Impeachment in South Africa is the process by which the legislative body of the Republic of South Africa addresses legal charges against a government official. [1]
When the Union of South Africa was established in 1910, the only officials who could be impeached (though the term itself was not used) were the chief justice and judges of the Supreme Court of South Africa. The scope was broadened when the country became a republic in 1961, to include the state president. It was further broadened in 1981 to include the new office of vice state president; and in 1994 to include the executive deputy presidents, provincial premiers, the Public Protector and the Auditor-General. Since 1997, members of certain commissions established by the Constitution can also be impeached. The grounds for impeachment, and the procedures to be followed, have changed several times over the years.
Impeachment proceedings were first invoked in the 2010s :
1910-1994 : the governor-general-in-council (until 1961) or state president (from 1961) could remove a judge from office for "misbehaviour or incapacity" if both the Senate and the House of Assembly submitted addresses to him, during the same session of parliament, asking him to do so. [2] [3]
1994-1997 : the president could remove a judge from office for "misbehaviour, incapacity or incompetence", if both the National Assembly and the Senate requested him to do so, after considering a report from the Judicial Service Commission. [4]
1997-date : the president may remove a judge from office if (a) the Judicial Service Commission finds that the judge "suffers from an incapacity, is grossly incompetent or is guilty of gross misconduct", and (b) the National Assembly resolves, by a two-thirds majority, that the judge be removed. [5] In 2022, two High Court judges, retired Judge Nkola Motata and Judge President John Hlophe of the Western Cape division, Cape Town were recommended for removal by the National Assembly by its Portfolio Committee on Justice and Correctional Services.
1961-1980 : the Senate and House of Assembly could remove the State President from office for "misconduct or inability to perform efficiently the duties of his office". The procedure required (a) at least thirty members of the House to petition the Speaker to appoint a joint committee; (b) the House to resolve to appoint the committee; (c) the Senate to concur with the resolution, (d) the committee to submit a report; and (e) each House to resolve, in the same session of parliament, to remove the State President from office. 1981-1984 : following the abolition of the Senate, the power to impeach the State President was vested in the House of Assembly alone. The same procedure applied to the removal of the Vice State President. [7]
1984-1994 : an electoral college, consisting of delegates from the House of Assembly and the new House of Representatives and House of Delegates, could remove the State President from office for "misconduct or inability to perform efficiently the duties of his office". The procedure required (a) at least half the members of each of the three houses to petition the Speaker of Parliament to appoint a committee; (b) each house to resolve to appoint the committee; (c) the committee to submit a report; and (d) the electoral college to resolve to adopt the report and declare the State President removed from office. 1994-1997 : the National Assembly and the Senate, sitting jointly, could remove the President from office by impeaching him or her for "a serious violation of this Constitution or the other laws of the Republic, or of misconduct or inability rendering him or her unfit to exercise and perform his or her powers and functions". A two-thirds majority was required. A similar procedure applied to the removal of any of the Executive Deputy Presidents. [9]
1997-date : the National Assembly (alone) may remove the President, for "a serious violation of the Constitution or the law", "serious misconduct" or "inability to perform the functions of office". A two-thirds majority is required. A president who is removed may not receive any benefits of that office, and may not serve in any public office. [10]
President Jacob Zuma came close to facing an impeachment vote in 2016 over the abuse of taxpayer funds to build his personal home at Nkandla, but his party used their parliamentary majority to prevent the vote. The Constitutional Court subsequently found that parliament had failed to hold Zuma to account and ordered parliament to establish rules for the impeachment process. [11]

A two-thirds majority is required. A premier who is removed may not receive any benefits of that office, and may not serve in any public office. [13]
1994-1997: the president could remove the Public Protector from office for "misbehaviour, incapacity or incompetence", if both the Assembly and the Senate requested him to do so, after considering a report from a joint committee. [14]
1997-date: the president must remove the public protector if a committee of the National Assembly finds him or her guilty of "misconduct, incapacity or incompetence", and the Assembly resolves that he or she be removed. A two-thirds majority is required. [15] In 2023, Public Protector Busisiwe Mkhwebane became the first head of a Chapter 9 institution to be impeached. [16]

1997-date: the president must remove a member of the South African Human Rights Commission, the Commission for the Promotion and Protection of the Rights of Cultural, Religious and Linguistic Communities, the Commission for Gender Equality or the Electoral Commission from office if a committee of the National Assembly finds him or her guilty of "misconduct, incapacity or incompetence", and the Assembly resolves that he or she be removed. A simple majority is required. [15]
The Constitution of the Orange Free State republic provided that the Volksraad (legislature) could impeach the state president and other public officers for "treason, bribery, and other high misdemeanours." A three-quarters majority vote was required. The Volksraad's sanction was limited to dismissing the incumbent from office and declaring him unfit to hold any office under the government, but the dismissed president or official remained liable to be prosecuted according to law. [18]
The Constitution of the South African Republic provided that the Volksraad could discharge or dismiss the president from office on conviction for misconduct, embezzlement of state property, treason or other serious crimes. He was liable to be prosecuted for such offences. [18]
Impeachment is a process by which a legislative body or other legally constituted tribunal initiates charges against a public official for misconduct. It may be understood as a unique process involving both political and legal elements.
The Constitutional Court of South Africa is the supreme constitutional court established by the Constitution of South Africa, and is the apex court in the South African judicial system, with general jurisdiction.
The National Prosecuting Authority Act, 1998 is an act of the Parliament of South Africa which established the National Prosecuting Authority (NPA). The creation of the NPA was required by section 179 of the Constitution of South Africa, which came into force in February 1997.
The Public Protector in South Africa is one of six independent state institutions set up by the country's Constitution to support and defend democracy.
