Kevin Gerard Beecroft Swain (born 20 December 1950) is a South African retired judge who served in the Supreme Court of Appeal from 2014 to 2020. He was formerly a judge of the KwaZulu-Natal High Court from 2003 to 2014. Before joining the bench in November 2003,he was an advocate and Senior Counsel in Pietermaritzburg.
Swain was born on 20 December 1950 in Pietermaritzburg in the former Natal Province. [1] He attended Merchiston Preparatory School and Maritzburg College,matriculating in 1967. [2]
Thereafter he studied at the University of Natal's Pietermaritzburg campus,where he completed a BSc in 1972 and an LLB cum laude in 1975,and at the University of Cambridge,where he completed a second LLB in 1977. [1] His study at Cambridge was funded by a bursary from the Attorneys,Notaries and Conveyancers Fidelity Fund. [1]
Swain was admitted as an advocate in 1975,shortly after his graduation from the University of Natal. [1] When he returned to South Africa from Cambridge in 1977,he commenced his practice at the Pietermaritzburg Bar,where he worked for the next 26 years and where he took silk in 1993. [2] During the post-apartheid period,his clients included the African National Congress,which he represented in litigation on floor-crossing. [3] [4]
During his time at the Bar,Swain was a part-time lecturer at the University of Natal from 1978 to 1980,teaching public international law and law of evidence,and he was later the vice-chairman of the Pietermaritzburg Bar for two terms from 1995 to 1997 and from 1999 to 2001. [1] In addition,he was an acting judge in the KwaZulu-Natal High Court on several occasions between 1998 and 2003. [1]
On 1 November 2003,Swain joined the bench permanently as a judge of the KwaZulu-Natal High Court. [2] He served in that court for over a decade,although he served a protracted stint as an acting judge in the Supreme Court of Appeal from October 2012 to May 2014;during the same period,he was also periodically an acting judge in the Competition Appeal Court. [1]
In April 2014,Swain was among seven candidates whom the Judicial Service Commission shortlisted and interviewed for possible permanent elevation to the Supreme Court of Appeal. Then serving as an acting judge of appeal,he was viewed as a frontrunner:Judge President Lex Mpati was complimentary during his interview, [5] and the Business Day described his candidacy as "apparently universally supported". [6] After the interviews,the commission recommended Swain,Boissie Mbha,and Dumisani Zondi for appointment, [7] and President Jacob Zuma accepted the recommendation the following month,appointing the trio to the Supreme Court of Appeal with effect from 1 June 2014. [8] Swain served in the appellate court until his retirement in 2020. [1]
He is married to Anne Swain;they have two children. [1]
Thembile Lewis Skweyiya was a South African lawyer and judge who served on the Constitutional Court of South Africa between February 2004 and May 2014. He rose to prominence as a civil rights lawyer during apartheid and he served three years in the KwaZulu-Natal High Court before his elevation to the Constitutional Court.

Dumisani Hamilton Zondi is a South African judge of the Supreme Court of Appeal. He was appointed as the chairperson of the Electoral Court in 2022. Before his elevation to the Supreme Court in June 2014,he served in the Western Cape High Court between 2007 and 2014,as well as in the Competition Appeal Court between 2011 and 2014. He entered legal practice as an attorney in 1986.
Fikile Eunice Mokgohloa is a South African judge of the Supreme Court of Appeal. Before her elevation to that court in June 2019,she was a judge of the High Court of South Africa between November 2008 and May 2019. She joined the bench as a judge of the KwaZulu-Natal Division and moved to the Limpopo Division in January 2016,becoming Deputy Judge President in Limpopo in July 2016. Born in Pretoria,she began her career as an attorney in the former Transvaal.
Boissie Henry Mbha is a retired South African judge who served in the Supreme Court of Appeal from June 2014 to August 2022. He was also the chairperson of the Electoral Court from 2018 to 2022,and he acted in the Constitutional Court for a term in 2016. A former attorney,he was appointed to the bench in October 2004 as a judge of the High Court's Gauteng Division.
Petrus Arnolus Koen is South African judge who is currently serving in the KwaZulu-Natal Division of the High Court of South Africa. Before joining the bench in November 2006,he was Senior Counsel in Pietermaritzburg. He is best known for presiding in the corruption trial of former President Jacob Zuma from May 2021 until he recused himself in January 2023.
Thoba Portia Poyo-Dlwati is a South African judge who is currently serving as the Judge President of the KwaZulu-Natal High Court. She joined the court as a puisne judge in June 2014 and was elevated to the judge presidency in January 2023,appointed by President Cyril Ramaphosa as the division's first female judge president.
Mahendra Ramasamy Chetty is a South African judge of the High Court of South Africa. He was appointed to the KwaZulu-Natal Division in June 2014. Before that,Chetty was an attorney for the Legal Resources Centre,where he worked between 1990 and 2014;he was the director of the centre's Durban office from 1999 onwards. He was admitted as an attorney in 1988.

Lorimer Eric Leach is a South African retired judge who served in the Supreme Court of Appeal from 2009 to 2020. He is best known for writing the judgement in which the Supreme Court found Oscar Pistorius guilty of murder. Before his elevation to the appellate court,he was a judge of the Eastern Cape Division from 1993 to 2009,and he practised as an advocate in Grahamstown from 1976 to 1993,taking silk in 1990.
