John Eldrid Smith (born 5 November 1958) is a South African judge of the Eastern Cape Division of the High Court of South Africa. He joined the bench in July 2010. Before that,he was the chief executive officer of Smith Tabata Inc.,which he co-founded in 1984. Smith is a judge of the Supreme Court of Appeal.
Smith was born on 5 November 1958 in Herschel,a small town near Sterkspruit in what was then the Cape Province (now the Eastern Cape). [1] He grew up in nearby Queenstown, [2] matriculating in 1976 at Maria Louw High School. [1] He is Coloured. [2]
After high school,he completed a BA in law at the University of the Western Cape in 1979 and an LLB at Rhodes University in 1981. [1] Later,while a practising lawyer,he completed a diploma in advanced labour law at the University of Cape Town in 1989. [1]
Between 1982 and 1984,Smith completed his articles of clerkship under T. M. Mdlalana,an attorney based in the Eastern Cape. He was admitted as an attorney in 1984. [1] Later the same year,he co-founded the firm of Smith,Tabata and Van Heerden,which was later reincorporated as Smith Tabata Inc. [2] While working there as a partner,he was active in progressive professional organisations:among other things,he joined the National Association of Democratic Lawyers in 1983 and ultimately joined its senior leadership,serving as its national vice-president from 1989 to 1990 and as its general secretary from 1990 to 1992. [1] During the same period,he was a trustee of the Legal Resources Centre. [1]
After the end of apartheid,Smith served briefly as a member of the Eastern Cape Provincial Legislature from 1994 to 1995. [2] Thereafter he remained in partnership at his firm for the rest of his career in practice;he was the firm's chief executive officer between 2007 and 2010. [1] At the same time,between 1998 and 2010,he served several stints as an acting judge in the Grahamstown High Court and Bhisho High Court. [1] Finally,he chaired the Ministerial Committee of Inquiry into Transformation in Cricket,which was appointed by Minister of Sport Ngconde Balfour in 2001. [1]
In April 2010 in Cape Town,Smith was interviewed by the Judicial Service Commission as a candidate for possible permanent appointment to the bench of the High Court of South Africa. [3] The JSC recommended his appointment,which President Jacob Zuma confirmed the following month. [4] He took office on 26 July 2010 in the Eastern Cape Division,and he was based at the division's seat in Grahamstown. [2] Over the next 14 years,only four of his judgments were overturned on appeal, [2] and he wrote 14 reported judgments. [5] According to Judges Matter,he distinguished himself in property law matters. [2]
In 2017,he was one of four candidates shortlisted for promotion to become the division's Judge President,but,after he and three other candidates were interviewed in Midrand in April,the Judicial Service Commission declined to make an appointment; [6] [7] the position ultimately went to Selby Mbenenge.
While serving in the High Court,Smith spent three terms as an acting judge in the Supreme Court of Appeal,first from October 2021 to March 2022 and then from April 2024 to September 2024. [1] He wrote for majority judgments for the appellate court. [2] During that period,he was thrice interviewed as a candidate for possible elevation to permanent vacancies in the Supreme Court. Both in his October 2022 interview and in his October 2023 interview,Judge of Appeal Xola Petse pressed him on deficiencies in his writing. [2] [8] On neither occasion did the Judicial Service Commission recommend Smith for appointment. The commission's October 2023 deliberations were later made public in court filings,and it transpired that Smith had been one of the top five candidates (among ten in total) but had failed to receive the support of a majority of the panel. [9] The third time he was shortlisted,as one of ten candidates for three vacancies in May 2024, [5] his interview was successful;the Judicial Service Commission said that it would recommend Smith,along with Judges David Unterhalter and Raylene Keightley,as suitable for elevation to the Supreme Court. He is married to Naomi Josephine Smith and has two children. [1]
Johan Coenraad Froneman is a South African retired judge who was a justice of the Constitutional Court of South Africa from October 2009 to May 2020. He joined the judiciary as a judge of the Eastern Cape Division in 1994 and was elevated to the apex court by President Jacob Zuma. He was also the inaugural Deputy Judge President of the Labour Court of South Africa between 1996 and 1999.
Lex Mpati is a South African retired judge who was the President of the Supreme Court of Appeal of South Africa from August 2008 to May 2016. He was appointed to the bench in February 1997 as a judge of the Eastern Cape Division and he joined the Supreme Court as a puisne judge in December 2000. Before his elevation to the presidency,he was the Supreme Court's first Deputy President from 2003 to 2008. He was also an acting judge in the Constitutional Court in 2007.

Rammaka Steven Mathopo is a judge of the Constitutional Court of South Africa. He was formerly a judge of the Gauteng High Court from January 2006 to May 2015,and he practised as an attorney for 17 years before then.

Christiaan Hendrik Gert van der Merwe is a South African judge of the Supreme Court of Appeal. Before his elevation to that court,he served in the Free State High Court from August 2003 to June 2016. He began his career as a public prosecutor and practised in the Free State as an advocate between 1981 and 2003,gaining silk status in 1994.
Dumisani Hamilton Zondi is a South African judge who is the Deputy President of the Supreme Court of Appeal. He was appointed as the chairperson of the Electoral Court in December 2022. Before his elevation to the Supreme Court in June 2014,he served in the Western Cape High Court between 2007 and 2014,as well as in the Competition Appeal Court between 2011 and 2014. He entered legal practice as an attorney in 1986.
David Unterhalter is a South African jurist and judge of the Supreme Court of Appeal of South Africa. He is also professor of law at the University of Cape Town. Before he was appointed to the bench of the Gauteng High Court in January 2018,Unterhalter was a prominent advocate,specialising in public law,competition law,and trade law. He was called to the Johannesburg Bar in 1990 and took silk in 2002.
Petrus Arnolus Koen is a South African judge who is currently serving in the KwaZulu-Natal Division of the High Court of South Africa. Before joining the bench in November 2006,he was Senior Counsel in Pietermaritzburg. He is best known for presiding in the corruption trial of former president Jacob Zuma from May 2021 until he recused himself in January 2023.
Anna Maleshane Kgoele,also spelled Annah Malefsane Kgoele,is a South African judge of the Supreme Court of Appeal. She joined the appellate court in December 2023 after 14 years in the High Court of South Africa. Selby Mfanelo Mbenenge is the Judge President of the Eastern Cape Division of the High Court of South Africa. He joined the bench as a puisne judge in July 2015 and was elevated to the judge presidency in November 2017. He was formerly an advocate and silk in East London and Mthatha.
Mandela Makaula is a South African judge who is currently serving in the Eastern Cape Division of the High Court of South Africa. He joined the bench in 2010 after two decades in practice as an attorney and magistrate in the Eastern Cape. He was an acting judge in the Supreme Court of Appeal in 2022.
