The Microsoft licensing corruption scandal was a political scandal and criminal investigation in Romania, involving large bribes paid to Romanian government members in exchange for approving increases in license fees for Microsoft products. It was called the 'biggest ever' Romanian corruption case. However, most of the charges were dropped in 2018 as the statute of limitations had expired (the charges were brought in 2015 and first contract signed in 2004). [1]

Nine government ministers have been charged by the National Anticorruption Directorate, [2] belonging to the Năstase, Tăriceanu and Boc Cabinets. The bribes were estimated at more than $50 million. [3]

Apart from Microsoft, this scandal involved several major multinational corporations, including Fujitsu-Siemens, IBM, Compaq, Hewlett-Packard, S&T and local software companies like SIVECO and Softwin. [4]

Persons involved in scandal

According to Gheorghe Ștefan (a.k.a. "Pinalti"), more than 100 persons are involved in the corruption scandal, [5] among them nine former ministers [6] and prominent businessmen.

Sentences

On 24 March 2016, Dorin Cocoș was sentenced to 2 years imprisonment for influence peddling and money laundering, and to an asset forfeiture of €3 million. Gabriel Sandu was sentenced to 2 years imprisonment for bribery and money laundering, and to an asset forfeiture of over €2 million. Gheorghe Ștefan was sentenced to 3 years imprisonment for influence peddling and to an asset forfeiture of €3 million. Dumitru Nicolae was convicted to 1 and a half years suspended sentence, €1 million forfeiture and 90 days community service. [7] [8] The sentences are not final and can be appealed.

On 3 October 2016, Dorin Cocoș was sentenced to 2 years 4 months imprisonment for influence peddling and money laundering, and to an asset forfeiture of €9 million. Gabriel Sandu was sentenced to 3 years imprisonment for bribery and money laundering, and to an asset forfeiture of over €2 million. Gheorghe Ștefan was sentenced to 6 years imprisonment for influence peddling and to an asset forfeiture of over €3 million. Nicolae Dumitru was convicted to 2 years 4 months imprisonment, $2,050,000 and €1 million forfeiture. [9] These sentences are final.

Sentenced to six years in prison for corruption offenses, she sought asylum in Costa Rica in 2018. The following year, she gave up the asylum claim and returned to Romania.

Gabriel Oprea Romanian politician

Gabriel Oprea is a Romanian politician and a general in the army reserves. The former president of the National Union for the Progress of Romania and a former member of the Social Democratic Party (PSD) who is now an independent, he was a member of the Romanian Chamber of Deputies for Ilfov County from 2004 to 2012 and was a Senator for Bucharest from 2012 to 2016. In the Adrian Năstase cabinet, he was Minister-Delegate for Public Administration from June 2003 to July 2004; in the Emil Boc cabinet, he was Minister of Administration and Interior from December 2008 to January 2009; again under Boc and continuing under Mihai Răzvan Ungureanu, he was Defence Minister ; and in the Victor Ponta cabinet, served as deputy prime minister from December 2012, additionally holding the Interior portfolio from January 2014. From June to July 2015, and again from late July into August, he was interim Prime Minister of Romania. That November, he left the government after Ponta's resignation.

Gabriel Sandu is a Romanian economist and politician. A member of the Democratic Liberal Party (PD-L), he was a member of the Romanian Chamber of Deputies for Brăila County from 2004 to 2008. In the Emil Boc cabinet, he was Minister of Communications and Information Society from 2008 to 2010, also serving as interim Minister of Small and Medium Enterprises, Commerce and Business Environment in late 2009.

Liviu Dragnea Romanian engineer and politician

Liviu Nicolae Dragnea is a Romanian engineer and politician. Starting his career in the Democratic Party (PD), he joined the Social Democratic Party (PSD), eventually becoming its leader. After holding several positions as Minister, he resigned from the cabinet in May 2015, following a conviction in a case involving electoral fraud, for which he received a two-year suspended sentence in April 2016.

Relu Fenechiu is a Romanian businessman and former politician. A former member of the National Liberal Party (PNL), he was a member of the Romanian Chamber of Deputies for Iaşi County from 2004 to 2014. In the Victor Ponta cabinet, he served as Transport Minister from 2012 to 2013. Convicted of corruption in 2013, he went to prison the following year.

Ioan-Codruţ Şereş is a Romanian engineer and politician. A member of the Conservative Party (PC), he was a member of the Romanian Senate for Maramureș County from 2004 to 2008. In the Călin Popescu-Tăriceanu cabinet, he was Minister of Economy and Commerce from 2004 to 2006.

Victor Babiuc is a Romanian jurist and politician. A former member of the Democratic Party (PD) and of the National Liberal Party (PNL), he was a member of the Romanian Chamber of Deputies for Bucharest in 1990 and from 1992 to 1996, and for Braşov County from 1996 to 2004. During the first days of June 2015, the Government of Romania was rocked by criminal investigation against Prime Minister Victor Ponta for 19 acts of corruption between 2007 and 2008, when he was lawyer. Moreover, Victor Ponta is also investigated for conflict of interest during his premiership, when he propelled Dan Șova, political ally and friend, in government positions. His resignation was demanded by President Klaus Iohannis and several figures in opposition. Victor Ponta denies the allegations and refuses to resign, plunging the country in the second political crisis in just three years.
