The National Forest Adventure Pass is a recreation fee pass issued by the United States Forest Service that permits bearers in designated regions of four National Forests in Southern California to park their cars for the purpose of recreation. Though it was introduced during the "Recreation Fee Demonstration Program" (Fee-Demo) [1] which ended on November 21, 2004, the Forest Service continues to administer the program, nearly unchanged, under the Federal Lands and Recreation Enhancement Act. This act, derisively dubbed by some as the "Recreation Access Tax" (RAT), was passed in December 2004 as part of the Omnibus Appropriations Bill. The four national forests it applies to are the Angeles National Forest, Cleveland National Forest, Los Padres National Forest and San Bernardino National Forest.
It is the local element of the controversial national Recreational Fee Demonstration Program [2] system that imposes fees on the public to use public lands. [3]
The Legislative Counsel of California has determined that the Forest Service may not cite cars for parking on state highways within national forests unless there is evidence that the occupants have used the forest for recreational purposes (for example, the occupants have been observed entering the forest). The Forest Service invites those who feel they have been cited unjustly to write to an address on the citation to appeal. This determination was made after a large number of incidents occurred where property owners were cited for parking on their own property, in communities completely contained in the San Bernardino National Forest.
Passes may be purchased for annual or day use online or from visitor centers and local merchants. [4] Violators usually receive a "Notice of Noncompliance" and may clear the notice by purchasing a pass after the violation, paying online, or sending in a check or money order to the address in the envelope provided. Punishment of noncompliant individuals has been rare. In theory, use of the forests for non-recreational, First Amendment purposes does not require an Adventure Pass. In addition, using the restroom, stretching, or taking a picture is not a violation.
After passage of the Recreational Enhancement Act in 2004, Adventure Passes are now only required at designated High Impact Recreational Areas. However, in fact most areas that previously required a parking pass still require one. To avoid a fine, a wise hiker will telephone a Forest Service office or check the maps of High Impact Recreational Areas online of the individual forests to determine in advance his or her permit needs, since adequate signage pertaining to the need for an Adventure Pass is not yet common. Although supposedly many areas do not require the pass, most of these locations are less convenient to populated areas and can be accessed only from areas that do require a pass.
Fees collected via purchases of the Adventure Pass/Notice of Required Fee help directly fund the recreation program on each of the forests involved which includes purchasing trash bags, toilet paper, paint, wood for picnic tables, campfire rings, stoves, etc as well as salary funding to hire rangers to care for the forest, clean bathrooms, pick up trash, answer visitor questions, enforce regulations, and serve the public. The proceeds from these fees stay local and do not go back into a central, national fund. [5]
The continued collection of fees for use of the National Forest Lands remains controversial since the 9th circuit court of appeals ruled in February 2012 in the case Adams v. U.S. Forest Service, that "The Federal Lands Recreation Enhancement Act ("REA")", the authority under which the fee structure was enacted, "prohibits the United States Forest Service from charging fees "[s]olely for parking". In spite of this clear prohibition, what many consider to be "parking only" fees are still required at numerous locations in the San Bernardino and Angeles National Forests as well as other National Forest Locations. The ruling stated that while fees are allowed in certain instances, the "fee" sites must conform to the following requirements as listed below:
The Forest Service "maintains that the latter part of § 6802(d)(1)(A), which prohibits fees "solely for . . . picnicking along roads or trailsides," clearly permits fees for road or trailside picnics that take place within a larger area (delineated by the Forest Service) if that larger area offers amenities".
The Court rejected such an interpretation of the REA statute stating:
"Because this reading is so illogical, we will consider another interpretation of the agency's position. Perhaps the Forest Service is really saying that a fee is "[s]olely for parking" when imposed in a location where a visitor has no option to do something else, whether or not that "something else" is an amenity required by the statute."
The Court further went on to illustrate:
"Consider what would happen if a restaurant-goer inspected his bill and noticed an unexpected charge. If told that the fee was for ten bottles of wine that the patron's group neither ordered nor drank, the patron would rightly be outraged. He would not find much solace in a waiter's explanation that the wine cellar contained ten bottles, which the patron could have ordered if he wished."
The Court clarified the motive behind such reasoning:
"By ignoring the plain text, the Forest Service arrives at an interpretation that would enable an end-run around the clear statutory restrictions. If the REA gave the agency complete discretion to dictate a fee's so-called purpose, then the agency could entirely evade the prohibition on parking fees by simply declaring that its fees are "for" something else too. At any of the places where subsection (f) contemplates recreation fees, it is possible for a visitor to do something more than park a car—take photos of a volcano, make a cell phone call, chew a piece of gum—and a visitor must use a facility or service to be subject to a subsection (g) fee. Therefore, the agency could simply say that its parking fee is also "for" those other activities. Because the REA has a plain meaning that does not lead to an absurd result, we have no need to afford deference to the agency's competing, nonsensical interpretation."
The court then concluded:
"...the REA unambiguously prohibits the Forest Service from charging fees... for recreational visitors who park a car, then camp at undeveloped sites, picnic along roads or trailsides, or hike through the area without using the facilities and services." [8]
In spite of this ruling the fees continue to be collected.
Campsite, campground, and camping pitch are all related terms regarding a place used for camping. The usage differs between British English and American English.
The Angeles National Forest (ANF) of the U.S. Forest Service is located in the San Gabriel Mountains and Sierra Pelona Mountains, primarily within Los Angeles County in southern California. The ANF manages a majority of the San Gabriel Mountains National Monument.
