The United Federal Workers of America (UFWA) was an American labor union representing federal government employees which existed from 1937 to 1946. It was the first union with this jurisdiction established by the Congress of Industrial Organizations (a national labor federation). In 1946 it merged with other unions to form the influential United Public Workers of America. The union challenged the constitutionality of the Hatch Act of 1939, which led to the Supreme Court decision in United Public Workers v. Mitchell , 330 U.S. 75 (1947).
The union is sometimes confused with the United Public Workers of America, its successor union.
In 1937, the Congress of Industrial Organizations (CIO) formed a new union for U.S. government employees, the United Federal Workers of America (UFWA), from local unions which had disaffiliated from the American Federation of Labor-affiliated American Federation of Government Employees (AFGE). [1] The UFWA's membership, however, remained static (as did the membership of nearly all federal government unions during the Great Depression of the 1930s, when people were grateful for work.). [1] Much of the UFWA leadership was leftist. The leadership was militant in its advocacy of the rights of its members, and most of the national and local union leadership advocated leftist ideals; associated with left-wing intellectuals, activists, and political people; and supported left-wing organizations. [2] This led many politicians and others to believe the organization was Communist-controlled. [2]
The political leanings of the UWFA led to passage of two pieces of legislation intended to restrict its political activities. [2] In June 1938, Congress passed a rider to appropriations legislation that prevented the federal government from making payments (such as salaries) to any person or organization which advocated the overthrow of the federal government (as many communist organizations at the time proposed). [3] In 1939, Congress passed the Hatch Act of 1939, which restricted political campaign activities by federal employees. A provision of the Hatch Act made it illegal for the federal government to employ anyone who advocated the overthrow of the federal government. [3] The UFWA hired lawyer Lee Pressman to challenge the constitutionality of the Hatch Act. [4]
On April 25, 1946, the State, County, and Municipal Workers of America (SCMWA) merged with the UFWA to form the United Public Workers of America. [5] [6] [7] The impetus for the merger was the relative failure of the UFWA to attract new members, and SCMWA essentially absorbed the smaller federal union. [8]
The union's long-standing lawsuit against the Hatch Act of 1939 (with Lee Pressman representing the UFW) finally reached the Supreme Court in 1947. In United Public Workers v. Mitchell , 330 U.S. 75 (1947), the Supreme Court of the United States upheld the Act. Writing for the majority, Associate Justice Stanley Forman Reed argued that the Hatch Act did not infringe on the First Amendment guarantees of free speech and free association but rather on rights guaranteed by the Ninth Amendment (guaranteeing non-enumerated rights to the people) and Tenth Amendment (guaranteeing non-enumerated rights to the states). [9] These rights were not absolute, and could be subordinated to the "elemental need for order" without which all rights ceased to function. [9] Additionally, the non-enumerated rights of the Ninth and Tenth Amendments were subordinate to the enumerated rights granted to the federal government by the Constitution. [9]
Reed upheld the Hatch Act as a legitimate exercise of the enumerated rights of the federal government. [9] The decision in United Public Workers v. Mitchell relied heavily on the "doctrine of privilege," a legal doctrine that held that public employment was a privilege (not a right) and subsequently significant restrictions could be placed on public employees that could not be constitutionally tolerated in the private sector. [10] United Public Workers v. Mitchell proved to be the last gasp of the doctrine of privilege.
The Supreme Court explicitly rejected the doctrine in Wieman v. Updegraff , 344 U.S. 183 (1952). A broad number of high court decisions in areas such as nonpartisan speech, due process, search and seizure, the right to marry, the right to bear children, equal protection, education, and receipt of public benefits over the next two decades continued to undermine the doctrine. [11] Although the Supreme Court later reaffirmed Mitchell in 1973 in Civil Service Comm'n v. Letter Carriers , 413 U.S. 548 (1973), it did so on the grounds that permitting public employees to engage in political activity was dangerous. [12]
The National Labor Relations Act of 1935, also known as the Wagner Act, is a foundational statute of United States labor law that guarantees the right of private sector employees to organize into trade unions, engage in collective bargaining, and take collective action such as strikes. Central to the act was a ban on company unions. The act was written by Senator Robert F. Wagner, passed by the 74th United States Congress, and signed into law by President Franklin D. Roosevelt.
The Labor Management Relations Act, 1947, better known as the Taft–Hartley Act, is a United States federal law that restricts the activities and power of labor unions. It was enacted by the 80th United States Congress over the veto of President Harry S. Truman, becoming law on June 23, 1947.
Adair v. United States, 208 U.S. 161 (1908), was a US labor law case of the United States Supreme Court which declared that bans on "yellow-dog" contracts were unconstitutional. The decision reaffirmed the doctrine of freedom of contract which was first recognized by the Court in Allgeyer v. Louisiana (1897). For this reason, Adair is often seen as defining what has come to be known as the Lochner era, a period in American legal history in which the Supreme Court tended to invalidate legislation aimed at regulating business.

Organized unions and their umbrella labor federations such as the AFL–CIO and citywide federations have competed, evolved, merged, and split against a backdrop of changing values and priorities, and periodic federal government intervention.

