Nomgcobo Jiba was the Deputy National Director of Public Prosecutions in South Africa.
Nomgcobo Jiba obtained her LLB from Walter Sisulu University in 1989 and went on to obtain her master's degree in Commercial Law in 1996. [1]
Jiba worked as a prosecutor in Peddie magistrate's court in the Eastern Cape in 1988 going on to also practice in courts at Tsolo and Mthatha. She resigned from government in 1997 to work for the legal firm Qunta Ntsebeza in Cape Town so as to work towards becoming an attorney,qualifying in 1998. In 1999 Jiba worked for Deloitte &Touche as a Senior Forensic Consultant in Pretoria and joined the Investigating Directorate for Serious Economic Offences as a Senior State Advocate. The Investigating Directorate was disbanded in 2001 and replaced by the Scorpions whereupon Jiba was appointed Deputy Director of Public Prosecutions. She was appointed Senior Deputy Director of Public Prosecutions in 2006. After the Scorpions was disbanded she was moved to the Specialised Commercial Crimes Court in 2009. In December 2010 Jiba was promoted to Deputy National Director of Public Prosecutions at the National Prosecuting Authority,a position that gave her oversight of all prosecutorial decisions made by the state. On 15 September 2016 Jiba was struck off the role of advocates by the North Gauteng High Court for her role in the handling of a number of politically related cases. [3] This included the decision to drop corruption charges against former head of the South African Police Service's Crime Intelligence Division Richard Mdluli. [3] [4] Other cases include being tried for fraud and perjury in a failed attempt to convict former Hawks official Major General Johan Booysen in 2012. [5] Booysen alleged that Jiba attempted to set him up so as to stop him from investigating specific cases of corruption involving president Zuma's family. [6] [7] She was also criticised by the courts for her role in handling the Zuma "spy tapes" scandal. [7]
The decision to strike Jiba off the role of advocates was overturned by the SCA in September 2018. [8]
On 26 April 2019,it was announced that Jiba had been fired by president Cyril Ramaphosa [9] acting on the recommendation of the Mokgoro inquiry. [10]
In 2015 the head of the NPA,Shaun Abrahams,announced that the case against Jiba would be dropped. [11] In November 2017 advocate Gerrie Nel and AfriForum instituted legal action to prosecute Jiba. [12] A month later the High Court in Pretoria set aside the NPA decision to withdraw the charges against Jiba. This effectively meant the NPA was obliged to reinstate them. As of 2020 she has yet to be informed of the status of these charges. [13]
Jiba's husband,Booker Nhantsi,was convicted of stealing R193,000 from a client's trust fund in 2003 and sentenced to five years in prison,but had his criminal record expunged after he received a presidential pardon from President Jacob Zuma in 2010. [14] In August 2021 she made pro bono representations for Democracy in Action (DIA) in which she argued that Jacob Zuma should not have been imprisoned for contempt of court without first having a trial. [15]
In 2007 the NPA head Mokotedi Mpshe suspended Jiba for allegedly assisting a police investigation against former NPA prosecutor Gerrie Nel,who was at the time Gauteng head of the now disbanded Scorpions. The disciplinary process never happened. [16]
In March 2012 in her role as acting NDPP she was ordered by the SCA to hand over the record of all documents and material that formed the basis of the decision to withdraw corruption charges against Zuma. She did not comply with the order. [16]
In April 2015 she appeared before the Specialised Commercial Crime Court [17] facing charges of fraud and perjury for her role in the constitutionally inconsistent [18] and invalid prosecution of a team investigating members of Jacob Zuma's family for corruption. Booysen told the Mokgoro inquiry that the reason he had been charged by Jiba was because he got in the way of the business interests of former president Jacob Zuma’s son Edward. [19]
The Daily Maverick has alleged that Western Cape Division High Court Judge John Hlophe has attempted to protect Jiba from prosecution in the past by constantly appointing Judge Mokgoatji Dolamo to dismiss cases involving Jiba. [7]
Former BOSASA executive,Angelo Agrizzi,testified to the Zondo Commission into state corruption that Jiba was receiving payments from BOSASA to ensure that corruption charges against the company would not be pursued by the National Director of Public Prosecutions. [20]
Jacob Gedleyihlekisa Zuma is a South African politician who served as the fourth president of South Africa from 2009 to 2018. He is also referred to by his initials JZ and clan names Nxamalala and Msholozi. Zuma was a former anti-apartheid activist,member of Umkhonto we Sizwe,and president of the African National Congress (ANC) from 2007 to 2017.
The National Prosecuting Authority (NPA) is the agency of the South African Government responsible for state prosecutions. The Directorate of Special Operations (DSO),commonly known as the Scorpions,was a specialised unit of the National Prosecuting Authority of South Africa formed by President Thabo Mbeki,tasked with investigating and prosecuting high-level and priority crimes including organised crime and corruption. An independent and multidisciplinary unit with a unique methodology which combined investigation,forensic intelligence,and prosecution,the Scorpions were known as an elite unit,and were involved in several extremely high-profile investigations,especially into the Arms Deal and into high-ranking African National Congress (ANC) politicians including Jackie Selebi,Jacob Zuma,and Tony Yengeni.
Jacob "Jackie" Sello Selebi was the National Commissioner of the South African Police Service from January 2000 to January 2008,when he was put on extended leave and charged with corruption. He was also a former President of African National Congress Youth League,South African ambassador to the United Nations from 1995 to 1998,and President of Interpol from 2004 to 2008. Selebi was found guilty of corruption on 2 July 2010 and sentenced to 15 years' imprisonment on 3 August 2010. However,he was released on medical parole in July 2012,after serving less than a year of his sentence,and lived at home until his death on 23 January 2015.
The Strategic Defence Package,popularly known as the Arms Deal,was a major defence procurement programme undertaken to re-equip the South African armed forces for the post-apartheid era. It is commonly associated with the large-scale corruption that is alleged to have taken place during and after the procurement process. Some critics have said that the Arms Deal was a defining moment or turning point for the African National Congress (ANC) government,less than five years into its tenure.