Qubudile Richard Dyantyi is a South African politician who represented the African National Congress (ANC) in the National Assembly from 2019 until 2024. Before that, he was a Member of the Western Cape Provincial Parliament and served as the Western Cape's Member of the Executive Council (MEC) for Local Government and Housing from 2005 to 2008. In 2021, he was elected chairperson of the national parliament's Committee for the Section 194 Enquiry into Busisiwe Mkhwebane's fitness to hold office.
Baaitse Elizabeth "Bess" Nkabinde-Mmono is a South African retired judge who served in the Constitutional Court of South Africa from January 2006 to December 2017. During that time, she was acting Deputy Chief Justice of South Africa from 23 May 2016 to 7 June 2017. She joined the bench in November 1999 as a judge of the Bophuthatswana Provincial Division.
Tina Monica Joemat-Pettersson was a South African politician who served as the Chairperson of the Portfolio Committee on Police from July 2019 until her death in June 2023. A member of the African National Congress, Joemat-Petterson had previously served as the Minister of Agriculture, Forestry and Fisheries from 2009 until 2014 and as the Minister of Energy from May 2014 until March 2017 under President Jacob Zuma.
Mogoeng Thomas Reetsang Mogoeng is a South African jurist who served as the Chief Justice of South Africa from 8 September 2011 until his retirement on 11 October 2021.
Lindiwe Daphney Zulu is a South African politician and communications strategist who served as Minister of Social Development from May 2019 to May 2024. Before that she was the Minister of Small Business Development from 2014 to 2019. A member of the African National Congress (ANC), she has served on the party's National Executive Committee since December 2007.
The chief justice of the Gambia is the head of the Gambian judiciary and is responsible for the administration and supervision of the courts. The chief justice is also the chief judge of the Supreme Court of the Gambia.
Economic Freedom Fighters v Speaker of the National Assembly and Others; Democratic Alliance v Speaker of the National Assembly and Others [2016] ZACC 11 is an important judgment of the Constitutional Court of South Africa which finds that President Jacob Zuma breached the South African Constitution by failing to implement the recommendations in the Public Protector's Nkandla report.
Busisiwe Mkhwebane is a South African advocate and prosecutor served as the 4th Public Protector of South Africa from October 2016 until her impeachment in September 2023. Following her impeachment, she served as a Member of the National Assembly of South Africa from October 2023 to October 2024, representing the EFF. She is the first head of a Chapter 9 institution to be removed through impeachment.
Bongani Thomas Bongo is a South African politician and the former Minister of State Security, a position to which he was appointed on 17 October 2017 by President Jacob Zuma until he was relieved from the post on 28 February 2018 by President Cyril Ramaphosa. He was the only appointment that had not been a cabinet minister before. He served as President of the University of Limpopo's Alumni and Convocation Association between 2016 and 2022, and became its emiratus president soon after that. As the Minister of State Security, Bongo headed the State Security Agency of South Africa.
Daluxolo Christopher Mpofu is a South African lawyer, politician, and former businessman who was the National Chairperson of the Economic Freedom Fighters (EFF) from 2014 to 2019. He served on the Judicial Service Commission from 2017 to 2022 and formerly served as chief executive officer of the South African Broadcasting Corporation from 2005 to 2009.
Xola Nqola is a South African politician from the Eastern Cape. A member of the African National Congress (ANC), he is the chairperson of the National Assembly of South Africa's Portfolio Committee on Justice and Constitutional Development.
The Committee for Section 194 Enquiry is an ad hoc committee of the National Assembly of South Africa that was established on 7 April 2021 to determine if there are grounds for the removal of Advocate Busisiwe Mkhwebane as Public Protector.
Thabo Nelson Mmutle is a South African former Member of Parliament for the African National Congress. He became an MP at the 2019 general election. Mmutle is a former member of the national executive committee (NEC) of the African National Congress Youth League.
The 2020 Phala Phala Robbery or Cyril Ramaphosa Farm Burglary or Farmgate Scandal was a burglary of South African President Cyril Ramaphosa's private Phala Phala game farm near Bela-Bela, Limpopo, South Africa. The incident occurred on 9 February 2020 in which an indeterminate amount of cash was stolen. Arthur Fraser, an ally of former President Jacob Zuma alleged that around 4 million US dollars of undeclared foreign currency had been stolen. However, subsequent reports indicated that the amount stolen was $580 000 Ramaphosa denied any wrongdoing, and sought judicial review of a report by a panel appointed by the South African Parliament released in 2022 that accused him of "serious misconduct". Opposition parties and MPs have slammed investigations into the source of the cash, and have accused the South African Reserve Bank of a providing claptrap report and systemic coverup. The Democratic Alliance intends to pursue the courts to further investigate the matter.
Economic Freedom Fighters and Others v Speaker of the National Assembly and Another is a 2017 decision of the Constitutional Court of South Africa on Parliament's constitutional obligation to hold the President accountable for his conduct. In a majority judgment written by Justice Chris Jafta, the court ordered the National Assembly to make rules regulating presidential impeachment under section 89 of the Constitution and to use those rules to determine whether President Jacob Zuma had committed impeachable conduct in failing to comply with a report by the Public Protector. Arising from the Nkandlagate scandal, the case was politically sensitive, and critics held that the court's order transgressed the separation of powers.
On 21 February 2024, the National Assembly of South Africa voted to impeach Judge John Hlophe, a judge of the High Court of South Africa and the judge president of the Western Cape Division. Hlophe was accused of improper interference in the deliberations of the Constitutional Court in litigation involving the interests of Jacob Zuma. His impeachment was the result of a finding by the Judicial Service Commission that his conduct in this regard amounted to gross misconduct. Hlophe was the first judge to be impeached under the post-apartheid Constitution.
