The 2022 University of California academic workers' strike was a labor strike at all campuses of the University of California (UC) system, including the Lawrence Berkeley National Laboratory. On November 14, some 48,000 academic workers went on strike for better pay and benefits. [1] Led by the United Auto Workers (UAW) labor union, it was the largest strike in the United States in 2022; union organizers describe it as the largest strike in all of U.S. higher education. [1] [2]

In reaction to the strike, the UC reached tentative agreements with around 12,000 postdoctoral and academic researchers on November 29. On December 9, the contracts were ratified. On December 16, under mediation by Sacramento mayor Darrell Steinberg, the UC reached tentative agreements with around 36,000 academic student employees and student researchers, and the contracts were put to ratification votes by membership. On December 23, the union members voted to ratify both of the remaining contracts and end the strike. [3]

Background

University of California academic workers participating in the strike were organized in four bargaining units represented by three different United Auto Workers unions: Student Researchers United-UAW represents student researchers, UAW Local 2865 represents graduate tutors, teaching assistants and readers, and UAW Local 5810 represents postdoctoral and academic researchers. [4] Though it is primarily known for autoworkers, academic workers now represent a quarter of the UAW membership, 100,000 out of the 400,000 UAW members. [5]

Salaries and employee benefits

Graduate student workers in the University of California system made an average of $24,000 prior to the strike and asked for a base annual salary of $54,000 for graduate students and $70,000 for postdocs. [1] [6] In contrast, the UC proposed a 4–7% pay increase in the first year and 3% in each year after, claiming it would be within the top pay scale of top public research universities and comparable to private universities. [1]

Negotiations for new contracts between the unions and UC began in Spring 2021. [1] The Los Angeles Times described the unions' demands as wanting "significant pay increases, child-care subsidies, enhanced healthcare for dependents, longer family leave, public transit passes and lower tuition costs for international scholars". [1] Prior to the strike, both sides already came to an agreement on protections against bullying, the first-ever such protections in an academic worker contract. [4]

The unions filed 30 unfair labor practice charges with the Public Employment Relations Board, which has issued seven complaints. [7] These charges included unilaterally implementing changes without worker negotiation, bypassing the bargaining process, refusing to provide necessary information regarding it, and obstructing the process. [8] The UC maintains they have been negotiating "in good faith" and have "recognize[d] the contributions of [their] academic employees"; in addition, they assert that the UC Board of Regents have helped accommodate student housing needs since 2017 and will continue to "add about 25,000 student housing beds over the next five years." [9] [10]

Strike authorization votes were held by the UAW from October 26 to November 2, resulting in a vote to strike with 76% voter participation and more than 97% approval. [11] [8]

Workers began striking on November 14 as negotiations continue. [1] [4] The UC has asked for a third-party mediator, while the union stated it wants to continue bargaining instead of switching to mediation. [1]

On November 29, a tentative agreement was reached for the about 12,000 postdoctoral and academic researchers in UAW 5810. [12] The agreement includes a 20-23% increase in salary, four more weeks of paid parental and family leave, childcare subsidies, longer appointments, stronger bullying protections and transportation benefits. [13] Those workers would remain on strike in solidarity, but once the contract was ratified by rank-and-file members, they would be obligated not to do so. [12] [13] The contract was then ratified on December 9, with an overwhelming 89.4% approval from postdoctoral scholars and 79.5% approval from academic researchers. [14] [15] [16]

During a sit in on December 5 at the UC Office of the President in Sacramento, 17 workers were cited for trespassing. [17] Similarly, on December 7, ten academic workers from UC Los Angeles (UCLA) were arrested at a UC regent's office on trespassing charges. [18]

On December 9, the UC and the remaining bargaining units reached an agreement to involve a private mediator in order to move negotiations forward. [14] Before then, the UC and UAW had held over 60 bargaining sessions, with the UC having made seven formal requests for mediation. [19] Sacramento mayor Darrell Steinberg served as the mediator. [20]

On December 13, 14 protesters were arrested for sitting in during a UC Board of Regents meeting and refusing orders from the UC Police Department to disperse. [21]

