Mxolisi Sandile Oliver Nxasana was the National Director of Public Prosecutions (NDPP) in South Africa, the head of the National Prosecuting Authority. In August 2013 he was appointed NDPP by President Jacob Zuma effective from 1 October 2013. [1] [2] After a protracted enquiry into his fitness to hold office, Nxasana agreed to step down from his position as NDPP on 31 May 2015, effective from 1 June 2015. [3]
Nxasana has a MA in Philosophy from the University of Durban-Westville, a B.Proc degree from the University of Zululand and completed his LLB qualification at the University of the Witwatersrand in 1995. [4] Prior to his appointment as NDPP, he was a practising attorney in KwaZulu-Natal. [1] [2]
Despite delays in being issued security clearance for the NDPP position, Nxasana maintained that he was fit for the office. [5] His security clearance was eventually denied for failing to disclose that in 1985 he had been tried on a murder charge, of which he was acquitted on grounds of self-defence. [6] [7] [8] He did however declare two convictions for assault. [9] [10] On 5 July 2014, President Zuma announced an inquiry to determine whether Nxasana was fit and proper to hold office in terms of section 12(6)(a)(iv) of the National Prosecuting Authority Act, 1998. In December 2017, the High Court of South Africa ruled that the termination of Nxasana's contract as NDPP had been invalid, and that he had to repay a R17 million payment he received on leaving the post. [12] It was held that Nxasana should have known the payout was unlawful. [13] This order was confirmed in the Constitutional Court of South Africa in Corruption Watch v President .

KwaZulu-Natal is a province of South Africa that was created in 1994 when the Zulu bantustan of KwaZulu and Natal Province were merged. The National Prosecuting Authority (NPA) is the agency of the South African Government responsible for state prosecutions. Under Section 179 of the South African Constitution and the National Prosecuting Authority Act of 1998, which established the NPA in 1998, the NPA has the power to institute criminal proceedings on behalf of the state and to carry out any necessary functions incidental to institution of criminal proceedings. The NPA is accountable to Parliament, and final responsibility over it lies with the Minister of Justice and Correctional Services.

There have been many political assassinations in post-apartheid South Africa. In 2013 it was reported that there had been more than 450 political assassinations in the province of KwaZulu-Natal since the end of apartheid in 1994. In July 2013 the Daily Maverick reported that there had been "59 political murders in the last five years". In August 2016 it was reported that there had been at least twenty political assassinations in the run up to the local government elections on the 3rd of August that year, most of them in KwaZulu-Natal.

The 2021 South African unrest, also known as the July 2021 riots, the Zuma unrest or Zuma riots, was a wave of civil unrest that occurred in South Africa's KwaZulu-Natal and Gauteng provinces from 9 to 18 July 2021, sparked by the imprisonment of former President Jacob Zuma for contempt of court. Resulting protests against the incarceration triggered wider rioting and looting, much of it said to be undertaken by people not in support of Zuma and fuelled by job layoffs and economic inequality worsened by the COVID-19 pandemic policies. The unrest began in the province of KwaZulu-Natal on the evening of 9 July, and spread to the province of Gauteng on the evening of 11 July, and was the worst violence that South Africa had experienced since the end of Apartheid.
Jacob Zuma, the former president of South Africa, is currently being criminally charged for proven corruption in the 1999 Arms Deal. He was first indicted on the charges in June 2005, but attempts to prosecute him have been beset by legal challenges and political controversy. He is currently charged with two counts of corruption, one count each of racketeering and money laundering, and twelve counts of fraud, all arising from his receipt of 783 payments which the state alleges were bribes from businessman Schabir Shaik and French arms company Thales.
The Executive Council of KwaZulu-Natal is the cabinet of the executive branch of the provincial government in the South African province of KwaZulu-Natal. The Members of the Executive Council (MECs) are appointed from among the members of the KwaZulu-Natal Provincial Legislature by the Premier of KwaZulu-Natal, an office held since August 2022 by Nomusa Dube-Ncube of the African National Congress (ANC).
Langalakhe Nicholas "Senzo" Mkhize was a South African politician who represented the African National Congress (ANC) in the National Assembly from 2009 to 2010 and then in the KwaZulu-Natal Provincial Legislature from 2010 to 2016. He was the Chief Whip in the provincial legislature from 2014 until his death in 2016. Formerly an activist in the ANC Youth League, Mkhize was also a member of the Provincial Executive Committee of the ANC's KwaZulu-Natal branch.
Halima Khanam Saldulker is a South African judge of the Supreme Court of Appeal. She began her judicial career as a judge in the South Gauteng High Court from August 2004 to July 2013, when she was appointed to the Supreme Court. Before that, she practiced as an advocate in Johannesburg between 1988 and 2004.
Corruption Watch NPC and Others v President of the Republic of South Africa and Others; Nxasana v Corruption Watch NPC and Others is a 2018 decision of the Constitutional Court of South Africa on prosecutorial independence. In a judgment written by Justice Mbuyiseli Madlanga, the court affirmed unanimously that section 179(4) of the Constitution provided for the independence of the National Prosecuting Authority. It therefore held that sections of the National Prosecuting Authority Act, 1998 were unconstitutional insofar as they granted the President discretion over certain aspects of senior prosecutors' terms of employment, thereby compromising prosecutorial independence.
