David Unterhalter (born 18 November 1958) is a South African jurist and judge of the Gauteng Division of the High Court of South Africa. He is also professor of law at the University of Cape Town. Before he was appointed to the bench in January 2018,Unterhalter was a prominent advocate,specialising in public law,competition law,and trade law. He was called to the Johannesburg Bar in 1990 and took silk in 2002.
Unterhalter was born on 18 November 1958 in Johannesburg. [1] His father was Jack Unterhalter,a lawyer who attained public prominence representing political prisoners during apartheid. [2] [3] Unterhalter attended Trinity College,Cambridge,where he completed a BA in 1980,converted to an MA in 1987. He went on to an LLB at the University of the Witwatersrand in 1984 and a BCL at University College,Oxford in 1985. [1]
Unterhalter was admitted as an advocate of the Supreme Court of South Africa in 1990. He practised as an advocate at the Johannesburg Bar for the next 27 years,taking silk in 2002. [1] He argued several high-profile cases in the Supreme Court of Appeal and Constitutional Court,including Democratic Alliance v President ,on Menzi Simelane's appointment to the National Prosecuting Authority; [4] Eisenberg v Minister of Home Affairs, on the constitutionality of immigration regulations; S v Jordan ,on the criminalisation of prostitution; [5] Glenister v President ,on the disbanding of the Scorpions; [6] Islamic Unity Convention v Minister of Telecommunications,a hate speech case; [7] and My Vote Counts v Speaker ,on political party funding. [8] He also represented Deputy President Cyril Ramaphosa during Ian Farlam's commission of inquiry into the Marikana massacre. [9] In 2010,when the senate of the University of Johannesburg considered a motion to sever its ties to Ben Gurion University as part of an academic boycott of Israel,Unterhalter appeared pro bono for Ben Gurion University. [10]
While remaining a member of the Johannesburg Bar,Unterhalter was called to the English Bar in 2009 and joined Monckton Chambers at Gray's Inn. [1] He was a member of the Appellate Body of the World Trade Organization between 2007 and 2013,serving as its chairperson from 2010 to 2011;and,on several occasions from 2003 onwards,he served as an acting judge in the Gauteng Division of the High Court of South Africa. [1]
In October 2017,the Judicial Service Commission interviewed Unterhalter and recommended him as suitable for permanent appointment to the Gauteng High Court. [11] [12] The following month,President Jacob Zuma confirmed his appointment,which took effect on 1 January 2018. [2] [13] Later that year,he was seconded as an acting judge to the Competition Appeal Court,where he served between June 2018 and December 2021. [7] In addition,he has served several stints as an acting judge in higher courts:in the Constitutional Court for two terms in 2022,and in the Supreme Court of Appeal on eight occasions between June 2020 and November 2023. [1]
On several occasions,Unterhalter was shortlisted for appointment to higher courts. He interviewed unsuccessfully for vacancies at the Constitutional Court in April 2021, [14] October 2021, [15] [16] and April 2022; [17] [18] and he interviewed unsuccessfully for a vacancy at the Supreme Court of Appeal in October 2023. [19] [20] In the 2021 rounds,members of the Judicial Service Commission argued with Unterhalter over his association with the South African Jewish Board of Deputies,a conservative and generally pro-Zionist organisation;he had been appointed to the board's executive committee in 2020. [21] In the 2022 and 2023 rounds,his interviews were diverted by rigorous debate with commissioners over his failure to recuse himself from the Constitutional Court quorum in Ken Lindeque v Eskom Holdings v Mogale City Local Municipality,a matter which he had heard earlier while acting in the Supreme Court of Appeal. [22] [23] [24] In addition,he was questioned on several occasions about the strength of his record in leading black female junior counsel while at the bar. [2] The Judicial Service Commission's repeated omission to recommend Unterhalter for elevation was often controversial and was criticised by Freedom Under Law,by the Council for the Advancement of the South African Constitution,by the Jewish Board of Deputies,and by various commentators. Between 2007 and 2013,Unterhalter was a professor of law at the University of the Witwatersrand,where he formerly led the Centre for Applied Legal Studies. [1] Since 2014,he has been a professor of law at the University of Cape Town. He has published in public law,trade law,and competition law. [1]
Unterhalter is Jewish, [2] and he was a member of the Democratic Party between 1989 and 1994. [7] He was a member of the Helen Suzman Foundation before he joined the bench. [7]
Narandran "Jody" Kollapen is a South African judge who joined the Constitutional Court of South Africa on 1 January 2022. He was appointed to the apex court by President Cyril Ramaphosa after a decade of service in the High Court of South Africa. He is also a former chairperson of the South African Human Rights Commission.
Christopher Nyaole Jafta is a retired South African judge who served in the Constitutional Court of South Africa from October 2009 to October 2021. Formerly an academic and practising advocate in the Transkei,he joined the bench in November 1999 as a judge of the Transkei Division. Thereafter he served in the Supreme Court of Appeal from November 2004 to October 2009.
Zukisa Laura Lumka Tshiqi is a South African judge of the Constitutional Court of South Africa. She formerly served in the Supreme Court of Appeal from December 2009 until October 2019,when President Cyril Ramaphosa elevated her to the Constitutional Court. She was a practising attorney until she was first appointed to the bench in the Gauteng High Court in 2005.