Vusumzi "Vusi" Pikoli is a South African advocate and the former head of South Africa's National Prosecuting Authority. He is noted for instigating criminal charges against disgraced South African police commissioner Jackie Selebi and ANC president Jacob Zuma. In 2008 he was suspended from his duties by President Thabo Mbeki,a close confidant of Selebi,and then subsequently fired by Mbeki's successor,Kgalema Motlanthe,who is an ally of Zuma. As such,opposition parties and sections of the press have claimed Pikoli is the victim of two separate political conspiracies. In October 2014 Pikoli was appointed as the Western Cape's first police ombudsman by Premier Helen Zille,whose choice was unanimously backed by the provincial legislature's standing committee on community safety.

She was the first female Premier of Gauteng from 2009 to 2014 and subsequently served in the national government as Minister of Water and Sanitation from 2014 to 2018,Minister of Communications in 2018,and Minister of Environmental Affairs from 2018 to 2019.

Glynnis Breytenbach is a former prosecutor for the National Prosecuting Authority (NPA) of South Africa and a Member of Parliament for the Democratic Alliance (DA). She is South Africa's Shadow Minister of Justice. In this capacity,she has called for an end to ongoing political interference that has compromised the integrity of the NPA. Her protracted dispute with the NPA over her suspension in 2012 from its Specialised Commercial Crime Unit was covered extensively in the media. In 2017,she published a memoir,Rule of Law,and in 2018 was shortlisted for the National Director of Public Prosecutions post at the NPA,but later withdrew her candidacy.
The Hawks are the South African Police Services' Directorate for Priority Crime Investigation (DPCI),which targets organised crime,economic crime,corruption,and other serious crime referred to it by the President or another division of the South African Police Service (SAPS). It was set up as the Scorpions by the Thabo Mbeki administration in 2001,but President Jacob Zuma replaced it with the Hawks as its successor in 2008,with many new associates.

Bosasa was a South African company specialising in providing services to government,most notably correctional services. It consisted of Bosasa Group,Bosasa Youth Development Centres,and African Global Operations. The company was liquidated in 2019 after a prolonged scandal about its allegedly corrupt relationship with members of the governing African National Congress (ANC),aired during the Zondo Commission of Inquiry.
Rammaka Steven Mathopo is a judge of the Constitutional Court of South Africa. Before his elevation to that court in January 2022,he served in the Supreme Court of Appeal between June 2015 and December 2021. He was formerly a judge of the Gauteng High Court from January 2006 to May 2015,and he practised as an attorney for 17 years before then.
Jacob Zuma,the former president of South Africa,is currently being criminally charged for proven corruption in the 1999 Arms Deal. He was first indicted on the charges in June 2005,but attempts to prosecute him have been beset by legal challenges and political controversy. He is currently charged with two counts of corruption,one count each of racketeering and money laundering,and twelve counts of fraud,all arising from his receipt of 783 payments which the state alleges were bribes from businessman Schabir Shaik and French arms company Thales.
William Andrew "Willie" Hofmeyr is a South African lawyer and former politician who was Deputy National Director of Public Prosecutions from 2001 to 2019. He was the founding head of the National Prosecuting Authority's Asset Forfeiture Unit from 1999 to 2011 and the head of the Special Investigating Unit from 2001 to 2011. Although he was removed from the AFU by Shaun Abrahams in 2015,he returned in 2019 before he retired late that year.