On December 16, the 36,000 graduate student researchers and teaching assistants in SRU-UAW and UAW 2865 reached a tentative agreement with the university. [22] [23] Steinberg negotiated the deal at Sacramento City Hall. [24] Under the agreement, the workers would experience an increase in minimum pay from $23,250 to $34,000 for nine months of part-time work, which would provide the lowest-paid workers an 80% pay boost until May 31, 2025. [23] At UC Berkeley, UC San Francisco (UCSF), and UCLA, the minimum pay would increase to $36,500. [22] The agreement would also provide enhanced child care reimbursements, healthcare for dependents, and supplemental tuition for up to three years for eligible international student employees [22] [23] The agreement was left to the rank-and-file members for ratification, after which the strike would officially end. [23]

On December 23, the agreement between UAW 2865 and the university was ratified by 62% (a vote of 11,386 to 7,097), and the agreement between SRU-UAW and the university was ratified by 68% (a vote of 10,057 to 4,640). [25] The 2022 ratification vote had a historically high turnout for graduate student workers, with over 92% of approximately 36,000 eligible workers voting overall. In comparison, only 4,374 workers participated in the previous ratification vote in 2018, with 59% voting yes. [26] The 2022 strike ended with the ratification of these contracts.

Reactions

At UC Davis, the Teamsters Local 2010 and California Nurses Association spoke in solidarity with the academic workers. [4] The Council of UC Faculty Associations is also supported the strike. [4]

U.S. Senator Bernie Sanders and Congresswoman Alexandria Ocasio-Cortez both tweeted in support of the academic workers. [27] [28] A group of California members of the U.S. House of Representatives, including Katie Porter, sent a letter to the UC president expressing their support for the workers. [29]

The Los Angeles Times published an editorial in support of the workers before the strike began, concluding "...these academic workers play such a critical role and deserve to earn enough to pay for basic needs". [30] The California Coalition for Public Higher Education wrote an op-ed in CalMatters calling for the unions to agree to mediation, concerned about the overall impact to the UC budget if workers' demands were met. [31]

After the December 16 tentative agreement, Governor Gavin Newsom stated he was "relieved" by the deal but called the strike "a preview of things to come," as a state budget agreement that provided five years of annual increases to UC funding, he said, would most likely pay for the added costs pertaining to the agreements. [24]

Impact

The strike disrupted grading and classes right before final exams, as well as fully stopping most research. [32] [33] Some professors canceled classes and final exams in solidarity. [34] [35] Over 200 faculty members pledged to stop working, including withholding final grades, until the strike ends. [36] As well, several academic and grading policies at several universities were temporarily suspended or altered in response to the situation. [37] [38]

Two branches of the International Brotherhood of Teamsters approved about 53,000 United Parcel Service employees to not deliver packages to UC campuses for the duration of the strike. [6] Construction workers at UC Berkeley, who are members of the International Union of Operating Engineers, International Brotherhood of Electrical Workers and Laborers’ International Union of North America, paused their work in solidarity. [39] As a result, research laboratories at UC Berkeley were disrupted and had to shut down experiments due to shortage of materials. [40]

Graduate student employee unionization, or academic student employee unionization, refers to labor unions that represent students who are employed by their college or university to teach classes, conduct research and perform clerical duties. As of 2014, there were at least 33 US graduate employee unions, 18 unrecognized unions in the United States, and 23 graduate employee unions in Canada. By 2019, it is estimated that there were 83,050 unionized student employees in certified bargaining units in the United States. As of 2023, there were at least 156 US graduate student employee unions and 23 graduate student employee unions in Canada.

UAW Local 5810 was the labor union representing postdoctoral researchers and academic researchers at the University of California. It is an affiliate of the International Union, United Automobile, Aerospace and Agricultural Implement Workers of America (UAW) or AFL–CIO. It was merged into UAW Local 4811 in March 2024 when the UAW International Executive Board voted to approve the amalgamation of academic student employees, graduate student researchers and academic researchers and postdoctoral workers into UAW Local 4811. UAW Local 5810 was chartered in 2008. The stand-alone postdoctoral scholar contract and academic researcher contract negotiated between UC and UAW are notable for being the first of their kind in the United States, respectively.

