Paul Daniel Dinakaran Premkumar (born 9 May 1950) served as the Chief Justice of the Sikkim High Court. He resigned from the post following allegations of corruption and subsequent removal proceedings. [2]
P.D Dinakaran was born in a Dalit family at Arakkonam,North Arcot (now Vellore District). [4] He did his schooling and then attended the Madras Christian College,Chennai and studied chemistry. He obtained his Masters in Political Science and Public Administration and Bachelor of Law Degree from Madras Law College. [3]
He started his career in Madras High Court. He also practised in the State and Central Administrative Tribunals at Madras. He served as Legal Adviser and Standing Counsel for Pondicherry University and for several State owned Corporations,such as Tamil Nadu State Marketing Corporation (TASMAC),Tamil Nadu Sugar Corporation,Tamil Nadu Sugar Federation Limited,Tamil Nadu Co-operative Milk Producers Federation (Aavin). [3]
He was also standing counsel for various religious institutions,such as Churches of South India,Madras Diocese and Coimbatore Diocese and Sri Subramania Swami Temple,Tiruttani and for several Local Bodies,Educational Institutions,Teachers' Federations,Agriculturists Associations,Marketing Societies and Social Organisations. [3]
On 28 August 2009,the Supreme Court of India announced that Dinakaran would be elevated to a Supreme Court Judge,but this was halted due to allegations of corruption and surrounding controversy. [5] Dinakaran subsequently refused to go on leave when asked by Chief Justice of India K.G. Balakrishnan and was transferred to the Sikkim High Court. [6] On 29 July 2011 he resigned from the post of Sikkim High Court Chief Justice. He was facing impeachment allegedly on the charges of corruption and judicial misconduct. [2]
In September 2009,allegations were made against Dinakaran by several members of the Bar Council of India including Former Union Law Minister Ram Jethmalani [7] stating that he had huge assets and land acquisitions in his Hometown Arakkonam more than what was fixed by the Tamil Nadu Land reforms. The lawyers requested Chief Justice of India and Union Law Minister not to appoint Dinakaran as Supreme Court Judge and initiate an enquiry process regarding the allegation. The members wrote a letter to President Pratibha Patil,Prime Minister Manmohan Singh and Union Law Minister to intervene in this matter. [8] [9]
Justice Dinakaran had not been performing any judicial functions since December 2009 when the Chairman of the Rajya Sabha admitted a motion seeking his removal on charges of corruption and abuse of his judicial office. [10] The Supreme Court collegium headed by Chief Justice K.G. Balakrishnan had decided to replace Justice Dinakaran with Uttarakhand High Court Chief Justice JS Khehar, [11] and recommended transfer of Dinakaran to the Sikkim High Court. [12] Later,Prime Minister Manmohan Singh questioned about the desirability of shifting Chief Justices. The Law Ministry returned the file to the collegium for consideration afresh. As a result,the collegium,headed by the then incumbent Chief Justice of India,S.H. Kapadia,met and reconsidered the whole issue and stuck to the earlier decision to shift the Chief Justices. [13] The Sikkim Bar Association opposed the transfer of Dinakaran to the Sikkim High Court and asked the Supreme Court to reconsider the proposal,(which requires approval from Indian President Pratibha Patil). The Sikkim Bar Association president D R Thapa had asked "How come the person be fit to be discharge judicial duties in one state if he has not been found worthy of doing the same in another state?" [14] [15]
Facing impeachment on charges of corruption and judicial misconduct,he resigned from the post of Sikkim high court Chief Justice on 29 July 2011 expressing "lack of faith and confidence" in the three-member inquiry Committee probing charges against him. [2]
"Before demitting office,I must confess with a very heavy heart that in spite of my constitutional position,I have been denied fair opportunity to defend myself and my reputation by the Judges Inquiry Committee," he said in a two-page letter of resignation sent to President Pratibha Patil. [2]
Justice Dinakaran,a Dalit,also said he had a "sneaking suspicion" that his "misfortune" was because of the circumstances of his birth in the socially oppressed and underprivileged section of the society. [2]
This opinion of his at the time of resignation is surprising to say the least because of following facts:
Mysteriously,on 4 August 2011,Justice Dinakaran had a "change of heart" and wrote to the law ministry seeking to withdraw his resignation. But the ministry rejected his request. [17] However,his pre-emptive resignation did manage to scuttle the probe against him as the chairman of Rajya Sabha,Hamid Ansari,quietly buried the inquiry committee citing Dinakaran's resignation in July. [18]
On 15 January 2012,it became public through an RTI query that Justice Dinakaran along with his other colleague facing similar accusations Justice Soumitra Sen will keep getting their post-retirement benefits,even though they resigned ahead of impeachment proceedings against them,as there are no Constitutional or statutory provisions restricting their entitlements in such a scenario. [19]
The All India Anna Dravida Munnetra Kazhagam is an Indian regional political party with great influence in the state of Tamil Nadu and the union territory of Puducherry. It is a Dravidian party founded by the former chief minister of Tamil Nadu M. G. Ramachandran (M.G.R.) at Madurai on 17 October 1972 as a breakaway faction from the Dravida Munnetra Kazhagam after M. Karunanidhi expelled him from the party for demanding an account as the party treasurer. The party is adhering to the policies of socialism and secularism based on the principles of C. N. The party has won a seven-time majority in the Tamil Nadu Legislative Assembly and has emerged as the most successful political outfit in the state's history. It is currently the main opposition party in the Tamil Nadu Legislative Assembly.

