. He was an acting judge in the Constitutional Court in 2023.
Boissie Henry Mbha is a retired South African judge who served in the Supreme Court of Appeal from June 2014 to August 2022. He was also the chairperson of the Electoral Court from 2018 to 2022,and he acted in the Constitutional Court for a term in 2016. A former attorney,he was appointed to the bench in October 2004 as a judge of the High Court's Gauteng Division.
Anna Maleshane Kgoele,also spelled Annah Malefsane Kgoele,is a South African judge of the Supreme Court of Appeal. She joined the appellate court in December 2023 after 14 years in the High Court of South Africa. From 2014 to 2018,she was the president of the South African chapter of the International Association of Women Judges.
Segopotje Sheila Mphahlele is a South African judge who is currently serving as the Judge President of the Mpumalanga High Court. Formerly an attorney and insolvency practitioner,she has been a judge of the High Court of South Africa since December 2013.
Cagney John Musi is a South African judge who is currently serving as Judge President of the Free State High Court. He was appointed to the court as a puisne judge in June 2005 and was elevated to the judge presidency in December 2018 after two years' service as Deputy Judge President. Before joining the bench,he was a public prosecutor from 1986 to 1992 and a magistrate from 1992 to 2004.
Kevin Gerard Beecroft Swain is a South African retired judge who served in the Supreme Court of Appeal from 2014 to 2020. He was formerly a judge of the KwaZulu-Natal High Court from 2003 to 2014. Before joining the bench in November 2003,he was an advocate and Senior Counsel in Pietermaritzburg.
Elizabeth Dorothy Baartman is a South African judge of the Western Cape Division of the High Court of South Africa. Before President Jacob Zuma appointed her to the bench in August 2009,she was an advocate and prosecutor for the National Prosecuting Authority. She also served a decade as a magistrate in Cape Town.
Nobulawo Martha Mbhele is a South African judge who is currently serving as Deputy Judge President of the Free State High Court. She was appointed to the court as a puisne judge in January 2016 and was elevated to the deputy judge presidency in July 2021. Before she joined the bench,she was an attorney in the Free State,both in private practice and for a decade at Legal Aid South Africa.
