Sir Anthony Paul Hayden (born 24 June 1961), styled The Hon. Mr Justice Hayden, is a judge of the High Court of England and Wales and former barrister appointed to the High Court.
He was called to the bar at Middle Temple in 1987 and was appointed a Queen's Counsel (QC) in 2002. [1] On 31 July 2013, he was appointed a judge of the High Court of Justice (Family Division) and invested with the customary knighthood in 2014. [2]
In 2018 he presided the Alfie Evans case over the legal challenge by the parents of Alfie Evans against Alder Hey Children's Hospital.
In 2019, he notoriously stated "I cannot think of any more obviously fundamental human right than the right of a man to have sex with his wife – and the right of the state to monitor that." [3] The statement referred to a case in the UK court of protection, brought by a council’s social services after the condition of the woman in question (who had learning difficulties) began to deteriorate. The statement caused substantial outcry from all sides, and was later (2024) used by Amnesty International in a misogyny-awareness quiz. [4]
In 2022, he was one of the judges to hear the Archie Battersbee case. [5]

The Bolton 7 were a group of gay and bisexual men who were convicted on 12 January 1998 in the United Kingdom before Judge Michael Lever at Bolton Crown Court of the offences of gross indecency under the Sexual Offences Act 1956. Although gay sex was partially decriminalised by the Sexual Offences Act 1967, they were all convicted under section 13 of the 1956 Act because more than two men had sex together, which was still illegal. One of the participants was also six months under the statutory age of consent for male gay sex: at the time, such an age was set at 18, while the heterosexual and lesbian age of consent was instead set at 16.

Obergefell v. Hodges, 576 U.S. 644 (2015), is a landmark decision of the Supreme Court of the United States which ruled that the fundamental right to marry is guaranteed to same-sex couples by both the Due Process Clause and the Equal Protection Clause of the Fourteenth Amendment of the Constitution. The 5–4 ruling requires all fifty states, the District of Columbia, and the Insular Areas to perform and recognize the marriages of same-sex couples on the same terms and conditions as the marriages of opposite-sex couples, with all the accompanying rights and responsibilities. Prior to Obergefell, same-sex marriage had already been established by statute, court ruling, or voter initiative in thirty-six states, the District of Columbia, and Guam.
Alfie James Evans, was an infant boy from Liverpool with an undiagnosed neurodegenerative disorder, later revealed to be GABA-transaminase deficiency. The medical team and the child's parents disagreed about whether to maintain his life support or to withdraw it, resulting in a legal battle. Alder Hey Children's NHS Foundation Trust sought a declaration that continued mechanical ventilation was "unkind and inhumane", and not in the child's best interests. Alfie's parents, Kate James and Thomas Evans, contested the application.

The courts ruled in favour of Barts Health NHS Trust, and against his parents, and allowed his life support to be withdrawn.