Palaniappan Chidambaram,better known as P. Chidambaram,is an Indian politician and lawyer who currently serves as Member of Parliament,Rajya Sabha. He served as the Chairman of the Parliamentary Standing Committee on Home Affairs from 2017 to 2018. He also served as Interim Deputy Leader of Opposition in Rajya Sabha from 2022 to 2023 under Mallikarjun Kharge.
M. Fathima Beevi was an Indian judge who was a justice of the Supreme Court of India. Appointed to the apex Court in 1989,she became the first female judge to be a part of the Supreme Court of India,and the first Muslim woman to be appointed to any of the higher judiciaries in the country. On her retirement from the court,she served as a member of the National Human Rights Commission and later as the Governor of the Indian state of Tamil Nadu from 1997 to 2001. In 2023,she was honoured with Kerala Prabha Award,the second-highest honour given by the Government of Kerala. In the 2024 honours list,she was posthumously awarded the Padma Bhushan.
Dr. Ambedkar Government Law College,commonly known by its former name Madras Law College,is a law school,located in Chennai (Madras),Tamil Nadu,India. It is also referred to as Government Law College or GLC,Chennai. It was established in 1891. It was renamed in 1990,as Dr. Ambedkar Government Law College,by the Government of Tamil Nadu in commemoration of the birth centenary of B. R. Ambedkar. In 1997,the Government of Tamil Nadu passed an Act which brought the college under the wings of the newly established Tamil Nadu Dr. Ambedkar Law University,splitting the college from the University of Madras.
The Chief Election Commissioner of India (CEC) heads the Election Commission of India,a body constitutionally empowered to conduct free and fair elections. An election commissioner is appointed by the President of India on the recommendation of a three member selection committee headed by the Prime Minister of India and senior most election commissioner is appointed as chief election commissioner. A Lokpal is an anti-corruption authority or body of ombudsman who represents the public interest in the Republic of India. The current Chairperson of Lokpal is Ajay Manikrao Khanwilkar. The Lokpal has jurisdiction over central government,anyone who is or has been Prime Minister,or a Minister in the Union government,or a Member of Parliament,as well as officials of the Union government under Groups A,B,C and D. Also covered are chairpersons,members,officers and directors of any board,corporation,society,trust or autonomous body either established by an Act of Parliament or wholly or partly funded by the Centre. It also covers any society or trust or body that receives foreign contributions above ₹10 lakh. to inquire into allegations of corruption against its public functionaries and for matters connected to corruption. The Lokpal and Lokayuktas Act was passed in 2013 with amendments in parliament,following the Jan Lokpal movement led by Anna Hazare in 2010. The Lokpal is responsible for enquiring into corruption charges at the national level while the Lokayukta performs the same function at the state level. The age of Lokpal on the date of assuming office as the chairperson or a member should not be less than 45 years.
The Lokayukta is the Indian Parliamentary Ombudsman,executed into power,through and for,each of the State Governments of India. It is brought into effect in a state after passing the Lokayukta Act in the respective state legislature,and a person of reputable background is nominated for the post. The post was created to quickly address the working of the government or its administration. Once appointed,Lokayukta cannot be dismissed or transferred by the government,and can only be removed by passing an impeachment motion by the state assembly.
