Thomas Dante Cloete (born 15 May 1948) is a South African retired judge who served in the Supreme Court of Appeal from January 2003 until his retirement in May 2013. Formerly an advocate and Senior Counsel in Johannesburg,he was appointed to the bench in 1991 as a judge of the Transvaal Provincial Division (later the Gauteng High Court).
Cloete was born on 15 May 1948 in Johannesburg. [1] His family moved to Grahamstown in the Eastern Cape in 1954,where his father,Johannes Dante Cloete,was Senior Counsel and later the Judge President of the Eastern Cape Division of the Supreme Court of South Africa. [2]
He attended St Andrew's Preparatory School and St Andrew's College in Grahamstown,matriculating in 1965,and went on to Rhodes University,where he completed a BA in 1969. [3] From 1969 to 1972,he attended Oxford University on a Rhodes Scholarship,completing his BA in jurisprudence. [1] [2] Thereafter he returned to Grahamstown to study toward his LLB at Rhodes,graduating cum laude in 1974. [1] He clerked for his father at the Supreme Court while reading for his LLB,and he was captain of the smallbore shooting team at St Andrew's,Rhodes,and Oxford. [2] [3]
In 1976,Cloete was admitted as an advocate of the Johannesburg Bar,where he practised law for the next 15 years. [1] He also practised in Botswana,where he was admitted as an advocate in 1979. [1] In South Africa,he took silk in 1989. [3]
On 15 December 1991,Cloete was appointed to the bench of the Supreme Court as a judge of the Transvaal Provincial Division,which became the Gauteng Division of the High Court after the end of apartheid. [2] During his 11 years' service on that court,sitting in Johannesburg,Cloete became the senior judge on the Witwatersrand Local Division circuit of the Commercial Court. [3] He was also an acting judge in Swaziland's high court in 1994. [1]
In November 2002,President Thabo Mbeki announced that Cloete and Carole Lewis would be elevated to the Supreme Court of Appeal with effect from 1 January 2003. [4] [5] Cloete served in the appellate court for just over a decade,during which time he was also an ad hoc judge of appeal in the Seychelles in 2003. [1] His notable judgements include Du Plessis v Road Accident Fund,an early judgement on the rights of same-sex partners. [6]
Cloete retired on 16 May 2013 at the age of 65. [7] [8] He is a trustee of Taco Kuiper's Valley Trust and often serves on the judging panel of the Taco Kuiper Award for Investigative Journalism. [9]
He is married to Janet Ritchie,with whom he has two children. [3] He is a Freemason. [10] [11]
Zukisa Laura Lumka Tshiqi is a South African judge of the Constitutional Court of South Africa. She formerly served in the Supreme Court of Appeal from December 2009 until October 2019,when President Cyril Ramaphosa elevated her to the Constitutional Court. She was a practising attorney until she was first appointed to the bench in the Gauteng High Court in 2005.
Halima Khanam Saldulker is a South African judge of the Supreme Court of Appeal. She began her judicial career as a judge in the South Gauteng High Court from August 2004 to July 2013,when she was appointed to the Supreme Court. Before that,she practiced as an advocate in Johannesburg between 1988 and 2004.
Pieter Andries Meyer is a South African judge of the Supreme Court of Appeal. Before his elevation to that court,he was a judge of the Gauteng High Court from November 2007 to November 2022. He formerly practised law in Johannesburg,where he was admitted as an advocate in 1986 and took silk in 2004.
Visvanathan Ponnan is a South African judge of the Supreme Court of Appeal. He joined the Gauteng High Court in 2001 and was elevated to the Supreme Court of Appeal in December 2004. Before that,he practised as an advocate in Durban between 1985 and 2001.
Dumisani Hamilton Zondi is a South African judge of the Supreme Court of Appeal. He was appointed as the chairperson of the Electoral Court in 2022. Before his elevation to the Supreme Court in June 2014,he served in the Western Cape High Court between 2007 and 2014,as well as in the Competition Appeal Court between 2011 and 2014. He entered legal practice as an attorney in 1986.
David Unterhalter is a South African jurist and judge of the Gauteng Division of the High Court of South Africa. He is also professor of law at the University of Cape Town. Before he was appointed to the bench in January 2018,Unterhalter was a prominent advocate,specialising in public law,competition law,and trade law. He was called to the Johannesburg Bar in 1990 and took silk in 2002.