The Graduate Teaching Fellows Federation (GTFF) is a graduate student union at the University of Oregon (UO) established in 1976 to represent graduate student workers, and it is one of the oldest graduate student unions in the United States. Developed out of the earlier Graduate Student Employees Association, the UO administration objected to the establishment of the union, citing that graduate workers were "not public employees", but were rather "primarily students receiving a form of financial aid similar to stipends or scholarships." The Oregon Employment Relations Board (ERB) ruled in favor of the graduate students and supported their right to organize. The GTFF began organizing its first contract in April 1977 with the University of Oregon administration. The negotiations reached an impasse in 1978, and it was not until after two strike votes that an agreement was reached. In 1989, the GTFF secured subsidies for health insurance, which was expanded in 1993 to be fully employer-paid, one of the first such programs offered to graduate teachers in the United States.

Postdoctoral researcher unionization is the formation of labor unions by postdoctoral researchers (postdocs). It has been driven by increasing competition for scarce tenure-track faculty positions, leading to more people residing in postdoctoral positions for a longer time. Unions often challenge the low pay, minimal benefits, and lack of job security that are typical of postdoctoral positions. Unionizing is however sometimes seen as creating a culture clash of tension between postdocs and their academic advisors, and some question the suitability of a union for a temporary position. Some universities seek to avoid pushes for unionization by proactively addressing the concerns of postdoctoral researchers.

The Harvard Graduate Students Union (HGSU), officially known as Harvard Graduate Students Union United Auto Workers (HGSU-UAW), is a labor union representing graduate students, teaching assistants, and other student employees at Harvard University. The bargaining unit comprises about 5,000 student employees, including graduate students working as research assistants and teaching fellows as well as several hundred undergraduate students holding teaching positions. Contract negotiations with the university are scheduled to begin in Fall 2018. HGSU is affiliated with the United Auto Workers labor union, whose 400,000 members include 45,000 graduate students and 30,000 academic workers.

The 2020 Santa Cruz graduate students' strike was a wildcat strike launched against the University of California, Santa Cruz (UCSC).

The 2021–2022 Columbia University strike was a labor strike involving graduate student workers at Columbia University in New York City. The strike began on March 15, 2021, and ended on May 13, 2021. However, additional strike action commenced on November 3 and lasted until January 7, 2022, when a tentative agreement with the university was reached. The strike was organized by the Graduate Workers of Columbia–United Auto Workers Local 2110 (SWC–UAW), a labor union representing student workers at the university. The goals of the strike were an increase in wages, increased healthcare and childcare coverage, and third-party arbitration in cases of discrimination and sexual harassment.

The 2021 Oregon Tech strike was a labor strike involving faculty members from the Oregon Institute of Technology. The strike was organized by the Oregon Tech - American Association of University Professors (OT-AAUP), a local union representing the faculty members that had been formed in 2018 and was recognized by the university in 2019. Following its recognition, the union and university entered into contract negotiations for the faculty members' first labor contract. However, negotiations proceeded slowly, and by early 2021, an agreement had not been reached. On March 17, both sides presented their final offers and the following month, union members voted to authorize strike action. On April 26, following a round of last-minute negotiations, the union officially commenced strike action.

The 2021 Virginia Volvo Trucks strike was a labor strike involving workers at a Volvo Trucks production facility in Dublin, Virginia, United States. The strike began in April and ended in July with the ratification of a new labor contract.

The 1986–87 John Deere strike and lockout was a conflict between Deere & Company, more commonly known as John Deere, and its employees. The workers, unionized as part of the United Auto Workers, began selective strikes at three Deere facilities on August 23, 1986. The selective strikes prompted Deere to close the rest of the facilities under the same labor contract as the original three striking locales, which the UAW, and later The New York Times, called a lockout. On February 1, 1987, workers ratified a tentative agreement which provided stronger benefits to Deere production employees. The conflict was the longest strike ever against Deere, lasting 163 days, or more than five months.

Student Researchers United-UAW (SRU-UAW) was a union representing student researchers at the University of California (UC). It was part of the United Auto Workers. The union was composed of more than 17,000 people who work across 10 UC campuses and the Lawrence Berkeley National Laboratory. They were the largest 2021 addition to the UAW, accounting for 0.1% of union members in the US, and, according to organizers, were "the largest academic student employee union in US history." The union later joined UAW 2865 and ceased to be an independent entity.

UAW Local 4811 is the chapter of United Auto Workers labor union representing academic student employees, graduate student researchers, academic researchers as well as postdoctoral researchers from all the 11 campuses of the University of California system. UAW Local 4811 was formed by merging UAW Local 2865 and UAW Local 5810 into one combined union in March 2024.
