Neptune's Navy believe themselves to be environmentalist, while the ICRW and the Japanese government have labeled them terrorists. [4] And pirates off the coast of Somalia claim to be "freedom fighters", defending Somali waters from pollution and foreign access. [3]
Some authors in maritime security point to the bombing of the USS Cole in 2000 as a pivotal moment of maritime terrorism. This bombing preceded the 9/11 attacks as an example of a direct and obviously malicious attack against a state by a non-state actor. [1] [5] The bombings also became crucial for private security companies: in the wake of the attack, Blackwater (now Academi) signed its first contract with US military. [6] Terrorist non-state actors at sea have also been linked with pirates. NATO concluded in 2010 that terrorism could be linked with piracy and illegal fishing. [7] This has been criticized however, by other authors, who believe a relation[ clarification needed ] between pirates and terrorists brings no mutual benefits. [1]
Actors such as Academi have been, or are in possession of, vessels such as the NOAAS McArthur, but most provide services that deliver armed personnel on board cargo ships. [8] Some authors argue that because private security companies are composed largely of retired military personnel from industrialized/western countries, and because they also collaborate with the same countries, they are perceived as merely an extension tool for liberal governments to get involved in conflicts, or at the very least, they function on a basis of legitimacy borrowed from their partnered countries. [8] [9] This might imply that while they are technically non-state actors, they benefit from being perceived as directly related to a state.

A failed state is a state that has lost its ability to fulfill fundamental security and development functions, lacking effective control over its territory and borders. Common characteristics of a failed state include a government incapable of tax collection, law enforcement, security assurance, territorial control, political or civil office staffing, and infrastructure maintenance. When this happens, widespread corruption and criminality, the intervention of state and non-state actors, the appearance of refugees and the involuntary movement of populations, sharp economic decline, and military intervention from both within and outside the state are much more likely to occur.

An insurgency is a violent, armed rebellion by small, lightly armed bands who practice guerrilla warfare against a larger authority. The key descriptive feature of insurgency is its asymmetric nature: small irregular forces face a large, well-equipped, regular military force state adversary. Due to this asymmetry, insurgents avoid large-scale direct battles, opting instead to blend in with the civilian population where they gradually expand territorial control and military forces. Insurgency frequently hinges on control of and collaboration with local populations.

Maritime security is of increasing concern to the global shipping industry, where there are a wide range of security threats and challenges. Some of the practical issues clustered under the term of maritime security include crimes such as piracy, armed robbery at sea, trafficking of people and illicit goods, illegal fishing or marine pollution. War, warlike activity, maritime terrorism and interstate rivalry are also maritime security concerns.
Piracy in the Gulf of Guinea affects a number of countries in West Africa as well as the wider international community. By 2011, it had become an issue of global concern. Pirates in the Gulf of Guinea are often part of heavily armed criminal enterprises, who employ violent methods to steal oil cargo. In 2012, the International Maritime Bureau (IMB), Oceans Beyond Piracy and the Maritime Piracy Humanitarian Response Program reported that the number of vessels attacks by West African pirates had reached a world high, with 966 seafarers attacked during the year. According to the Control Risks Group, pirate attacks in the Gulf of Guinea had by mid-November 2013 maintained a steady level of around 100 attempted hijackings in the year, a close second behind the Strait of Malacca in Southeast Asia.
Piracy off the coast of Somalia occurs in the Gulf of Aden, Guardafui Channel, and Somali Sea, in Somali territorial waters and other surrounding places and has a long troubled history with different perspectives from different communities. It was initially a threat to international fishing vessels during the early 2000s, only to rapidly escalate and expand to international shipping during the War in Somalia (2006–2009).

Triple Canopy, Inc., is an American private security company and private military company (PMC) that provides armed security, mission support, and risk management services to corporate and government clients. The firm was founded in May 2003 by United States Army Special Forces veterans, including former Delta Force operators. In June 2014, the firm merged with rival security contracting firm Academi, formerly Blackwater, to form Constellis Group, with Craig Nixon, the former CEO of Academi, becoming the CEO of Constellis Group, and training facilities being consolidated at the existing Academi training facility in North Carolina. It was staffed by, among others, a number of former Army Special Operations personnel, Green Berets, Rangers, SEALs, MARSOC Raiders, other special operations personnel, and several law enforcement officers. At the time of the merger, over 5,000 employees were working for Triple Canopy.
Piracy in Somalia has been a threat to international shipping since the beginning of the country's civil war in the early 1990s. Since 2005, many international organizations have expressed concern over the rise in acts of piracy. Piracy impeded the delivery of shipments and increased shipping expenses, costing an estimated $6.6 to $6.9 billion a year in global trade in 2011 according to Oceans Beyond Piracy (OBP).

Throughout history and legal precedents, pirates have been defined as hostis humani generis, Latin for "the enemy of all mankind". The United Nations has codified much of the law in the United Nations Convention on the Law of the Sea (UNCLOS), which defines different types of piracy and ways to combat it.
Maritime terrorism in Southeast Asia refers to acts of extreme maritime violence committed with political motives within the Southeast Asian region. Despite seaborne terrorist attacks accounting for only 2% of all international terrorist incidents from 1978 to 2008, according to RAND's Terrorism Database, Southeast Asia has proven a hotbed of maritime terrorism. Due to the high frequency of pirates in the region, many Southeast Asian-based terrorist groups have appropriated piratical tactics in carrying out their violent political struggles. In 2003, the International Maritime Bureau reported that out of the 445 actual or attempted piratical attacks on merchant vessels, 189 occurred in Southeast Asia, which was more cases than either Africa or Latin America, with 121 attacks occurring in Indonesian waters and 35 attacks occurring in Malaysian and Singaporean waters. In 2004, while the number of actual and attempted attacks fell to 325, Southeast Asia remained at the top of the regional rankings, with 93 incidents occurring in Indonesian waters. Between 2014 and 2018, 242 attacks occurred in Southeast Asia, with the majority occurring in Indonesian waters. The most popular weapons of choice among Southeast Asian maritime terrorists have been explosive devices and firearms, which were used in roughly 60% of maritime attacks in the region.

Piracy kidnappings occur during piracy, when people are kidnapped by pirates or taken hostage. Article 1 of the United Nations International Convention against the Taking of Hostages defines a hostage-taker as "any person who seizes or detains and threatens to kill, to injure, or to continue to detain another person in order to compel a third party namely, a State, an international intergovernmental organization, a natural or Juridical person, or a group of people, to do or abstain from doing any act as an explicit or implicit condition tor the release of the hostage commits the offense of taking of hostages ("hostage-taking") within the meaning of this convention." Kidnappers often try to obtain the largest financial reward possible in exchange for hostages, but piracy kidnappings can also be politically motivated.