Tati Moffat Makgoka is a South African judge of the Supreme Court of Appeal. Formerly an attorney in Pretoria,he served in the Gauteng High Court from August 2009 until June 2018,when he was elevated to the Supreme Court of Appeal. He was an acting judge in the Constitutional Court in 2023.
Boissie Henry Mbha is a retired South African judge who served in the Supreme Court of Appeal from June 2014 to August 2022. He was also the chairperson of the Electoral Court from 2018 to 2022,and he acted in the Constitutional Court for a term in 2016. A former attorney,he was appointed to the bench in October 2004 as a judge of the High Court's Gauteng Division.
Aubrey Phago Ledwaba is South African judge who is currently serving as the Deputy Judge President of the Gauteng Division of the High Court of South Africa. Petrus Gcinumuzi Malindi is South African judge of the High Court of South Africa. He was appointed to the Gauteng Division in July 2021 after 25 years as a practising advocate,during which time he was well known for his association with the African National Congress. He was admitted to the Johannesburg Bar in 1995 and took silk in 2010. During apartheid,he rose to prominence as an anti-apartheid activist and defendant in the Delmas Treason Trial,which led to his conviction for terrorism and his imprisonment on Robben Island.
Raylene May Keightley is a South African judge of the High Court of South Africa. She was appointed to the Gauteng Division in January 2016 after a career as a legal academic and practising lawyer. She was admitted as an attorney in 1986 and as an advocate in 2006.
Petrus Arnolus Koen is South African judge who is currently serving in the KwaZulu-Natal Division of the High Court of South Africa. Before joining the bench in November 2006,he was Senior Counsel in Pietermaritzburg. He is best known for presiding in the corruption trial of former President Jacob Zuma from May 2021 until he recused himself in January 2023.
Annali Christelle Basson is a South African judge of the High Court of South Africa. She was appointed to the Gauteng Division in January 2016 after serving in the Labour Court from 2007 to 2016. Before her appointment to the bench,she was a legal academic at the University of South Africa,where she specialised in labour law and mercantile law. She was an acting judge in the Constitutional Court in 2018 and was shortlisted for permanent appointment to that court in 2019.
Legoabe Willie Seriti is a South African retired judge who served in the Supreme Court of Appeal between 2010 and 2019. Before his elevation to that court,he was a judge of the Gauteng High Court from 2003 to 2010. He is best known for his role in the Seriti Commission of Inquiry into the Arms Deal,which he chaired between 2011 and 2015. He was formerly an attorney in his hometown of Pretoria.
Malesela Francis Legodi is a South African retired judge of the High Court of South Africa. He was the first Judge President of the Mpumalanga Division of the High Court from August 2017 to August 2023. He joined the bench in October 2004 as a puisne judge of the Gauteng Division. Before that,he was a practising attorney in Mpumalanga.
Lebotsang Orphan "Ronnie" Bosielo was a South African judge of the Supreme Court of Appeal. Formerly a judge of the High Court of South Africa,he served in the appellate court from October 2009 until his death in May 2018. He was an acting judge in the Constitutional Court in 2012 and 2016,and he was thrice nominated unsuccessfully for permanent appointment to the apex court.
Robert Wolseley Nugent is a South African retired judge who served in the Supreme Court of Appeal from 2002 to 2013. Formerly an advocate and Senior Counsel in Johannesburg,he was appointed to the bench in 1993 as a judge of the Transvaal Provincial Division. In 2018,he chaired the Nugent Commission into maladministration at the South African Revenue Service.
Suretta Snyders was a South African judge who served in the Supreme Court of Appeal from December 2008 until her death in August 2014. Formerly an advocate and Senior Counsel in Johannesburg,she was appointed to the bench in February 1997 as a judge of the Transvaal Provincial Division of the High Court.
Nigel Paul Willis is a South African retired judge who served in the Supreme Court of Appeal from July 2013 until his retirement in October 2018. Francois Retief Malan is a South African retired judge who served in the Supreme Court of Appeal from 2009 to 2014. Before his elevation to the appellate court,he was a judge of the Gauteng High Court from 1997 to 2009,and he also served as a judge of the Competition Appeal Court. He was formerly a legal academic at the Rand Afrikaans University,where he was an expert on banking law.