The Conecuh National Forest in southern Alabama covers 83,000 acres (340 km2), along the Alabama - Florida line in Covington and Escambia counties. Topography is level to moderately sloping, broad ridges with stream terraces and broad floodplains.
Delnor-Wiggins Pass State Park is a Florida state park located on a barrier island on Florida's southwest coast near Naples, Florida, 6 miles west of I-75 in North Naples. The Cocohatchee River and the Gulf of Mexico are accessible from the park, which contains a hard-bottom reef.
The Sam Houston National Forest, one of four National Forests in Texas, is located 50 miles north of Houston. The forest is administered together with the other three United States National Forests and two National Grasslands located entirely in Texas, from common offices in Lufkin, Texas. The units include Angelina, Davy Crockett, Sabine, and Sam Houston National Forests, plus Caddo National Grassland and Lyndon B. Johnson National Grassland. There are local ranger district offices located in New Waverly. It is located in portions of three Texas counties including Montgomery, San Jacinto, and Walker.
The Angeles National Forest Fire Lookout Association ("ANFFLA") is a non-profit 501(c)(3) organization of citizen volunteers dedicated to the preservation, restoration and operation of the fire lookout towers in the Angeles National Forest, Los Angeles County, and other Southern California areas. The organization works in partnership with the federal, state, county and city agencies to meet these goals.
Dunn State Park is a public recreation area surrounding a 20-acre (8.1 ha) pond in Gardner, Massachusetts. The state park covers 132 acres (53 ha) and is managed by the Department of Conservation and Recreation.
Chantry Flat is a designated "Recreation Area" within the Angeles National Forest, about three miles (5 km) into Big Santa Anita Canyon, and is closely associated with the towns of Arcadia and Sierra Madre, CA. The flat itself houses a large public picnic area, and is the starting point for several historic trails of the San Gabriel Mountains, including the 28.5-mile (45.9 km) Gabrielino Trail. The US Forest Service estimates the road to Chantry as the third busiest entry into the Angeles, next to CA State Highways 2 and 39.
Sliding Rock is a waterfall in Western North Carolina, located near Brevard, so named because visitors can slide all the way down the waterfall into the plunge pool below. The plunge pool is around 8 feet deep in the middle, with a strong churning river current, so users must be able to swim or wear a life vest. The water in the river and the plunge pool remains near 55 degrees Fahrenheit year round. Sliding Rock is a small slide-type waterfall on Looking Glass Creek, in the Pisgah National Forest, near Brevard, North Carolina. It has a gentle slope and is about 60 feet long, ending in a large, deep pool at the bottom.
American Fork Canyon is a canyon in the Wasatch Mountains of Utah, United States. The canyon is famous for the Timpanogos Cave National Monument, which resides on its south side. It is named after the American Fork River, which runs through the bottom of the canyon.
Colt Creek State Park is a Florida State Park in Central Florida, 16 miles (26 km) north of Lakeland off of State Road 471. This 5,067 acre park nestled within the Green Swamp Wilderness Area and named after one of the tributaries that flows through the property was opened to the public on January 20, 2007. Composed mainly of pine flatwoods, cypress domes and open pasture land, this piece of pristine wilderness is home to many animal species including the American bald eagle, Southern fox squirrel, gopher tortoise, white-tailed deer, wild turkey and bobcat.
The Gateway State Trail is a multi-use recreational rail trail in the U.S. state of Minnesota, running 18 miles (29 km) from Saint Paul to Pine Point Regional Park in Stillwater. It runs through urban landscapes of eastern Saint Paul in Ramsey County and rural farmland and forests in Washington County. It was designated a National Recreation Trail in 2002.
National Park Service rangers are among the uniformed employees charged with protecting and preserving areas set aside in the National Park System by the United States Congress and the President of the United States. While all employees of the agency contribute to the National Park Service mission of preserving unimpaired the natural and cultural resources set aside by the American people for future generations, the term "park ranger" is traditionally used to describe all National Park Service employees who wear the uniform. Broadly speaking, all National Park Service rangers promote stewardship of the resources in their care—either voluntary stewardship via resource interpretation, or compliance with statute or regulation through law enforcement. These comprise the two main disciplines of the ranger profession in the National Park Service.
Big Bear Discovery Center is a regional visitor center and nature center, located in the Big Bear Valley of the San Bernardino Mountains, and within the San Bernardino National Forest, in San Bernardino County, southern California. It is in the Mountaintop Ranger District Office complex of the National Forest.
Lake Bardwell is a lake in Ellis County, Texas. The lake was constructed by the United States Army Corps of Engineers in 1965. Lake Bardwell is not used for military operations, and is accessible to the public for recreational purposes; it has seven facilities, but the state public ramp is closed.
National Parks are a legally-defined type of protected area of Brazil. The first parks were created in the 1930s with other parks being gradually added, typically protecting a natural monument such as a waterfall or gorge near to a coastal population centre. At least two early parks were later submerged by hydroelectric reservoirs. The first park in the Amazon rainforest was inaugurated in 1974. Today the national parks cover a huge area, particularly in the Amazon. However, many of them suffer from outstanding claims for compensation from former owners or users of the land, and many lack the management plans, physical infrastructure and personnel needed to support public visits. The responsible government agency does not have the capacity to provide services such as food and drink, souvenir sales and guided tours, and bureaucracy has delayed letting the private sector bid on providing such services.
Mount Ascutney State Park is a state park in the U.S. state of Vermont. The park entrance is located along Vermont Route 44-A near the town of Windsor in Windsor County. Operated by the Vermont Department of Forests, Parks and Recreation, a significant portion of the park is listed on the National Register of Historic Places.