Veeraswami Ramaswami is an Indian retired judge of the Supreme Court of India and the first judge against whom removal proceedings were initiated in independent India.
Justice S. Ashok Kumar was a judge of the Madras High Court and the Andhra Pradesh High Court in India.
Soumitra Sen is a former judge of the Calcutta High Court. He was the first judge in independent India whose removal motion was passed in Rajya Sabha for misappropriation of funds.
Jagdish Singh Khehar is a former senior advocate and a former judge,who served as the 44th Chief Justice of India in 2017. Khehar is the first chief justice from the Sikh community. He has been a judge in Supreme Court of India from 13 September 2011 to 27 August 2017 upon superannuation. He served for a brief period but gave many landmark judgements such as the Triple Talaq and the Right to Privacy verdict. He was succeeded by Justice Dipak Misra.
The Indian Judicial Collegium system,where existing judges appoint judges to the nation's constitutional courts,has its genesis in,and continued basis resting on,three of its own judgments made by Supreme Court judges,which are collectively known as the Three Judges Cases. The collegium system has often been alleged to have caste bias due to the lack of representation of marginalised communities,i.e.,OBCs,SCs and STs,in the Supreme Court and high courts.
Puspanathan Wilson is a Senior Advocate in India,who served as the Additional Solicitor General of India between August 2012 and May 2014,and the Additional Advocate General of the State of Tamil Nadu between August 2008 and May 2011.
Jayaram Jayalalithaa,commonly referred to as Jayalalithaa,was an Indian politician who was the six time Chief Minister of the Indian state of Tamil Nadu. She was initially convicted for misusing her office during her tenure of 1991–96. Subramanian Swamy was the chief petitioner. Some of the allegations involved spending on her foster son's lavish marriage in 1996 and her acquisition of properties worth more than ₹66.65 crore,as well as jewellery,cash deposits,investments and a fleet of luxury cars. This was the first case where a ruling chief minister had to step down on account of a court sentence. Ultimately,in May 2015,her conviction was overturned,she was acquitted of all charges,and she then died before the Supreme Court of India reviewed the case in 2017.
Justice Chinnaswamy Swaminathan Karnan is a retired Indian judge. In May 2017,he was sentenced to six months of imprisonment by the Supreme Court of India,holding him guilty of contempt of court. He was the first Indian High Court judge to be punished for contempt while in office but was arrested and jailed after retirement.
Vijaya Kamlesh Tahilramani is a former Indian judge and prosecutor,who last served as the chief justice of the Madras High Court. Previously,as a judge of the Bombay High Court,she notably upheld the conviction of several persons for the rape of a pregnant Muslim woman during the 2002 Gujarat riots,chastising investigative authorities for their inaction in the matter,and also refused parole for those convicted in the 1993 Bombay bombings. She retired in 2019,after refusing to accept a controversial transfer from the Madras High Court to the Meghalaya High Court.
Bengaluru Venkataramiah Nagarathna is a judge of the Supreme Court of India. She served as a judge of the Karnataka High Court from 2008 to 2021. Her father,E. S. Venkataramiah,was Chief Justice of the Supreme Court of India in 1989.
The High Court of Judicature at Madras is a High Court located in Chennai,India. It has appellate jurisdiction over the state of Tamil Nadu and the union territory of Puducherry. It is one of the oldest high courts of India along with Calcutta High Court in Kolkata and Bombay High Court in Mumbai. The Madras High Court is one of four charter high courts of colonial India established in the four Presidency Towns of Madras,Bombay,Allahabad and Calcutta by letters patent granted by Queen Victoria,dated 26 June 1862. It exercises original jurisdiction over the city of Chennai,as well as extraordinary original jurisdiction,civil and criminal,under the letters patent and special original jurisdiction for the issue of writs under the Constitution of India. Covering 107 acres,the court complex is one of the largest in the world,second only to the Supreme Court of the United Kingdom. The four-storey administrative building attracts hundreds of litigants every day.
Shanmughasundaram Mohan was former judge of the India Supreme Court and former acting governor of Karnataka state. He authored 11 books in English and seven books in Tamil.
