Christiaan Hendrik Gert van der Merwe (born 29 July 1954) is a South African judge of the Supreme Court of Appeal. Before his elevation to that court,he served in the Free State High Court from August 2003 to June 2016. He began his career as a public prosecutor and practised in the Free State as an advocate between 1981 and 2003,gaining silk status in 1994.
Van der Merwe was born on 29 July 1954 in Frankfort in the former Orange Free State (now the Free State). [1] His home language was Afrikaans. [2] He matriculated at Grey College in Bloemfontein in 1972 and went on to the University of the Free State,where he completed a BJuris in 1976;he then completed an LLB at the University of South Africa in 1978. [1]
After graduating,van der Merwe served two years at the National Prosecuting Authority in Bloemfontein,where he was a state advocate between 1978 and 1980. [1] In 1981,he was admitted as an advocate,and he practised at the Free State Bar for over two decades thereafter,gaining silk status in March 1994. He served on the Free State Bar Council between 1990 and 2003,including as its chairperson for the last three of those years. [1]
On 1 August 2003,van der Merwe joined the bench of the Free State Division of the High Court of South Africa. [1] During his nearly 13 years in that court,he was seconded for two non-consecutive years to the Supreme Court of Appeal,where he was an acting judge from December 2012 to November 2013 and then from December 2014 to November 2015. [1]
In April 2014,van der Merwe was one of seven candidates whom the Judicial Service Commission shortlisted and interviewed for possible permanent appointment to one of three vacancies in the Supreme Court of Appeal, [3] but his interview was unsuccessful. [2]
Two years later,in April 2016,van der Merwe was shortlisted and interviewed again for new vacancies at the Supreme Court of Appeal. His friendly and brief 20-minute interview began with Supreme Court President Lex Mpati disclosing that he had bought cattle from van der Merwe. [2] [4] He had been nominated to the shortlist by the law faculty and dean of his alma mater,the University of the Free State, [5] and his application emphasised his commercial law expertise. [4] However,some commentators were concerned that his contributions to jurisprudence had been sparse, [2] and advocacy groups pointed to a prior judgement in which they argued he had been unduly lax in sentencing a rapist. [6]
Nonetheless,the Judicial Service Commission recommended van der Merwe for appointment, [7] which was later confirmed by President Jacob Zuma. He joined the bench on 1 July 2016 alongside Connie Mocumie. [8] He was the first Afrikaner to join the court since the retirement of Justice Fritz Brand. [4]
During his career as an advocate,van der Merwe chaired the disciplinary committee of the Free State Rugby Union,and he later served as chairperson of the governing body of his high school,Grey College,between 2004 and 2007. [1] In March 2007,he joined the council of his alma mater,the University of the Free State,and between 2010 and 2016, [1] he served two terms as chairperson of the council. [9] [10] [11] [12] During his tenure,the council adopted a new language policy,which included a commitment to multilingualism as well as to English as the primary medium of instruction. [13]
He is married to Tronel van der Merwe and has three children. [1]
Mandisa Muriel Lindelwa Maya is the Deputy Chief Justice of South Africa. She was formerly the President of the Supreme Court of Appeal from 2017 to 2022. She joined the bench in May 2000 as a judge of the Transkei Division of the High Court of South Africa and was elevated to the Supreme Court of Appeal in 2006.
Xola Mlungisi Petse is a South African judge who has been the Deputy President of the Supreme Court of Appeal since 2019. A former attorney,he joined the Supreme Court as a puisne judge in June 2012. Before that,he was a judge of the Eastern Cape High Court from July 2005 to May 2012.
Rammaka Steven Mathopo is a judge of the Constitutional Court of South Africa. Before his elevation to that court in January 2022,he served in the Supreme Court of Appeal between June 2015 and December 2021. He was formerly a judge of the Gauteng High Court from January 2006 to May 2015,and he practised as an attorney for 17 years before then.
Owen Lloyd Rogers is a South African judge of the Constitutional Court of South Africa. Before his appointment to that court in August 2022,he served in the Western Cape Division of the High Court for nine years,having joined the bench in February 2013. Formerly an advocate and senior counsel at the Cape Bar,he was also a judge of the Competition Appeal Court between 2016 and 2022.
Mahube Betty Molemela is a South African judge who has been the President of the Supreme Court of Appeal since 1 June 2023. Before her appointment to the Supreme Court in June 2018,she was the first woman Judge President of the Free State High Court from 2015 to 2018. A former attorney,she was appointed to the bench in the Free State in July 2008.

Dumisani Hamilton Zondi is a South African judge of the Supreme Court of Appeal. He was appointed as the chairperson of the Electoral Court in 2022. Before his elevation to the Supreme Court in June 2014,he served in the Western Cape High Court between 2007 and 2014,as well as in the Competition Appeal Court between 2011 and 2014. He entered legal practice as an attorney in 1986.
David Unterhalter is a South African jurist and judge of the Gauteng Division of the High Court of South Africa. He is also professor of law at the University of Cape Town. Before he was appointed to the bench in January 2018,Unterhalter was a prominent advocate,specialising in public law,competition law,and trade law. He was called to the Johannesburg Bar in 1990 and took silk in 2002.
Ashton Schippers is a South African judge of the Supreme Court of Appeal. Before his elevation to that court in June 2018,he served in the Western Cape High Court from February 2013 to May 2018. He was formerly an advocate in Cape Town,where he took silk in 2004 and where he was chairperson of the bar council between 2004 and 2006.
Tati Moffat Makgoka is a South African judge of the Supreme Court of Appeal. Formerly an attorney in Pretoria,he served in the Gauteng High Court from August 2009 until June 2018,when he was elevated to the Supreme Court of Appeal. He was an acting judge in the Constitutional Court in 2023.
Boissie Henry Mbha is a retired South African judge who served in the Supreme Court of Appeal from June 2014 to August 2022. He was also the chairperson of the Electoral Court from 2018 to 2022,and he acted in the Constitutional Court for a term in 2016. A former attorney,he was appointed to the bench in October 2004 as a judge of the High Court's Gauteng Division.
Aubrey Phago Ledwaba is South African judge who is currently serving as the Deputy Judge President of the Gauteng Division of the High Court of South Africa. Formerly a practising attorney in Gauteng,he joined the bench as a puisne judge in November 2005 and was elevated to his leadership position in July 2013. He is best known for his role in the Seriti Commission of Inquiry into the Arms Deal,which he chaired between 2011 and 2015. He was formerly an attorney in his hometown of Pretoria.
Malesela Francis Legodi is a South African retired judge of the High Court of South Africa. He was the first Judge President of the Mpumalanga Division of the High Court from August 2017 to August 2023. He joined the bench in October 2004 as a puisne judge of the Gauteng Division. Before that,he was a practising attorney in Mpumalanga.