United States labor law sets the rights and duties for employees, labor unions, and employers in the US. Labor law's basic aim is to remedy the "inequality of bargaining power" between employees and employers, especially employers "organized in the corporate or other forms of ownership association". Over the 20th century, federal law created minimum social and economic rights, and encouraged state laws to go beyond the minimum to favor employees. The Fair Labor Standards Act of 1938 requires a federal minimum wage, currently $7.25 but higher in 29 states and D.C., and discourages working weeks over 40 hours through time-and-a-half overtime pay. There are no federal laws, and few state laws, requiring paid holidays or paid family leave. The Family and Medical Leave Act of 1993 creates a limited right to 12 weeks of unpaid leave in larger employers. There is no automatic right to an occupational pension beyond federally guaranteed Social Security, but the Employee Retirement Income Security Act of 1974 requires standards of prudent management and good governance if employers agree to provide pensions, health plans or other benefits. The Occupational Safety and Health Act of 1970 requires employees have a safe system of work.
Lee Pressman was a labor attorney and earlier a US government functionary, publicly alleged in 1948 to have been a spy for Soviet intelligence during the mid-1930s, following his recent departure from Congress of Industrial Organizations (CIO) as a result of its purge of Communist Party members and fellow travelers. From 1936 to 1948, he represented the CIO and member unions in landmark collective bargaining deals with major corporations including General Motors and U.S. Steel. According to journalist Murray Kempton, anti-communists referred to him as "Comrade Big."
In the United States Senate, the La Follette Civil Liberties Committee, or more formally, Committee on Education and Labor, Subcommittee Investigating Violations of Free Speech and the Rights of Labor (1936–1941), began as an inquiry into a National Labor Relations Board (NLRB) investigation of methods used by employers in certain industries to avoid collective bargaining with unions.
Labor unions represent United States workers in many industries recognized under US labor law since the 1935 enactment of the National Labor Relations Act. Their activity centers on collective bargaining over wages, benefits, and working conditions for their membership, and on representing their members in disputes with management over violations of contract provisions. Larger labor unions also typically engage in lobbying activities and electioneering at the state and federal level.
The Blue Eagle at Work: Reclaiming Democratic Rights in the American Workplace is a legal treatise written by Charles J. Morris which analyzes collective bargaining under the National Labor Relations Act (NLRA), the federal statute governing most private sector labor relations in the United States. Published in 2005 by Cornell University Press, the text claims that the NLRA guarantees that employees under that Act have the right to bargain collectively through minority unions—but only on a members-only basis—in workplaces where there is not an established majority union, notwithstanding that the present practice and general understanding of the law is that only majority-union employees are entitled to engage in collective bargaining on an exclusivity basis. Contracts resulting from such minority-union bargaining would apply to union members only, not to other employees.
NLRB v. Mackay Radio & Telegraph Co., 304 U.S. 333 (1938), is a United States labor law case of the Supreme Court of the United States which held that workers who strike remain employees for the purposes of the National Labor Relations Act (NLRA). The Court granted the relief sought by the National Labor Relations Board, which sought to have the workers reinstated by the employer. However, the decision is much better known today for its obiter dicta in which the Court said that an employer may hire strikebreakers and is not bound to discharge any of them if or when the strike ends.
Communications Workers of America v. Beck, 487 U.S. 735 (1988), is a decision by the United States Supreme Court which held that, in a union security agreement, unions are authorized by statute to collect from non-members only those fees and dues necessary to perform its duties as a collective bargaining representative. The rights identified by the Court in Communications Workers of America v. Beck have since come to be known as "Beck rights", and defining what Beck rights are and how a union must fulfill its duties regarding them is an active area of modern United States labor law.
The United Public Workers of America (1946–1952) was an American labor union representing federal, state, county, and local government employees. The union challenged the constitutionality of the Hatch Act of 1939, which prohibited federal executive branch employees from engaging in politics. In United Public Workers of America v. Mitchell, 330 U.S. 75 (1947), the Supreme Court of the United States upheld the Hatch Act, finding that its infringement on the Constitutional rights was outweighed by the need to end political corruption. The union's leadership was Communist, and in a famous purge the union was ejected from its parent trade union federation, the Congress of Industrial Organizations, in 1950.
The State, County, and Municipal Workers of America (SCMWA) was an American labor union representing state, county, and local government employees. It was created by the Congress of Industrial Organizations (CIO) in 1937 along with United Federal Workers of America. SCMWA's leaders Abram Flaxer and Henry Wenning had been leaders of the Association of Workers of Public Relief Agencies (AWPRA) in New York City prior to the formation of SCMWA.

National Association of Letter Carriers, 413 U.S. 548 (1973), is a ruling by the United States Supreme Court which held that the Hatch Act of 1939 does not violate the First Amendment, and its implementing regulations are not unconstitutionally vague and overbroad.

The Congress of Industrial Organizations (CIO) was a federation of unions that organized workers in industrial unions in the United States and Canada from 1935 to 1955. Originally created in 1935 as a committee within the American Federation of Labor (AFL) by John L. Lewis, a leader of the United Mine Workers (UMW), and called the Committee for Industrial Organization. Its name was changed in 1938 when it broke away from the AFL. It focused on organizing unskilled workers, who had been ignored by most of the AFL unions.
The first-ever "political action committee" in the United States of America was the Congress of Industrial Organizations – Political Action Committee or CIO-PAC (1943–1955). What distinguished the CIO-PAC from previous political groups was its "open, public operation, soliciting support from non-CIO unionists and from the progressive public. ... Moreover, CIO political operatives would actively participate in intraparty platform, policy, and candidate selection processes, pressing the broad agenda of the industrial union movement."
Abram Flaxer (1904-1989) was an American union leader who founded the State, County, and Municipal Workers of America (SCMWA), which merged with the United Federal Workers of America (UFWA) to form the United Federal Workers of America (UFWA), of which he became president.