Mandisa Muriel Lindelwa Maya is the Deputy Chief Justice of South Africa. She was formerly the President of the Supreme Court of Appeal from 2017 to 2022. She joined the bench in May 2000 as a judge of the Transkei Division of the High Court of South Africa and was elevated to the Supreme Court of Appeal in 2006.
Tembeka Nicolas Ngcukaitobi is a South African lawyer and legal scholar. An advocate of the Johannesburg Bar since August 2010,he gained silk status in February 2020. He is currently a member of the Judicial Service Commission and a part-time member of the Competition Commission's Competition Tribunal.
Xola Mlungisi Petse is a South African judge who has been the Deputy President of the Supreme Court of Appeal since 2019. A former attorney,he joined the Supreme Court as a puisne judge in June 2012. Before that,he was a judge of the Eastern Cape High Court from July 2005 to May 2012.
Rammaka Steven Mathopo is a judge of the Constitutional Court of South Africa. Before his elevation to that court in January 2022,he served in the Supreme Court of Appeal between June 2015 and December 2021. He was formerly a judge of the Gauteng High Court from January 2006 to May 2015,and he practised as an attorney for 17 years before then.
Owen Lloyd Rogers is a South African judge of the Constitutional Court of South Africa. Before his appointment to that court in August 2022,he served in the Western Cape Division of the High Court for nine years,having joined the bench in February 2013. Formerly an advocate and senior counsel at the Cape Bar,he was also a judge of the Competition Appeal Court between 2016 and 2022.
Mahube Betty Molemela is a South African judge who has been the President of the Supreme Court of Appeal since 1 June 2023. Before her appointment to the Supreme Court in June 2018,she was the first woman Judge President of the Free State High Court from 2015 to 2018. A former attorney,she was appointed to the bench in the Free State in July 2008.
Caroline Elizabeth Heaton Nicholls is a South African judge of the Supreme Court of Appeal. Formerly a human rights lawyer,she was a judge of the Johannesburg High Court from September 2009 until June 2019,when she was appointed to the Supreme Court of Appeal.
Keoagile Elias Matojane is a South African judge of the Supreme Court of Appeal. Formerly an attorney,he was a judge of the Gauteng High Court from December 2009 until December 2022,when he was appointed to the Supreme Court of Appeal.
Nolwazi Penelope Mabindla-Boqwana is a South African judge of the Supreme Court of Appeal. Before she joined the Supreme Court in July 2021,she was a judge in the Western Cape High Court between 2013 and 2021. She has additionally served on the Competition Appeal Court since January 2017. Before entering the judiciary,she practiced as an attorney in Johannesburg with a specialty in labour law.
Fayeeza Kathree-Setiloane is a South African judge of the Supreme Court of Appeal. She joined the appellate court in December 2023 after 13 years in the Gauteng High Court. Before her appointment to the bench in October 2010,she practiced as an advocate of the High Court in Johannesburg;she was involved in constitutional litigation,including through the Legal Resources Centre,and also served a stint in corporate advisory at Werksmans.
Dumisani Hamilton Zondi is a South African judge of the Supreme Court of Appeal. He was appointed as the chairperson of the Electoral Court in 2022. Before his elevation to the Supreme Court in June 2014,he served in the Western Cape High Court between 2007 and 2014,as well as in the Competition Appeal Court between 2011 and 2014. He entered legal practice as an attorney in 1986.
Tati Moffat Makgoka is a South African judge of the Supreme Court of Appeal. Formerly an attorney in Pretoria,he served in the Gauteng High Court from August 2009 until June 2018,when he was elevated to the Supreme Court of Appeal. He was an acting judge in the Constitutional Court in 2023.
Boissie Henry Mbha is a retired South African judge who served in the Supreme Court of Appeal from June 2014 to August 2022. He was also the chairperson of the Electoral Court from 2018 to 2022,and he acted in the Constitutional Court for a term in 2016. A former attorney,he was appointed to the bench in October 2004 as a judge of the High Court's Gauteng Division.
Alan Christopher Dodson SC is a South African lawyer who was a judge of the Land Claims Court from 1995 to 2000. He was also the chairperson of the United Nations's Housing and Property Claims Commission in Kosovo from 2000 to 2007. A member of the Johannesburg Bar since 2001 and Senior Counsel since 2011,he formerly practised as an attorney between 1987 and 1995.
Anna Maleshane Kgoele,also spelled Annah Malefsane Kgoele,is a South African judge of the Supreme Court of Appeal. She joined the appellate court in December 2023 after 14 years in the High Court of South Africa. From 2014 to 2018,she was the president of the South African chapter of the International Association of Women Judges.
Lebotsang Orphan "Ronnie" Bosielo was a South African judge of the Supreme Court of Appeal. Formerly a judge of the High Court of South Africa,he served in the appellate court from October 2009 until his death in May 2018. He was an acting judge in the Constitutional Court in 2012 and 2016,and he was thrice nominated unsuccessfully for permanent appointment to the apex court.
Robert Wolseley Nugent is a South African retired judge who served in the Supreme Court of Appeal from 2002 to 2013. Formerly an advocate and Senior Counsel in Johannesburg,he was appointed to the bench in 1993 as a judge of the Transvaal Provincial Division. In 2018,he chaired the Nugent Commission into maladministration at the South African Revenue Service.
